"The City Council approves a consultant contract in the amount of$87,396.00 with WSB &
Associates and authorizes the preparation of a feasibility study for the Lake Drive East Street
Rehabilitation Project No. 18-02.
City Council approval requires a simple majority vote of the City Council present."
DISCUSSION
The Capital Improvement Program has planned for the rehabilitation of Lake Drive East in the
summer of 2018. Staff used the City's Pavement Management Program and site investigations to
determine the project extents, as illustrated in Figure 1. The project includes approximately 0.7
miles of urbanized streets.

Lake Drive East is a Municipal State Aid Route constructed in 1991, overlaid in 2002 and sealcoated
in 1995 and 2005. The 2015 surveyed pavement conditions were 66.8 and 67.3 on the west and east
sides of Dakota Avenue, respectively as shown in Figure 1. A PCI of 100 represents a new street.
According to 2015 traffic counts Lake Drive East carries approximately 3,600 vehicles per day.
The proposed project includes intersection improvements at the Dakota Avenue/Lake Drive East
intersection. The intersection has a stop condition for both directions of the Lake Drive East traffic.
Residents in the neighborhood to the south are concerned with eastbound Lake Drive East traffic
failing to yield to northbound Dakota Avenue traffic. There is also concern for pedestrian and bicyclist
safety at this intersection. The engineering consultant will collect and analyze traffic volume, turning
movement and accident data to provide recommended intersection improvement alternatives.
Dakota Avenue is also a Municipal State Aid Route constructed in 1986 and sealcoated in 2005. As
shown in Figure 1, the 2015 surveyed pavement condition was 74.4, which is higher than expected
due to the extensive patching along the street corridor. A 190-foot long, raised concrete median
separates north- and southbound Dakota Avenue. The northbound portion consists of two through
lanes, one left turn lane, and one right turn lane. The southbound portion consists of two lanes that
transition to a right turn and a through/left turn lane at the Lake Drive East intersection. According
to 2015 traffic counts, Dakota Avenue carries approximately 4,500 vehicles per day. Staff
recommends including Dakota Avenue in the project due to the underlying pavement condition, the
traffic volume, and the anticipated intersection improvements at Lake Drive East.
Twelve-inch ductile iron water main is within Lake Drive East and 8" cast iron water main is within
Dakota Avenue. There are no documented water main breaks within the project area. Some valves
and hydrants are anticipated to be repaired/replaced with this project.

Municipal sanitary sewer within the project area is 8" PVC pipe and 12" RCP. It is anticipated that
some sanitary sewer mains will need to be repaired or replaced. The City will have the sewer lines
televised to determine the scope of work.

Minor repairs to the storm sewer system is anticipated. The project shall include the installation of
drain tile to alleviate groundwater from weeping on to the street. The location and extent of drain tile
installation will be determined during the design process.

ENGINEERING SERVICES
The City requires consultant engineering services for the project including preparation of the
feasibility report,preliminary and final design, construction administrative and observation services,
and preparation of as-built drawings. Staff sent a request for proposals to three engineering
companies: HTPO, Kimley-Horn &Associates and WSB &Associates. All consultants submitted
proposals, as summarized below:

The proposed WSB team worked on the Park Road/Park Place (2017) rehabilitation project and has
extensive street and utility reconstruction project experience including the following projects in
Chanhassen: Orchard Lane(2018), Minnewashta Manor(2017), Minnewashta Heights (2012), Red
Cedar Point (2011), and the Erie Avenue Area (2010). Their work in Chanhassen and other
communities has been satisfactory. The consultant contract will be a time and materials based work
not-to-exceed amount. Depending on the outcome of the Dakota-Lake Drive intersection analysis
additional design services may be required.
As with all engineering contracts, the consultant must submit periodic invoices that staff will review
before processing. The consultant will be required to submit timesheets verifying the hours worked
on the project and expense sheets. Staff will review the invoices and expense sheets for accuracy
and conformance to the contract.
FUNDING
Budgets for the proposed work have been included in the 2017 CIP. The budgets will need to be
reviewed and updated based upon current construction cost estimates and after the feasibility report
is drafted. Funding for the project is proposed to come from mainly Municipal State Aid and has
been budgeted for in the 2017 Capital Improvement Plan as follows:

Justification
The City uses a Pavement Management System to monitor the condition of the City streets. While proper preventative maintenance extends the
life of the street and is cost effective,a street will eventually deteriorate to a point that further maintenance is no longer cost effective.
Rehabilitation projects extend the life of the street. In cases when utilities or poor sub grade needs to be replaced or where streets have
deteriorated to a point where rehabilitation will no longer be practical,reconstruction of the street is necessary. A feasibility study is written to
consider the merits of the project and scope of work.

