2017-57 CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES,MINNESOTA DATE: August 28,2017 RESOLUTION NO: 2017-57 MOTION BY: McDonald SECONDED BY: Campion RESOLUTION IN SUPPORT OF CARVER COUNTY'S APPLICATION FOR TRANSPORTATION ECONOMIC DEVELOPMENT(TED)PROGRAM FUNDING FOR HIGHWAY 41 AT LYMAN BOULEVARD WHEREAS,the Minnesota Department of Transportation is soliciting funding applications for the Minnesota Transportation Economic Development Program(TED) which provides competitive grants to construction projects on state highways that provide measurable economic benefits; WHEREAS,the Minnesota Department of Transportation(MnDOT) is accepting candidate projects for State Highway Construction Projects in Calendar Years 2018 through 2020 with applications due on September 15, 2017; WHEREAS,the TED Program may provide funding for up to 70 percent of the eligible project cost, and applicants are required to identify other public and/or private funding sources that will be leveraged to contribute to the transportation construction cost of the proposed project; WHEREAS,to be eligible for funding, a proposed project must have a trunk highway purpose— it must improve, enhance or modify a state trunk highway or highway right of way; WHEREAS, Carver County is seeking Minnesota TED Program funds to complete improvements on the TH 41 (Hazeltine Blvd. /Chestnut St.) and CSAH 18 (Lyman Blvd.) intersection in the City of Chaska. WHEREAS,the subject improvements have been developed to preliminary design plans and identified as a priority project for Carver County, the City of Chaska, and the City of Chanhassen; WHEREAS,the County, the City of Chaska and the City of Chanhassen are seeking support and partnerships with the business communities along TH 41 and CSAH 18 to support an application for this funding; WHEREAS,the County, the City of Chaska and the City of Chanhassen will share in the local cost share responsibility of the applicable projects in accordance with the MnDOT and Carver County Cost Participation Policy. WHEREAS, these road improvements specifically target transportation improvements that will lead to measureable economic benefits and contribute to job creation or retention or other measurable economic benefits; NOW THEREFORE BE IT RESOLVED, that the City of Chanhassen supports and approves Carver County's application and local match commitment for the Minnesota Transportation Economic Development Program funding for the Calendar Years 2018 through 2020 in order to complete improvements on the TH 41 (Hazeltine Blvd. /Chestnut St.) and CSAH 18 (Lyman Blvd.) Intersection in the City of Chaska, and hereby authorizes and directs the Carver County Engineer to submit the application. 1 BE IT FURTHER RESOLVED that Carver County acts as the legal sponsor for the project contained in the Transportation Economic Development(TED) Program Application to be submitted on September 15, 2017 and that the County Engineer and Deputy County Engineer are hereby authorized to apply to the Minnesota Department of Transportation for funding of this project on behalf of Carver County. BE IT FURTHER RESOLVED that Carver County has the legal authority to apply for financial assistance, and the institutional,managerial, and financial capability to ensure matching funds and adequate construction of the proposed project. BE IT FURTHER RESOLVED that Carver County has not violated any Federal, State or local laws pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest or other unlawful or corrupt practice. BE IT FURTHER RESOLVED that upon approval of its application by the state, Carver County may enter into an agreement with the State of Minnesota for the above-referenced project, and that it will comply with all applicable laws and regulations as stated in all contract agreements. BE IT FURTHER RESOLVED that, Carver County confirms if the project cost increases above the amount listed in the Application, Carver County will provide or secure all additional funds necessary to complete the project. BE IT FURTHER RESOLVED that Carver County certifies that it will comply with all applicable laws, regulations, and rules of the Application. BE IT FURTHER RESOLVED that the sources and uses, private investors, equity, and other financing commitment represented in the attached document are accurate. NOW, THEREFORE BE IT FURTHER RESOLVED that the County Engineer and the Deputy County Engineer or their successors in office, are hereby authorized to execute such agreements, and amendments thereto, as are necessary to implement the project on behalf of the applicant, Carver County.
