City Council approval requires a simple majority vote of the City Council present. 7D — (o The local watershed districts have requested the City support minor boundary changes. The administrative and taxing boundary between the Carver County Watershed Management Organization (CCWMO) and the Minnehaha Creek (MCWD) and Riley Purgatory Bluff Creek (RPBCWD) Watershed Districts has not matched the true drainage patterns of the watersheds since their creation decades ago. The boundary has not been updated since 1967 and the legal description since 1997. The overall goal of this effort is to better align the tax boundaries with actual stormwater drainage. Numerous developments have occurred along the boundary since the watershed districts were formed creating inconsistencies on permitting, lack of input on water drainage impacts and lack of control on protection of area water resources. Estimate based on 2016 tax rates. The watershed districts has notified the property owners about the proposed change. City staff has not received any feedback from property owners on the proposed change. Once all the agencies have approved the change, the petition for boundary change will be sent to the Board of Water and Soil Resources (BWSR) for approval. BWSR will notice the petition for a 20 -day comment period. BWSR may hold a public hearing depending on the comments received. If BWSR approves the parcels switch, the tax designation change will take effect in 2018. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF CHANHASSEN, MINNESOTA: 1. That the City of Chanhassen supports the submission of a petition to the Minnesota Board of Water and Soil Resources pursuant to Minnesota Statues 103D to alter the boundaries of the CDWMO, MCWD, and RPBCWD.