EXHIBIT A
GENERAL CONTRACT PROVISIONS
ARTICLE 1 — PERFORMANCE OF THE WORK
Consultant shall perform the services under this Agreement in accordance with the care and skill
ordinarily exercised by members of Consultant's profession practicing under similar circumstances at the
same time and in the same locality. Consultant makes no warranties, express or implied, under this
Agreement or otherwise, in connection with its services.
ARTICLE 2 — ADDITIONAL SERVICES
If the Client requests that the Consultant perform any services which are beyond the scope as set forth in
the Agreement, or if changed or unforeseen conditions require the Consultant to perform services outside
of the original scope, then, Consultant shall promptly notify the Client of cause and nature of the
additional services required. Upon notification, Consultant shall be entitled to an equitable adjustment in
both compensation and time to perform.
ARTICLE 3 — SCHEDULE
Unless specific periods of time or dates for providing services are specified in a separate Exhibit,
Consultant's obligation to render services hereunder will be for a period which may reasonably be
required for the completion of said services. The Client agrees that Consultant is not responsible for
damages arising directly or indirectly from any delays for causes beyond Consultant's control. For
purposes of this Agreement, such causes include, but are not limited to, strikes or other labor disputes,
severe weather disruptions, or other natural disasters or acts of God; fires, riots, war or other
emergencies; any action or failure to act in a timely manner by any government agency, actions or failure
to act by the Client or the Client's contractor or consultants; or discovery of any hazardous substance or
differing site conditions. If the delays outside of Consultant's control increase the cost or the time required
by Consultant to perform its services in accordance with professional skill and care, then Consultant shall
be entitled to a reasonable adjustment in schedule and compensation.
ARTICLE 4 — CONSTRUCTION OBSERVATION
If requested by Client, Consultant shall visit the project during construction to become familiar with the
progress and quality of the contractors' work and to determine if the work is proceeding, in general, in
accordance with plans, specifications or other contract documents prepared by Consultant for the Client.
The Client has not retained the Consultant to make detailed inspections or to provide exhaustive or
continuous project review and observation services.
Consultant neither guarantees the performance of any Contractor retained by Client nor assumes
responsibility for any Contractor's failure to furnish and perform the work in accordance with the
construction documents. Client acknowledges Consultant will not direct, supervise or control the work of
contractors or their subcontractors, nor shall Consultant have authority over or responsibility for the
contractors' means, methods, or procedures of construction. Consultant's services do not include review
or evaluation of the Client's, contractors or subcontractor's safety measures, or job site safety. Job Site
Safety shall be the sole responsibility of the contractor who is performing the work.
For Client -observed projects, the Consultant shall be entitled to rely upon and accept representations of
the Client's observer. If the Client desires more extensive project observation or full-time project
representation, the Client shall request such services be provided by the Consultant as an Additional
Service. Consultant and Client shall then enter into a Supplemental Agreement detailing the terms and
conditions of the requested project observation.
ARTICLE 5 — OPINIONS OF PROBABLE COST
Opinions, if any, of probable cost, construction cost, financial evaluations, feasibility studies, economic
analyses of alternate solutions and utilitarian considerations of operations and maintenance costs,
collectively referred to as "Cost Estimates," provided for are made or to be made on the basis of the
Consultant's experience and qualifications and represent the Consultant's best judgment as an
experienced and qualified professional design firm. The parties acknowledge, however, that the

Consultant does not have control over the cost of labor, material, equipment or services furnished by
others or over market conditions or contractor's methods of determining their prices, and any evaluation
of any facility to be constructed or acquired, or work to be performed must, of necessity, be viewed as
simply preliminary. Accordingly, the Consultant and Client agree that the proposals, bids or actual costs
may vary from opinions, evaluations or studies submitted by the Consultant and that Consultant assumes
no responsibility for the accuracy of opinions of Cost Estimates and Client expressly waives any claims
related to the accuracy of opinions of Cost Estimates. If Client wishes greater assurance as to Cost
Estimates, Client shall employ an independent cost estimator as part of its Project responsibilities.
ARTICLE 6 — REUSE AND DISPOSITION OF INSTRUMENTS OF SERVICE
All documents, including reports, drawings, calculations, specifications, CADD materials, computers
software or hardware or other work product prepared by Consultant pursuant to this Agreement are
Consultant's Instruments of Service and Consultant retains all ownership interests in Instruments of
Service, including copyrights. The Instruments of Service are not intended or represented to be suitable
for reuse by the Client or others on extensions of the Project or on any other project. Copies of
documents that may be relied upon by Client are limited to the printed copies (also known as hard copies)
that are signed or sealed by Consultant. Files in electronic format fumished to Client are only for
convenience of Client. Any conclusion or information obtained or derived from such electronic files will be
at the user's sole risk. Consultant makes no representations as to long term compatibility, usability or
readability of electronic files.
If requested, at the time of completion or termination of the work, the Consultant may make available to
the Client the Instruments of Service upon (i) payment of amounts due and owing for work performed and
expenses incurred to the date and time of termination, and (ii) fulfillment of the Client's obligations under
this Agreement. Any use or re -use of such Instruments of Service by the Client or others without written
consent, verification or adaptation by the Consultant except for the specific purpose intended will be at
the Client's risk and full legal responsibility and Client expressly releases all claims against Consultant
arising from re -use of the Instruments of Service without Consultant's written consent, verification or
adaptation.
The Client will, to the fullest extent permitted by law, indemnify and hold the Consultant harmless from
any claim, liability or cost (including reasonable attorneys' fees, and defense costs) arising or allegedly
arising out of any unauthorized reuse or modification of these Instruments of Service by the Client or any
person or entity that acquires or obtains the reports, plans and specifications from or through the Client
without the written authorization of the Consultant. Under no circumstances shall transfer of Instruments
of Service be deemed a sale by Consultant, and Consultant makes no warranties, either expressed or
implied, of merchantability and fitness for any particular purpose. Consultant shall be entitled to
compensation for any consent, verification or adaption of the Instruments of Service for extensions of the
Project or any other project.
ARTICLE 7 — PAYMENTS
Payment to Consultant shall be on a lump sum or hourly basis as set out in the Agreement. Consultant is
entitled to payment of amounts due plus reimbursable expenses. Client will pay the balance stated on
the invoice unless Client notifies Consultant in writing of any disputed items within fifteen (15) days from
the date of invoice. In the event of any dispute, Client will pay all undisputed amounts in the ordinary
course, and the Parties will endeavor to resolve all disputed items. All accounts unpaid after thirty (30)
days from the date of original invoice shall be subject to a service charge of 1-1/2% per month, or the
maximum amount authorized by law, whichever is less. Consultant reserves the right to retain instruments
of service until all invoices are paid in full. Consultant will not be liable for any claims of loss, delay, or
damage by Client for reason of withholding services or instruments of service until all invoices are paid in
full. Consultant shall be entitled to recover all reasonable costs and disbursements, including reasonable
attorney fees, incurred in connection with collecting amounts owed by Client. In addition, Consultant
may, after giving seven (7) days' written notice to Client, suspend services under this Agreement until it
receives full payment for all amounts then due for services, expenses and charges. Payment methods,
expenses and rates may be more fully described in Exhibit C and Exhibit E.

