"The Chanhassen City Council recommends approval:
An ordinance amending the PUD to allow liquor sales at Paisley Park from Monday, January
29, 2018 through Sunday, February 4, 2018 from 7:00 p.m. until 1:00 a.m. with the
recommendation of limiting the number of guests to 500 per night.
City Council approval requires a simple majority vote of those present.
SUMMARY
Paisley Park, located at 7801 Audubon Road, is requesting a special event permit for a series of
after-hours parties during the week of the Super Bowl. While Paisley Park's Planned Unit
Development (PUD) ordinance allows for the hosting of private events, the proposed parties
would occur outside of normal business hours, thus requiring a permit. Additionally, Paisley
Park is interested in serving cocktails during these events. Since the PUD Ordinance specifically
prevents liquor sales and consumption, PPark Management has also applied for PUD amendment
to allow a onetime exception from the alcohol prohibition.
ANALYSIS
The original request proposed private events would be held Monday, January 29, 2018 through
Sunday, February 4, 2018 from 7:00 p.m. to 11:00 p.m. nightly. The private events would
involve watching Prince themed movies and videos and, pending the proposed PUD amendment,
drinking cocktails. The proposed size of the events ranges from 500 to 1,000 guests. Guests

attending private parties will arrive by bus and the museum's normal security and parking
employees will staff the events. The gift shop will be open during these events and the applicant
will erect a 40 -foot by 70 -foot tent, pending approval from the building department. The
applicant has stated that they feel it is unlikely that they will host a private event every night but
that they wish for the permit to provide them with the flexibility to host events throughout the
week.
At the Planning Commission Public hearing on December 4th there was discussion on:
• the operation of the venue (what is included in the events)
• the requirements of the caterer's license (including food and intoxicating liquor service)
• the original request for number of possible guests attending was listed on the application
as 1000
• the hours of operation ( the application asked to modify the request for hours to be
extended until 1:00 am
• residents were concerned about possible sex trafficking
After the public hearing the commission discussed the issues raised and recommended that the
number of quests on any one night be limited to 500 (this would be condition of the Special
Event Permit) and that the hours be extended until 1:00 a.m. The commission voted to 3 to 1 in
support the ordinance amending the PUD. The minutes from the December 5th meeting are
included in the January 8th City Council Packet.

SUMMARY
The applicant PPark Management for the Paisley Park Museum located at 7801 Audubon Road,
is requesting an amendment to the Planned Unit Development (PUD) ordinance governing the
use of the property to permit liquor sales as a part of one week of activities associated with the
Super Bowl.
BACKGROUND
Paisley Park is requesting a special event permit for a series of after-hours parties during the
week of the Super Bowl. While Paisley Park's Planned Unit Development (PUD) ordinance
allows for the hosting of private events, the proposed parties would occur outside of normal
business hours, thus requiring a permit. Additionally, Paisley Park is interested in serving
cocktails during these events. Since the PUD Ordinance specifically prevents liquor sales and
consumption, PPark Management has also applied for PUD amendment to allow a onetime
exception from the alcohol prohibition.
ANALYSIS
On October 24, 2016, the City Council approved the rezoning of the Paisley Park Property to
permit a Museum. The Rezoning was a PUD the specified uses for the site. One of the

