PROPOSED MOTION
"The City Council adopts the attached resolution vacating a portion of the drainage and
utility easement on 7500 Chanhassen Road as described on the attached exhibit."
City Council approval requires a simple majority vote of those present.
BACKGROUND
A drainage and utility (D&U) easement is located on the
southeastern corner of 7500 Chanhassen Road. A stormwater i oiJui ` ` '�"
pipe is located on the southeastern portion of the property, cAtsx �
and this D&U easement grants access to the City to constructt.,. ;
and maintain this pipe. This storm sewer system mainly /% . ` fes—
drains Highway 101. : ... -:
As part of SWMP Project#17-08-01 by the City and the 'Noir •
Riley Purgatory Bluff Creek Watershed District, the , ecK.`' .1
stormwater pipe was removed and replaced closer to the edge 4 _ ..
of the property.
The residents of 7500 Chanhassen Road, Tracey and Chris f °
Rust, are removing and rebuilding there house and would like
to construct a new garage within a portion of the existing D&U easement. Building a permanent
structure in a(D&U) easement is not allowed.
A Gopher State One Call was completed in the easement. The markings on site did not indicate
private utilities are located within the easement.

Re: 7500 Chanhassen Road—Pasement Reduction
To whom it may concern,
My husband, Chris Rust and I have been living at 7500 Chanhassen Road, Chanhassen,
MN since October 2004. We are currently in the process of redeveloping our property to
demolish the existing home and rebuild a new home on the same property in
approximately the same location. Prior to purchasing the property, a utility and storm
sewer easement was created and recorded on May 14, 1987. When we purchased the
property an open drainage channel existed at the southeast corner that collected storm
water from Highway 101, Eden Prairie and neighboring properties and conveying it to
Lotus Lake. Within a couple of years, the open drainage way was in need of repair due to
extensive erosion on the property. The City then designed and installed underground
storm sewer and structures eliminating the open drainage way with the existing easement
remaining.
We would like to respectfully request that the existing easement be reduced (vacated and
rededicated) to align more with the existing underground storm sewer system. This
would reduce some of the burden placed on the property yet still allowing City access for
maintenance of the system.
We look forward to working with the City to resolve this item allowing us to move

RESOLUTION VACATING PUBLIC DRAINAGE & UTILITY
EASEMENTS ON 7500 CHANHASSEN ROAD
WHEREAS, pursuant to Minnesota Statutes Section 412.851, after two (2) weeks' published
and posted notice of the hearing and after mailing written notice of the hearing at least ten (10) days
before the hearing to each property owner affected by the proposed vacation, the Chanhassen City
Council has conducted a hearing to consider the vacation of the public drainage and utility easements
legally described on the attached Exhibit"A"; and
WHEREAS, following the hearing and consideration of the proposed vacation, the Council
has determined that it is in the public interest to vacate the public easements for right-of-way and
drainage and utility easements.
NOW,THEREFORE, BE IT RESOLVED by the City Council of the City of Chanhassen:
1. The public drainage and utility easements legally described on the attached Exhibit A
are hereby vacated.
2. The vacation shall not affect the authority of any person, corporation, or municipality
owning or controlling the electric or telephone poles and lines, gas and sewer lines, water pipes, mains
and hydrants thereon or thereunder, if any, to continue maintaining the same or to enter upon such way
or portion thereof vacated to maintain,repair,replace,remove,or otherwise attend thereto.
3. The City Manager is directed to file a certified copy of this Resolution with the County
Auditor and County Recorder of Carver County.

Public drainage and utility easement, described as:
That part of Lot 10, Block 1, SUNSET VIEW, bounded by the following described line:
Commencing at the southeast property corner of Lot 10, Block 1, SUNSET VIEW; thence on an
assumed bearing of North 00 degrees 51 minutes 23 seconds East, along the east property line of
said Lot 10, Block 1, a distance of 110.00 feet; thence South 78 degrees 35 minutes 48 seconds West
a distance of 125.00 feet; thence South 53 degrees 48 minutes 37 seconds East along the south
property line of Lot 10, Block 1, 150.44 feet to the point of origin, there terminating.