ARTICLE 8 — SUBMITTALS AND PAY APPLICATIONS
If the Scope of Work includes the Consultant reviewing and certifying the amounts due the Contractor, the
Consultant's certification for payment shall constitute a representation to the Client, that to the best of the
Consultant's knowledge, information and belief, the Work has progressed to the point indicated and that
the quality of the Work is in general accordance with the Documents issued by the Consultant. The
issuance of a Certificate for Payment shall not be a representation that the Consultant has (1) made
exhaustive or continuous on-site inspections to check the quality or quantity of the Work, (2) reviewed
construction means, methods, techniques, sequences or procedures, (3) reviewed copies of requisitions
received from Subcontractors and material suppliers and other data requested by the Client to
substantiate the Contractor's right to payment, or (4) ascertained how or for what purpose the Contractor
has used money previously paid on account of the Contract Sum. Contractor shall remain exclusively
responsible for its Work.
If the Scope of Work includes Consultant's review and approval of submittals from the Contractor, such
review shall be for the limited purpose of checking for conformance with the information given and the
design concept. The review of submittals is not intended to determine the accuracy of all components,
the accuracy of the quantities or dimensions, or the safety procedures, means or methods to be used in
construction, and those responsibilities remain exclusively with the Client's contractor.
ARTICLE 9 — HAZARDOUS MATERIALS
Notwithstanding the Scope of Services to be provided pursuant to this Agreement, it is understood and
agreed that Consultant is not a user, handler, generator, operator, treater, arranger, storer, transporter, or
disposer of hazardous or toxic substances, pollutants or contaminants as any of the foregoing items are
defined by Federal, State and/or local law, rules or regulations, now existing or hereafter amended, and
which may be found or identified on any Project which is undertaken by Consultant.
The Client agrees to indemnify Consultant and its officers, subconsultant(s), employees and agents from
and against any and all claims, losses, damages, liability and costs, including but not limited to costs of
defense, arising out of or in any way connected with, the presence, discharge, release, or escape of
hazardous or toxic substances, pollutants or contaminants of any kind, except that this clause shall not
apply to such liability as may arise out of Consultant's sole negligence in the performance of services
under this Agreement arising from or relating to hazardous or toxic substances, pollutants, or
contaminants specifically identified by the Client and included within Consultant's services to be provided
under this Agreement.
ARTICLE 10 —INSURANCE
Consultant has procured general and professional liability insurance. On request, Consultant will furnish
client with a certificate of insurance detailing the precise nature and type of insurance, along with
applicable policy limits. Additional Insurance requirements are listed in Exhibit D.
ARTICLE 11 —TERMINATION OR SUSPENSION
If Consultant's services are delayed or suspended in whole or in part by Client, or if Consultant's services
are delayed by actions or inactions of others for more than sixty (60) days through no fault of Consultant,
Consultant shall be entitled to either terminate its agreement upon seven (7) days written notice or, at its
option, accept an equitable adjustment of rates and amounts of compensation provided for elsewhere in
this Agreement to reflect reasonable costs incurred by Consultant in connection with, among other things,
such delay or suspension and reactivation and the fact that the time for performance under this
Agreement has been revised.
This Agreement may be terminated by either party upon seven (7) days written notice should the other
party fail substantially to perform in accordance with its terms through no fault of the party initiating the
termination. In the event of termination Consultant shall be compensated for services performed prior to
termination date, including charges for expenses and equipment costs then due and all termination
expenses.
This Agreement may be terminated by either party upon thirty (30) days' written notice without cause.
Consultant shall upon termination only be entitled to payment for the work performed up to the Date of
termination. In the event of termination, copies of plans, reports, specifications, electronic drawing/data