prohibited uses was liquor sales and consumption. The operator of the museum is requesting
approval to serve liquor for the week of the Super Bowl. An amendment to the PUD is required.
It is the city's intention to amend the PUD to allow for liquor to be served for one week only.
The proposed private events would be held Monday, January 29, 2018 through Sunday, February
4, 2018 from 7:00 p.m. to 11:00 p.m. nightly. The private events would involve watching Prince
themed movies and videos and, pending the proposed PUD amendment, drinking cocktails. The
proposed size of the events ranges from 500 to 1,000 guests. Guests attending private parties will
arrive by bus, and the museum's normal security and parking employees will staff the events.
The gift shop will be open during these events, and the applicant will erect a 40 -foot x 70 -foot
tent, pending approval from the building department. The applicant has stated that they feel it is
unlikely that they will host a private event every night, but that they wish for the permit to
provide them with the flexibility to host events throughout the week.
On June 12, 2017 staff provided the City Council an update of the approved the PUD conditions
and Site Improvement Performance Agreement for Paisley Park as well as a report on the how
museum operations are working. The conclusion of that report was that the operation of the
museum continues to evolve as the owner refines their business model. There is a minimal
number of CFS (Calls for Service) for this location and has a negligible impact on our overall
public safety mission in the city. There have been no major problems at Paisley Park Museum
and operations do not have a negative impact on law enforcement services. The updated traffic
study demonstrated an acceptable level of service. Special events require traffic and parking
management plans. They have revised their traffic circulation and access have also made
accommodations for Uber and Lyft.
In order the liquor to be served at the event it must be catered by a restaurant that holds an on -
sale intoxicating liquor license and a caterer's permit. Per statute, liquor service and sales shall
be incidental to the food service. The caterer must notify public safety of the event dates and
times prior the event. The city has a special event that is mechanism for notification of the event.

RECOMMENDATION
Staff is recommending approval to the PUD to permit alcohol to be served during the time period
of Monday, January 29, 2018 through Sunday, February 4, 2018 and compliance with the Special
Event Permit.

CHANHASSEN CITY CODE, THE CITY'S ZONING ORDINANCE,
BY REZONING CERTAIN PROPERTY
THE CITY COUNCIL OF THE CITY OF CHANHASSEN ORDAINS:
Section 1. Chapter 20 of the Chanhassen City Code, the City s zoning ordinance, is
amended by rezoning the following described property ("Subject Property") to PUD, Planned Unit
Development:

Section 2. Paisley Park Planned Unit Development
a. Intent
The purpose of this rezoning is to create a PUD zoning district for Paisley Park. The uses,
development standards and regulations of the IOP, Industrial Office Park District shall
apply subject to the following modifications:

1. Museum.
2. Recording studio.
3. Retail sales of products stored or manufactured on the site provided no more than
twenty percent (20%) of the floor space is used for retail sales. These sales may
include food, beverages and memorabilia.
4. Twelve (12) indoor concerts per calendar year. A concert -specific seating plan must
be filed with the City at least ten (10) days in advance of each concert.
5. Private events. An event -specific seating plan must be filed with the City at least ten
(10) days in advance of each event.
6. Office.
7. Multiple buildings on a lot.

Fence:
Fences shall comply with City Code requirements including the Buffer Yard

f. Development Plans and Regulations.
The PUD must be maintained in accordance with the following development plans which
are on file with the City and which are incorporated herein by reference:
Site Plan — SRF Consulting Group, Inc. Parking Study dated September 15, 2016,
Figure 5, Option 1, with a north access right -in for buses only and right -out only for
buses, and passenger vehicles.
2. The tent identified on the Site Plan may only be used for the sale of food, beverages
and memorabilia.
3. A hotel may only be in the round building on the Site Plan and may not exceed 35
guest rooms.
4. Site Improvement Performance Agreement approved by the Chanhassen City Council
on October 24, 2016.
5. Landscaping along the east side of Audubon Road is required and shall include roses,
junipers and barberry.
g. Parking
1. Parking lots and parking spaces shall comply with city code requirements.
2. If guests only arrive to the site by a shuttle bus the tour size shall be limited by the
maximum occupancy under the Fire Code.
3. Audubon Road must be striped to include a left turn lane into the southern access.
4. All required permits, including from the Riley -Purgatory -Bluff Creek Watershed
District, must be obtained prior to installing the pavement.
5. The north access shall be limited to a right -in for buses only and right -out of the site
for buses and passenger vehicles.

