PROPOSED MOTION:
"The City Council amends the Foxwood Addition Highway 101 Trail Reimbursement CIP
budget from $400,000 to $805,350 utilizing$768,350 from the park dedication fund and
$37,000 from the water utility fund."
Approval requires a simple majority vote of the City Council.
BACKGROUND
On July 25,2016, the final plat for Foxwood was approved, including the following park and trail
conditions of approval:
a. Full park dedication fees shall be collected per city ordinance in lieu of requiring parkland
dedication.
b. Dedication of an outlot adjacent to Lot 12, Block 5 and across the southern portion of Lot 5,
Block 5 to accommodate future construction of a trail.
c. Planning, engineering and construction of two planned 10-foot wide trail connections leading
from two cul-de-sacs into the Fox Woods Preserve.
d. Planning, engineering and construction of a planned 10-foot wide Highway 101 trail
connection between the current trail terminus at the Bandimere Park Pedestrian Underpass
and the northern terminus of the plat adjacent to and along Highway 101.
e. Trail right of ways within the subdivision shall be provided within outlots as a condition of
the plat. Acquisition of trail easements outside of the plat shall be the responsibility of the
City of Chanhassen.

f. The Developer shall be responsible for the installation and payment of the two planned 10-
foot wide trail connections leading from two cul-de-sacs into the Fox Woods Preserve.
g. For those sections of the Hwy 101 trail situated north and south of their property boundaries,
the Developer shall be reimbursed by the City of Chanhassen for the full cost of planning,
engineering and construction of a planned 10-foot wide Highway 101 trail connection
between the current trail terminus at the Bandimere Park Pedestrian Underpass and the
northern terminus of the plat along Highway 101.
h. For that section of the Highway 101 trail located within or adjacent to the Developer's
project boundary, the applicant shall be reimbursed by the City for the cost of the aggregate
base, trail surfacing,retaining walls, and storm water systems utilized to construct the trail.
This reimbursement payment shall be made upon completion and acceptance of the trail and
receipt of an invoice documenting the actual costs for the construction materials noted. Labor
and installation for the trail surface and design, and engineering and testing services for all
components of the Developers section, are not reimbursable expenses.
i. All trails shall be 10 feet in width, surfaced with asphalt, and constructed to meet city
specifications.
j. The granting of a pennanent 20 foot wide trail easement across the rear of lots 8 and 9, Block
3.
DISCUSSION
Foxwood LLC, the developer,paid $266,800 in park fees at the time the Foxwood plat was
recorded.
The 2017-2021 Capital Improvement Program 5-Year Plan includes $400,000 in 2017 project
PK&T 134. Per their development contract with the city, Foxwood LLC is responsible for the
planning and construction of a Highway 101 trail connection between the current trail terminus
at Bandimere Park Pedestrian Underpass and the northern terminus of the Foxwood plat adjacent
to and along Highway 101. These dollars will reimburse the developer for the city share of
expenses.
On March 8,2017, the developer's engineer delivered a project plan set and engineer's estimate
without contingency for construction of the city portion of the pedestrian trail and retaining walls
totaling$310,552.
On March 14, 2017, the city received approval from the Minnesota Department of Health for the
relocation of the water main currently in place to accommodate the construction of retaining
walls and the pedestrian trail.
On April 10, 2017, the city received a permanent easement for trail purposes, temporary
easement for trail construction, and agreement and release of claims to amend the final certificate

as to Parcel 4/Blanski to correct the legal description of property acquired previously from David
and Mary Blanski.
On April 20, 2017, the city received permit approval from the Riley Purgatory Bluff Creek
Watershed District to construct 350 feet of 10-foot wide trail in the TH 101 right of way about
1,500 feet south of Lyman Boulevard. The trail construction requires site grading,relocation of a
segment of water main, construction of 2 retaining walls, and site restoration.
On May 25, 2017, the city received permit approval from the Minnesota Department of
Transportation to excavate, grade, and construct retaining walls and a 10-foot wide pedestrian
trail with state highway right-of-way at this location.
On June 2, 2017,the developer's engineer delivered two bids for completing the grading and
retaining walls for city portion(outside of the Foxwood plat) of the Highway 101 trail extension
construction. The high bid of$581,000 was received from Hawkins Tree& Landscaping. The
low bid of$535,000 was received from Hardscapes Contracting. The primary drivers of the
increased costs are MN Dot retaining wall design requirements and the lack of a larger adjacent
project to accept excess dirt from grading activity. Combining the grading and wall costs with
paving($15,000), watermain ($37,000), easements ($35,000), engineering/design/inspection
($65,000),reimbursement to Gonyea Homes for the materials to construct their portion of the
trail ($80,000), and a 5% contingency($38,350), the estimated grand total for the work is
$805,350.
City staff has reviewed the bids and unit pricing delivered by the developer and finds them to be
acceptable and in accordance with current unit pricing.
PARK AND RECREATION COMMISSION RECOMMENDATION
On June 27, 2017, the Park and Recreation Commission reviewed and discussed this proposed
budget amendment. At the conclusion of their discussion, Commissioner Kelly moved and
Commissioner Echternacht seconded a motion recommending that the City Council amend the
Foxwood Addition Hwy 101 Trail Reimbursement CIP budget from $400,000 to $805,350
utilizing$768,350 from the park dedication fund and $37,000 from the water utility fund.

101. These dollars will reimburse the developer for the City share of expenses.
Justification
This section of trail is included in the City of Chanhassen and Carver County comprehensive trail plan. Its construction will create an essential
pedestrian connection between the new Foxwood neighborhood and Bandimere Community Park as well as serve the greater community.