files (CADD), field data, notes, and other documents whether written, printed or recorded on any medium
whatsoever, finished or unfinished, prepared by the Consultant pursuant to this Agreement and pertaining
to the work or to the Project, (hereinafter "Instruments of Service"), shall be made available to the Client
upon payment of all amounts due as of the date of termination. All provisions of this Agreement
allocating responsibility or liability between the Client and Consultant shall survive the completion of the
services hereunder and/or the termination of this Agreement.
ARTICLE 12 — INDEMNIFICATION
The Consultant agrees to indemnify and hold the Client harmless from any damage, liability or cost to the
extent caused by the Consultant's negligence or willful misconduct.
The Client agrees to indemnify and hold the Consultant harmless from any damage, liability or cost to the
extent caused by the Client's negligence or willful misconduct.
ARTICLE 13 — WAIVER OF CONSEQUENTIAL DAMAGES
The Consultant and Client waive claims against each other for consequential damages arising out of or
relating to this contract. This mutual waiver includes damages incurred by the Client for rental expenses,
for loss of use, loss of income, lost profit, project delays, financing, business and reputation and for loss
of management or employee productivity or of the services of such persons, and (2) Damages incurred
by the Consultant for principal office expenses including the compensation for personnel stationed there,
for losses of financing, business and reputation and for loss of profit except anticipated profit arising
directly from the Work. The Consultant and Client further agree to obtain a similar waiver from each of
their contractors, subcontractors or suppliers.
ARTICLE 14 — WAIVER OF CLAIMS FOR PERSONAL LIABILITY
It is intended by the parties to this Agreement that Consultant's services shall not subject Consultant's
employees, officers or directors to any personal legal exposure for the risks associated with this
Agreement. Therefore, and notwithstanding anything to the contrary contained herein, the Client agrees
that as the Client's sole and exclusive remedy, any claim, demand or suit shall be directed and/or
asserted only against Consultant, and not against any of Consultant's individual employees, officers or
directors.
ARTICLE 15—ASSIGNMENT
Neither Party to this Agreement shall assign its interest in this agreement, any proceeds due under the
Agreement nor any claims that may arise from services or payments due under the Agreement without
the written consent of the other Party. Any assignment in violation of this provision shall be null and void.
Nothing contained in this Agreement shall create a contractual relationship with or a cause of action in
favor of a third party against either the Consultant or Client. This Agreement is for the exclusive benefit of
Consultant and Client and there are no other intended beneficiaries of this Agreement.
ARTICLE 16 — CONFLICT RESOLUTION
In an effort to resolve any conflicts that arise during the design or construction of the project or following
the completion of the project, the Client and Consultant agree that all disputes between them arising out
of or relating to this Agreement shall be submitted to nonbinding mediation as a precondition to any
formal legal proceedings.
ARTICLE 17 — CONFIDENTIALITY
The Consultant agrees to keep confidential and not to disclose to any person or entity, other than the
Consultant's employees, subconsultants and the general contractor and subcontractors, if appropriate,
any data and information furnished to the Consultant and marked CONFIDENTIAL by the Client. These
provisions shall not apply to information in whatever form that comes into the public domain, nor shall it
restrict the Consultant from giving notices required by law or complying with an order to provide
information or data when such order is issued by a court, administrative agency or other authority with
proper jurisdiction, or if it is reasonably necessary for the Consultant to complete services under the
Agreement or defend itself from any suit or claim.

ARTICLE 18 — AVAILABLE INSURANCE PROCEEDS AND LIMITATION OF LIABILITY
Consultant maintains professional liability insurance with a liability limit of not less than $2,000,000 per
claim. The Consultant's total liability to Client shall not exceed the total available insurance policy limits
per claim available to Consultant under its professional liability insurance policy. Client hereby agrees
that to the fullest extent permitted by law, the Consultant's total liability to Client for any and all injuries,
claims, losses, expenses or damages whatsoever arising out of or in any way related to or arising from
this Agreement from any cause or causes including, but not limited to, Consultant's negligence, errors,
omissions, strict liability, breach of contract or breach of warranty (Client's Claims) shall not exceed the
total policy limits available to Consultant under its professional liability insurance policy for settlement or
satisfaction of Client's Claims under the terms and conditions of the Consultant's professional liability
insurance policy applicable hereto.
Notwithstanding the language above, Client agrees that with regard to any claim arising from or relating to
Consultant's provision of geotechnical engineering services, construction materials testing, special
inspections, and/or environmental engineering services, including but not limited to environmental site
assessments, that Consultant's liability for any claims asserted by or through Client shall be limited to
$50,000.
Client and Consultant each further agree that neither will be responsible for any incidental, indirect, or
consequential damages (including loss of use or loss of profits) sustained by the other, its successors or
assigns. This mutual waiver shall apply even if the damages were foreseeable and regardless of the
theory of recovery plead or asserted.
ARTICLE 19 — CONTROLLING LAW
This Agreement is to be governed by the laws of the State of Minnesota. Any controversy or claim arising
out of or relating to this Agreement, or the breach thereof, including but not limited to claims for
negligence or breach of warranty, that is not settled by nonbinding mediation shall be settled by the law of
the state of Minnesota.
ARTICLE 20 — LOCATION OF UNDERGROUND IMPROVEMENTS
Where requested by Client, Consultant will perform customary research to assist Client in locating and
identifying subterranean structures or utilities. However, Consultant may reasonably rely on information
from the Client and information provided by local utilities related to structures or utilities and will not be liable
for damages incurred where Consultant has complied with the standard of care and acted in reliance on that
information. The Client agrees to waive all claims and causes of action against the Consultant for claims
by Client or its contractors relating to the identification, removal, relocation, or restoration of utilities, or
damages to underground improvements resulting from subsurface penetration locations established by
the Consultant.