6. The traffic signal at Highway 5 and Audubon Road must be optimized based on the
SRF study.
7. The number of guests allowed on the site shall be limited so that either (a) there are a
sufficient number of on-site parking spaces to accommodate guests who arrive by a
personal vehicle, or (b) guests arrive and depart by bus.
8. Until all parking requirements have been constructed, all access to the site shall be by
bus with the exception of employees, contractors and 40 guest cars per hour
maximum.
9. If the on-site parking is inadequate, the maximum allowable tour size shall be reduced
to a level where the on-site parking is sufficient, or the PUD and the site plan must be
amended to provide more parking or guests shall be bused to and from the site. Any
changes to the site plan are subject to review and approval by the City and other
agencies with regulatory authority over the site.
Section 3. The zoning map of the City of Chanhassen shall not be republished to show the
aforesaid zoning, but the Clerk shall appropriately mark the zoning map on file in the Clerk's Office
for the purpose of indicating the rezoning hereinabove provided for in this ordinance, and all of the
notations, references, and other information shown thereon are hereby incorporated by reference and
made a part of this ordinance.
Section 4. This ordinance shall be effective immediately upon its passage and publication.

The City of Chanhassen authorizes Paisley Park to conduct After Hours Parties for the Super
Bowl at 7801 Audubon Road on January 29, 2018 through February 4, 2018 from 7:00 pm to
11:00 pm. This approval is subject to the following conditions:
Event Conditions:
1. The applicant shall apply for and receive a temporary structure permit for the tent from
the Building Department no later than January 12, 2018 (Jessica Archer: 952-227-1199).
2. The applicant shall provide the city with the name of the Cater(s) providing food and
alcohol service, if present, for the event(s) no later than January 12, 2018 (Kim

3. Fire Marshal shall be contacted once setup is complete for site and tent inspection (Don

29, 2018 to February 4, 2018 (Don Johnson: 952-227-1152).
5. The applicant shall adhere to the pre -approved seating plan for any event using amplified
sound for 500-1000 people. (musical performances or events where live steaming of pre-
recorded or live television)
a. If proposed set up varies from the approved seating plan of record, the applicant
shall provide the Fire Department with the proposed seating plan.
6. The applicant shall have the seating arrangement inspected and approved by the Fire
Department prior to any event. Multiple inspections will be required if the set-up is
changing in between events.
7. The applicant shall adhere to the posted occupancies of all spaces within the building.
8. The applicant shall ensure that any amplification used for Special Events is connected to
the building alarming system.
9. The applicant shall ensure that parking around the building is limited to marked parking
spaces only and all fire lanes are kept open.
10. The applicant shall ensure all exit routes remain open and unimpeded at all times;,
specifically the main soundstage exits that pass by the retail area.
11. Emergency vehicle access shall be maintained.
12. Guests attending private parties shall be shuttled in by bus or coach.
13. Storm sewer catch basins shall not be used for disposal of garbage or non-stormwater
liquids per the regulations for use of storm sewer Section 19-102.
14. Alcohol may only be served if the City Council approves an amendment to Paisley Parks
Planned Unit Development Ordinance granting a onetime exemption from the PUD's
prohibition on alcohol service. In the event that the PUD is not amended to allow for
alcohol service, no alcohol may be served and condition 2 shall not apply.

Temporary Assemblies and Tents
Temporary indoor or outdoor assemblies and temporary use of tents in excess of 200 square feet
or canopies in excess of 400 square feet are allowed with a fire inspection. Temporary assemblies
and tents shall comply with the Minnesota State Fire Code (MSFC), 2015 edition, Chapter 31. For
the purpose of this handout, the term "tents" shall include canopies, temporary membrane struc-
tures and air supported or air inflated structures.
ExcepUofls
1. Tents used exclusively for recreational camping purposes
2. Tents open on all sides which comply with all of the following:
2.1. Individual tents having a maximum size of 700 square feet (65 m2).
2.2. The aggregate area of multiple tents placed side by side without a fire break
clearance of 12 feet (3658mm), not exceeding 700 square feet (65m2) total.
2.3. A minimum clearance of 12 feet (3658 mm) to all structures and other tents.
Submittal Requirements
A completed fire inspection permit application signed by the property owner.
Provide a description of walls to be used, i.e. permanent, movable/removable,
due to weather condition.
Provide two copies of a detailed site or floor plan showing the seating arrangement, exits and loca-
tions of portable fire extinguishers. One approved copy must remain on site at all times.
Provide a detailed description of all activities that will be occurring, the hours of the event and the
approximate number of participants.
Provide a certificate, executed by an approved testing laboratory, certifying the flame resistance of
materials used to construct the tent are in compliance with NFPA Standard 701.
Provide flame -spread rating information for materials used as ceiling and/or wall decorations.

