I don't have a problem with that either as it's in the same BSA.
As we discussed ding the meeting on 11/29/2017, the memo dated 11/20/2017 requesting sequencing flexibility
complies with WCA rules. Two (potentially 3) of the four categories allowing sequencing flexibility have been meet
support the application.

A quick follow up on the banks proposed for Avienda.
The original banks are:
1494, Drummer, BSA9, Wtshd 32, Blue Earth — 4.9 acres credit
1605, Schmidgall, BSA9, Wtrsh 23, Stevens — 2.5 acres credit
174, Ryan, BSA9, Wtsh 33, Rice —1.74 ac (mostly upland)
#174 is the one that has the PA expiring. This was the only one in the same watershed. The applicant may or may not
push to extend the PA — the bank holder is reluctant to extend the PA. If the bank owner does not want to sell, I don't
think the TEP can make them buy those credits if they are not available.
The new bank is:
#1636, Kremer, BSA9, Wtsg 25, Lyon CO. — would be used for the 1.74 acres
The new bank meets the same BSA requirement. As we discussed, I told Melissa the TEP did not have immediate
concerns with the new proposed bank.