complete the feasibility, design, and construction of improvements to roads that are south of State
Highway 5 and include Dakota Avenue (State Highway 5 to Lake Drive East) and Lake Drive East

and receiving permits for the project. Eric has worked on numerous reconstruction projects and is very familiar
with special design considerations associated with residential reconstructions, utility construction, and roadway
section evaluation. A few examples of Eric's most recent work include reconstruction projects in the cities of

Deputy Project Manager
Monica will serve as the Deputy Project Manager for this Lake Drive East Street Improvement project.
Monica is a Senior Project Manager in our Municipal Group with thirteen years of experience, including
over six years with the City of Lakeville. At the City, Monica managed the City's Street, Utility and
Operations and Maintenance Divisions of the Public Works Department. Beyond consideration for the
technical aspects of any engineered design, Monica is keenly aware of the long-term operations and
maintenance needs associated with a project, and can work with multiple agencies to identify potential
long-term issues, and solutions, for a project.
Nick Preisler, EIT
Graduate Engineer
Nick will be responsible for the overall design and coordination of the project. He will work closely with
each of the design groups to ensure design milestones are met. Since joining WSB in 2013, Nick has
spent most of his time working with design teams that specialize in similar street rehabilitation projects
In addition to his design experience, he has also been the lead construction inspector for many roadway
construction projects, which gives him a unique and valuable viewpoint for our design team that
emphasizes constructability. Examples of his most recent work include street rehabilitation projects in the
cities of Shorewood, Maple Grove, Rogers, Chanhassen, and Osseo
Adam Gadbois, EIT
Graduate Engineer
Adam will assist in the overall design and coordination of the project. Since joining the Municipal Group
in 2016, he has worked with design teams whose focus has been municipal street reconstruction projects
similar to the Lake Drive East Street Improvement Project. Since joining WSB in March 2013, he has also
acted as the lead inspector on multiple street reconstruction and new development projects for the Cities
of Minnetrista and Lakeville. His experience in the field, as well as his experience with estimating, project
administration, and document controls, will be valuable to the design and implementation of the proposed
project.
Merle Jewell
CADD Specialist, Municipal
Merle will work closely with the entire team to support the design and administrative needs of this project. He
has over 35 years of varied civil engineering experience, primarily in detailed design and layout of street, storm
sewer, sanitary sewer, water main and grading projects. Merle is also responsible for providing cost estimates
for preliminary reports and construction projects. He has extensive experience with AutoCAD, Civil 3D, and
MicroStation.
Bill Alms, PE
Project Engineer
Bill has more than four years of professional water resources engineering consulting experience. He is
responsible for completing hydrologic and hydraulic analyses for drainage systems in a wide variety of water
resource management, transportation, and municipal projects. Bill has been responsible for the development
of State Aid Hydraulic reports, watershed permitting submittals, plans and specifications, and construction
management.
Mike Billings, EIT
Graduate Engineer
Mike is a Graduate Engineer in WSB's Water Resources Group with experience in storm sewer design, beach
restoration, and stormwater management review. He also has experience with field inspection, Geographic
Information Systems (GIS), and Civil 3D on multiple projects.
Shawn Williams
Senior Environmental Scientist
Shawn has more than ten years of professional environmental consulting experience. He completes wetland
delineations and reports, wetland replacement plans, ecological evaluations, threatened and endangered
species reviews, wetland permit applications, and woodland evaluations. Shawn has proven successful
coordinating with clients, project engineers, and agency staff to achieve timely results. For the MN Wetland
Conservation Act, he serves the role of local government unit (LGU) for several local municipalities.
Shawn has received formal training in wetland delineation methods, wetland plant identification, tree surveys,
floristic quality assessment methods, erosion control inspections, and geographic information systems (GIS).
He is certified through the University of Minnesota for Stormwater Construction Site Management and SWPPP
Design, and provides environmental compliance oversight for large transportation construction projects.
Chuck Rickart, PE, PTOE
Transportation Engineer
Chuck is a Senior Project Manager in our Transportation Engineering Group with more than 30 years of
experience in traffic and transportation engineering. Chuck's project experience has included project
management, planning and design for traffic safety improvement projects, traffic impact studies, traffic signal
design and construction, intersection lighting projects, parking studies and design, transportation planning,
pedestrian planning and design and Safe Routes to School projects.
He has extensive experience with the review and implementation of all traffic engineering aspects of
projects. This includes traffic data collection, work -zone safety, traffic control plans, signing, pavement
markings, lighting, and traffic signal systems.

Andrea Blanchette
Pavement Specialist
Andrea has an undergraduate degree and master's degree in civil engineering from the University of
Minnesota with an emphasis on pavements and materials. Her master's degree research detailed the
effect of heavy agricultural equipment on flexible and rigid pavements in rural roads in Minnesota,
Wisconsin, and Iowa. Andrea joined WSB's Pavements Section in 2011 and is now leading WSB's
pavements and pavement management efforts, incorporating experience from her work with GIS, contract
administration, and asset management. In that time, she has developed pavement management and asset
management systems for numerous counties and cities across the state. Her education, research, and
experience are valued additions to WSB's Construction Services Group and she is helping to expand an
already recognized pavements and materials group.
Tom Wood
Pavement Specialist
Tom has more than 35 years of experience and is an expert in asphalt -based emulsions. He has worked
with all types of pavement and previously worked for MnDOT both in the maintenance and pavement
research areas. He has worked on preventative maintenance treatments, surface treatments, in-place
recycling, HMA construction practices, asphalt forensics and mediation, and pavement preservation
research. Tom is well-known in his field for being an expert on chip sealing and microsurfacing. Tom has a
passion for sharing his expertise and has spoken at more than 100 conferences nationwide. He also has
authored multiple published reports on chip sealing, asphalt dust, and a variety of other topics.

