SUMMARY MINUTES
SEPTEMBER 25, 2017
Mayor Laufenburger called the meeting to order at 7:10 p.m. The meeting was opened
with the Pledge to the Flag.
COUNCIL MEMBERS PRESENT: Mayor Laufenburger, Councilwoman Tjornhom,
Councilman McDonald, Councilwoman Ryan, and Councilman Campion

Councilman McDonald moved, Councilwoman Tjornhom seconded to approve the agenda
as written. All voted in favor and the motion carried unanimously with a vote of 5 to 0.
PUBLIC ANNOUNCEMENTS: None.
CONSENT AGENDA: Councilman McDonald moved, Councilwoman Tjornhom
seconded to approve the following consent agenda items pursuant to the City Manager’s
recommendations:

2. Receive Planning Commission Minutes dated September 5, 2017
3. Receive Park and Recreation Commission Minutes dated August 22, 2017

4. Chanhassen High School-2200 Lyman Boulevard: Approve Fireworks Display Permit
for the Chanhassen High School Storm Chasers Booster Club for October 13, 2017.

6. Resolution #2017-62: Accept $500 Donation from Charter Bank for 2017 Senior
Holiday Party.

Watershed District for Storm Water Pond Maintenance.

All voted in favor and the motion carried unanimously with a vote of 5 to 0.
VISITOR PRESENTATIONS: Frank Ernst, 840 Cree Drive shared his thoughts about some of

the actions that took place at the September 11 meeting, specifically Councilwoman Tjornhom
who singled out a resident, his wife Vicki Ernst, because she may have chuckled. He read from
23 emails that he and his wife have received criticizing, belittling and threatening them. After
reading some of the emails he asked that Councilmember Bethany Tjornhom step down from the
Chanhassen City Council. Randy Cantin, 6694 Nez Perce stated he was in full support of what
Frank Ernst requested of the Mayor and City Council. Michael Leonard, 8129 Stone Creek
Drive stated the behavior between Councilwoman Tjornhom and former Councilmember Vicki
Ernst at the September 11, 2017 meeting was in his words, junior high. Rollie Neve, 7635
Nicholas Way stated his support for the comments made by Frank Ernst.
FIRE DEPARTMENT/LAW ENFORCEMENT UPDATE. Assistant Chief Jim Van Asten
presented the monthly update for August regarding staffing, calls for service, training, open
house, and their assistance with the wake and funeral service for City of Wayzata’s fallen police
officer Bill Matthews. Lt. Eric Kittelson provided updates for August monthly calls for service,
arrest and citation summary, training, community relations and community policing project.
MINNEWASHTA MANOR AREA STREET & UTILITY RECONSTRUCTION
PROJECT 2016-01: PROJECT UPDATE.

Paul Oehme presented an overview of this project. Councilman McDonald asked about the
impact on residents in this area by not completing the project this year and an explanation of
small utilities. Councilwoman Ryan asked for clarification on staff’s communication with the
residents. Mayor Laufenburger asked for clarification on the mismarking of utilities.
Resolution #2017-62.5: Councilman McDonald moved, Councilman Campion seconded
that the Chanhassen City Council approve a resolution calling for an assessment hearing
for a supplement assessment for the 2016 street improvement Minnewashta Manor Area
Street Reconstruction Project No. 16-01. All voted in favor and the motion carried
unanimously with a vote of 5 to 0.
Mayor Laufenburger opened up the meeting for public comment. Nicole Nejezchleba, 2851
North Manor Road reviewed the history of this construction project’s approval process,
construction, assessment methodology and assessment due date. Chad Herman, 2851 North
Manor Road explained that this construction project has been a complete nightmare noting the
biggest issue was the lack of communication between the City, contractor and the residents.
Mayor Laufenburger directed staff to prepare options to modify assessments and insure that this
is handled efficiently for all 59 people; that staff get counsel from Carver County on what leeway
they may give for presentation and collection of assessments and asked the City Manager to take
to heart the comments from at least two of the people in this project area regarding
communications and their perception of workmanship in the project area. Staff addressed
comments made by Councilman Campion regarding changing the payment deadline date and
Councilwoman Ryan about how the City is dealing with the contractor.
PUBLIC HEARING: VACATE PUBLIC DRAINAGE AND UTILITY EASEMENTS IN
REDSTONE RIDGE.
Paul Oehme presented the staff report on this item. Mayor Laufenburger opened the public
hearing. Robert Rabe, 6307 Teton Lane asked for clarification of the proposed vacation. Mayor
Laufenburger closed the public hearing.
Resolution #2017-63: Councilwoman Ryan moved, Councilman Campion seconded that
the City Council adopts a resolution approving the vacation of all the public drainage and

utility easements dedicated on the recorded plat of Curry Farms 2 Addition that lie
within Lots 2 and 3, Block 1, Redstone Ridge as described in Exhibit A. All voted in favor
and the motion carried unanimously with a vote of 5 to 0.
CERTIFY PRELIMINARY 2018 LEVY TO CARVER COUNTY AUDITOR.
Greg Sticha presented the staff report on this item. Councilwoman Ryan asked that information
regarding contractual services and consultant fees be presented prior to final adoption of the
levy.

City Council Summary – September 25, 2017
Resolution #2017-64: Councilman McDonald moved, Councilman Campion seconded that
the City Council approves Resolution 2017-64 adopting the Preliminary Levy of
$10,913,868 for 2018 and Establishing the Truth-in-Taxation Hearing Date for 2017 as
December 4, 2017 for Taxes Collectible in 2018. All voted in favor and the motion carried
unanimously with a vote of 5 to 0.
COUNCIL PRESENTATIONS. None.
ADMINISTRATIVE PRESENTATIONS. Todd Gerhardt provided an update on an
agreement with Carver County to do a shared cost study for the upgrade of Galpin Boulevard
north of Highway 5 and maintenance work being done on the new Highway 101 river crossing

bridge on Monday, October 2.
CORRESPONDENCE DISCUSSION. Councilwoman Ryan asked for an update on when
Powers Boulevard will re-open.
Councilman McDonald moved, Councilwoman Tjornhom seconded to adjourn the
meeting. All voted in favor and the motion carried unanimously with a vote of 5 to 0. The
City Council meeting was adjourned at 9:15 p.m.