Project
Understanding
The City of Chanhassen is seeking professional engineering
services for the feasibility; design, and construction
administration for a bituminous overlay of approximately 0.7
miles of local roadways south of Trunk Highway (TH) 5. Streets
within the project area include:
■ Dakota Avenue (TH 5 to Lake Drive East)
■ Lake Drive East (west of Dakota Avenue to Dell Road)
The streets included in the project area are Municipal State
Aid (MSA) streets and the City will be using State Aid funds to
finance a portion of the project. As a result, the plans prepared
for the project wiil incorporate MnDOT design standards and
will be formatted for State Aid review. In addition to State
Aid funds, special assessments to benefitting properties
are proposed, which will require State Statutes Chapter 429
processes be followed with project implementation.
One of the primary goals of the project is to provide intersection
improvements at the Dakota Avenue/Lake Drive East
southbound intersection. This intersection receives significant
traffic from vehicles exiting TH 5, and also accommodates
substantial pedestrian and bicycle traffic from the residential
neighborhood to the south. The ntersection has a 2 -way -stop
for east and westbound Lake Drive East traffic, but does not
have any traffic control for north and southbound traffic along
Dakota Avenue The City has rec&ved comciamts from area
residents who are concerned with eastbound traffic failing to
yield to northbound traffic along Dakota Avenue. In order to
determine the best improvement that will provide improved
intersection operation and safety for both vehicles and
pedestrians, a traffic analysis will be prepared as part of the
preliminary design task. This will Include collecting required
data and identifying alternatives for improvements at this
location.
There is a stormwater collection system in the area that is in
need of some minor repair work that may include rebuilding
structures, casting replacement and replacement of damaged
cone sections. This work is proposed to be completed with
WSB
the mill and overlay improvements. The final scope of work will
be determined by field inspections performed by City staff.
In addition to the minor storm sewer repair work, the project
will also include the addition of drain tile to supplement the
existing storm sewer to control groundwater and prevent it
from weeping on to Lake Drive. The location and extent of the
drain tile installation will be determined during the final design
process.
The watermain in the area consists of 12 -inch ductile Iron
pipe along Lake Drive East and 8 -inch cast iron pipe along
Dakota Avenue. The watermain within the project limits Is
considered to be in good condition with no history of breaks.
While no rehabilitation of the pipe is anticipated, some valves
and hydrants are anticipated to be repaired or replaced with
this project. Anode bags may be considered for installation In
conjunction with these repairs to minimize future deterioration of
the pipe and extend its useful life The location and extent of the
watermain repairs will be determined during final design with
input from City staff.
The sanitary sewer system consists of PVC and RCP pipe
materials and is in need of some minor repair work. The City
will complete the televising of the sanitary sewer system and
inspection of manholes within the project area. WSB will review
the televising logs and inspection reports to determine the
extent and locations of system repairs to extend the service
life of these facilities. Potential repairs may include: chemical
and grout sealing of joints and manholes, replacement of
deteriorated cone sections, and point repairs of the sewer pipe.
It is our understanding that final improvements to the system
will be selected by the City based on the selected consultant's
recommendations.
We understand that geotechnical services will be required for
the design of the project. Geotechnical services will not be
coordinated through our scope of services. These services will
be acquired under a separate contract by the City. Accordingly,
we have not included an allowance for geotechnical services.

Work Plan/
Approach
Based on our understanding of the project, WSB proposes the following scope of services. The schedule provided presumes award of
the consultant contract on April 24, 2017 and estimates substantial construction completion in October 2018
TASK 1 - Design and Bidding Services
1.1- Project Management
Project management is an essentiai task that WSB includes
with each project to maintain an open line of communication
between the City of Chanhassen and the WSB team. Proper
execution of this task allows us to monitor project progress in
relationship to project budget in order to minimize schedule
slipping and scope deviations. This task also involves quality
assurance and control reviews of documents and processes to
maximize efficiency in the project development process.

1.2 - Surveying for Design
Services/Data Collection
Initial underground data to be collected will be primarily based
on a Gopher State One Call design locate. Following the locate
request, WSB will contact each private utility company to inform
them of the project and to gather mapping of individual private
facilities within the project site Other work performed and
information to be collected will include
Topographic survey
WSB will perform the design survey at this stage to create
accurate base mapping and provide for accuracy as part
of the feasibility study. The preliminary design survey will be
completed using conventional survey methods with invert
verification of sanitary and storm sewer structures.
Base mapping
Base mapping will be created from the survey data collected.
Information on private and public utilities will also be
incorporated Into the base map in order to identify potential
conflicts at the feasibility level. As an added benefit, base
mapoing and design will be created - . ng 3-D Civil Design
in AutoCAD. WSB has developed design templates specifically
for use in drafrng and designing wim the 3-D program_ Tnose
templates will be provided to the City, along with all base files
for the project at no additional cost to the City.

1.3 — Preliminary Design
WSB will complete a preliminary design for all components
within the project, which will serve as the basis for the feasibility
study. The preliminary design will address the following
features:
Pavement Design
The design of the overlay section will be in accordance with
MnDOT design standards The geotechnical analysis will
include Ground Penetrating Radar (obtained by the City) to
determine existing pavement thicknesses. Based on that
analysis, WSB will complete the pavement design and report
for submittal and approval by MnDOT Discussions with City
staff have revealed that past mill & overlay projects have shown
significant early reflective cracking. Because of this, WSB
will investigate advanced techniques, such as the Texas
Under Seal, to help control reflective cracking. The Texas
Under Seal has been used by MnDOT with similar pavement
sections and has proven to be a cost effective way to
drastically reduce early reflective cracking.
Stormwater collection system improvements
Improvements to the local stormwater collection system will
be based on field reviews completed by City staff. In addition,
WSB will investigate options for the installation of drain tile to
supplement the existing storm sewer to control groundwater
and prevent it from weeping on to the street.
Watermain improvements
With input from City staff: WSB will determine the extent and
location of valves and hydrants that are in need of repair or
replacement. Anode bags may be considered for installation at
the location of these repairs to minimize future deterioration of
the pipe and extend its useful life.
Sanitary Sewer system improvements
The City will televise the gravity of the sanitary sewer system
and inspect the manholes within the area prior to completion
of the feasibility study. WSB will review the sanitary sewer logs
and inspection reports collected by the City and generate a list
of recommended improvements that can be incorporated into
the final design of the project.
Intersection analysis
WSB will prepare a traffic analysis and provide a
recommendation for improvements to the Dakota Avenue
and Lake Drive East intersection. The analysis will include the
following:
■ Data Collection: Traffic volume, turning movements,
pedestrian movements and crash data will be collected.
■ Intersection Analysis: An analysis of the intersection
will be conducted to identify alternatives to improve both
operations and safety. Up to three alternatives will be
prepared.
■ Alternative Evaluation: Criteria will be developed and
each alternative will be evaluated. Based on the evaluation,
a recommendation will be provided and included with the
Feasibility Report.

1.4 — Pavement Design Report
WSB will review existing pavement distresses in conjunction
with the recommendations made from the geotechnical
exploration obtained by the City. This will allow for the
development of a pavement section that will address
anticipated traffic loading and subgrade soil conditions, as well
as document the design and justification for the new pavement
section to be constructed with the project. This will be a
technical report submitted independently of the feasibility report
and project plans and specifications.
1.5 — Feasibility Report
Upon obtaining the approval of the preliminary design from City
staff, WSB will prepare a feasibility report that will include:
■ Report text
■ Graphics depicting proposed improvements
■ Engineer's opinion of probable cost
• Preliminary assessment roll
As part of the feasibility report, WSB will prepare a presentation
and handout materials for the project public hearing; and also
attend and facilitate the public hearing as needed.
1.6 — Final Design/Plan
Preparation
Feedback from residents at neighborhood meetings and the
public hearing, along with input from City staff, will provide the
basis for the final design and plan preparation. Once the City
Council has ordered the project following the public hearing,
WSB will complete the final design, which will include:
• Final Pavement design and typical section based on
MnDOT requirements.
■ Stormwater collection system improvements, including
structure repairs, casting adjustments/repairs, and drain tile
installation.
■ Watermain repairs identified through input from City staff.
■ Sanitary sewer repairs as determined by televising logs and
manhole inspection reports.
All elements of the final design will be documented in the
construction plans prepared for the project. The construction
plans will also detail miscellaneous items necessary for the
construction. The final plan set may consist of the following plan
sheets, as well as others necessary for bidding the project
• Title sheet
■ Alignment sheet (per MnDOT)
■ Statement of Estimated Quantities
■ Project tabulations (per MnDOT)
■ General construction details
■ Removal sheets
■ Street and storm sewer plan and profile
■ Water main and sanitary sewer plan and profile sheets as
needed
■ Surface water pollution prevention plan (SWPPP)
■ Restoration and turf establishment plans
Quantities will be calculated and tabulated on a bid proposai
form that will be distributed with the plans and specifications for
potential bidders to submit their individual bids. An engineer's
estimate of probable cost will also be created and given to the
City for review prior to bidding

1.7 — Project Manual
The project manual will be prepared based on the City of
Chanhassen's standard specifications for construction and will
contain all contract documents relating to the project.

1.8 — Permits
Based on the nature of the construction and overall size of the
project, the following permits will be prepared and submitted on
behalf of the City:
■ Minnesota Pollution Control Agency - NPDES Construction
Activity Permit. This permit will not be required for the mill
and overlay component of the project.
■ Riley Purgatory Bluff Creek Watershed - Erosion and
sediment control.
■ MI Work in Right -of -Way -- Work adjacent to TH 5

1.9 — Bidding Services
Upon authorization from the City Council to bid the project,
WSB will provide bidding support services, including plan and
specification reproduction and distribution, fielding questions
from potential bidders, and providing a final engineer's opinion
of probable cost. WSB will also attend the bid opening,
and prepare a tabulation of bids received and a letter of
recommendation for contract award.
1.10 — Preparation of
Assessment Rolls
WSB will prepare the preliminary assessment roll at the
feasibility stage of the project, based on preliminary costs.
The assessment rolls will include all necessary information,
including parcel identification numbers, property owner
name and address, along with the basis of assessment and
assessment amount. The preliminary assessment roll will
be updated based on final design quantities for use at the
assessment hearing and then be updated again after the bids
are received for the project.
1.11 — Meetings
Work completed under this task will include project meetings
listed as follows:
■ Preparation of meeting materials and attendance at two (2)
City Council meetings
■ Preparation of meeting materials and attendance at two (2)
neighborhood informational meetings
■ Up to three (3) progress meetings with City staff
■ Up to two (2) individual property owner meetings
TASK 2 — Construction
Services
Contract Administration components will include facilitation and
attendance at the preconstruction conference, weekly meetings
as required, processing applications for payment, and
managing personnel and project issues on a day-to-day basis.
WSB will provide construction observation services and
personnel that have the appropriate MnDOT certifications
for the work being performed. Construction observation
services will include on-site presence during construction and
completing appropriate MnDOT required documentation and
reporting, along with tracking quantities for payment.
Inspection hours associated with the intersection improvements
may require further consideration based on the final
recommendations and scope of work.

TASK 3 — Preparation
of As -Built Drawings,
Including Necessary
Surveying Work
A draft of the as -built drawings will be completed and delivered
to the City for review within one month following the completion
of the construction. Final edits will be made to the drawings and
delivered to the City within two weeks following the initial review.
Services necessary for the completion of the as -built drawings
will include the following:
• Surveying to locate and identify as -built elevations for
repaired hydrants, valves, and structures
■ Structure measure downs on repaired facilities
■ Record drawing preparation
• Any necessary tie cards for repaired utilities.
The scope of services as proposed herein is based on services
identified as necessary in the RFP from the City, review of the
project site, and discussions with City staff.

The proposed project schedule will extend from 2017 (design) to 2018 (construction). Typically, engineering fees increase annually to account for inflation.
However, WSB will honor the prices as proposed herein to aid in maintaining the City's budget. The proposed hours listed in the task hour budget for
construction observation are assumed to provide project coverage during all construction activities for an expected period of 5 weeks at 30 hours per
week and 30 hours for State Aid close-out documentation.
WSB is willing to renegotiate the proposed fee if the scope of the project needs is reduced based on preliminary findings during the utility investigation,

Construction Schedule
The proposed construction schedule stated in the RFP lists a Fall 2018 to October 2018 timeframe for the selected contractor to reach
substantial completion for the construction. The schedule appears to be adequate for the work involved and we will meet the City's
timeframe in plan development and bidding of the project.

EXHIBIT F
CLIENT RESPONSIBILITIES
The Client's responsibilities related to the services to be provided by Consultant are generally as set out
below. These responsibilities can be modified through Supplemental Agreements.
In order to permit the Consultant to perform the services required under this Agreement, the Client shall,
in proper time and sequence and where appropriate to the Project, at no expense to the Consultant:
ARTICLE F.1
Provide available information as to its requirements for the Project, including copies of any design and
construction standards and comprehensive plans which the Client desires Consultant to follow or
incorporate into its work.
ARTICLE F.2
Guarantee access to and make all provisions for the Consultant to enter upon public and private lands to
enable the Consultant to perform its work under this Agreement.
ARTICLE F.3
Provide such legal, accounting and insurance counseling services as may be required for this Project.
ARTICLE FA
Notify the Consultant whenever the Client observes or otherwise becomes aware of any defect in the
Project construction or design.
ARTICLE F.5
Designate a Client Representative with authority to transmit and receive instructions and information,
interpret and define the Client's policies with respect to services rendered by the Consultant, and
authority to make decisions as required for Consultant to complete services required under this
Agreement.
ARTICLE F.6
Act promptly to approve all pay requests, Supplemental Agreements, or request for information by
Consultant as set out below.
ARTICLE F.7
Furnish data (and professional interpretations thereof) prepared by or services performed by others,
including where applicable, but not limited to, previous reports, core borings, sub -surface explorations,
hydrographic and hydrogeologic surveys, laboratory tests and inspection of samples, materials and
equipment; appropriate professional interpretations of the foregoing data; environmental assessment and
impact statements, property, boundary, easement, right-of-way, topographic and utility surveys; property
description; zoning, deed and other land use restrictions; and other special data.
ARTICLE F.8
Require all Utilities with facilities in the Client's Right of Way to Locate and mark said utilities upon
request, Relocate and/or protect said utilities as determined necessary to accommodate work of the
Project, submit a schedule of the necessary relocation/protection activities to the Client for review and
comply with agreed upon schedule.
ARTICLE F.9
Review all reports, sketches, drawings, specifications and other documents prepared and presented by
the Consultant, obtain advice of legal, accounting and insurance counselors or others as Client deems
necessary for such examinations and render in writing decisions pertaining thereto.

ARTICLE F.10
Where appropriate, endeavor to identify, remove and/or encapsulate asbestos products or materials or
pollutants located in the project area prior to accomplishment by the Consultant of any work on the
Project.
ARTICLE F.11
Provide record drawings and specifications for all existing physical plants of facilities which are pertinent
to the Project.
ARTICLE F.12
Provide the foregoing in a manner sufficiently timely so as not to delay the performance by the Consultant
of the services in accordance with the Contract Documents.
ARTICLE F.13
Consultant shall be entitled to rely on the accuracy and completeness of information or services furnished
by the Client or others employed by the Client. Consultant shall endeavor to verify the information
provided and shall promptly notify the Client if the Consultant discovers that any information or services
furnished by the Client is in error or is inadequate for its purpose.
ARTICLE F.14
Client shall bear all costs incidental to compliance with the requirements of this article.