Definitions
Air -Supported Structure. A structure wherein the shape of the structure is attained by air pres-
sure, and occupants of the structure are within the elevated pressure area.
Canopy. A structure, enclosure or shelter constructed of fabric or pliable materials supported by
any manner, except by air or the contents it protects, and is open without sidewalls or drops on 75
percent or more of the perimeter.
Membrane Structure. An air -inflated, air -supported, cable or frame -covered structure as defined by
the International Building Code and not otherwise defined as a tent or canopy. See chapter 31 of
the International Building Code.
Tent. A structure, enclosure or shelter constructed of fabric or pliable material supported by any
manner except by air or the contents that it protects.
General Requirements for Assemblies
Documentation must be provided showing all draperies, decorative fixtures, and other fabrics and
materials have been treated with an approved fire retardant material.
When more than 200 loose seats, folding chairs or similar seating is provided, chairs must be
bonded together in groups of not less than three. This is not necessary for seating around tables.
Fire Extinguishers required: Provide a portable fire extinguisher with a minimum rating of 4A-60BC
in every cooking facility When cooking operations utilize oil or animal fax , a K classportable fire
extinguisher is required. Fire extinguishers must be mounted in an approved and accessible loca-
tion and bear a tag certifying that it has been inspected within the last year by a licensed contrac-
tor. Additional fire extinguishers shall be provided at 75 foot spacing. Fire extinguishers shall be
located no closer than 10 feet to a hazard and no further than 50 feet from the hazard. All extin-
guishers shall me mounted waist high.

General Requirements for Tents and Canopies
Tents and canopies must have a permanently attached label stating the material is fire retardant.
Tents shall be at least 20 feet from lot lines, structures, parked vehicles, or internal combustion
engines as noted in MSFC 3103.8.2.
Fireworks are not permitted within 100 feet of tents.
Venting shall be to the exterior with approved spark arrestors. Vents shall not be placed within
12 inches of the tent.
Cooking and heating equipment (no tent) shall be at least 10 feet from exits and combustible
materials.
Cooking tents: Tents where cooking is performed shall be separated from other tents, canopies or
membrane structures by a minimum of 20 feet.
Outdoor cooking that produces sparks or grease -laden vapors shall be at least 20 feet away from
a tent, canopy, or membrane structure.
L.P. gas must be secured outside of a tent with the following separations;
Containers <500 gallons - 10 feet, >500 gallons - 25 feet

Flammable Liquids shall not be stored within 50 feet from the tent.
Generators shall be at least 20 feet from tents.
Vegetation and waste materials shall be at least 30 feet from tent.

be located in a tent containing an assembly occupancy. Exception: Materials necessary for the
daily feeding and care of animals and materials that are kept damp. Combustible trash shall be

Hello Kate, I hope you're well. I am a resident of Chanhassen (1945 Commonwealth Blvd) and fully support the liquor
license temporary permit. I am also very active on Prince Facebook groups. I know there is quite a bit of resistance
among fans but the fact that they are basing their disapproval on the belief that Prince wouldn't agree, is not only
incorrect, it is baseless.
As you know because you have access to permit applications, Prince often allowed alcohol at private Paisley Park events.
The criticism is unnecessary and is personal opinions only. I feel it will be a great revenue -generating resource for Paisley
Park for a limited amount of time. It's important Paisley Park thrives for me and other homeowners/citizens of the city.
We need to trust the people running the venue and the estate - and not the fans who are peeking in from an
uninformed distance. Many who will not financially support Paisley Park anyhow.
I am happy to attend the meeting if necessary but, otherwise will consider this a note in support of the application. Of
course, I assume that security will be properly handled and alcohol will be served in a responsible manner. Feel free to

I returned from the planning commission meeting last night feeling confused, frustrated and
disappointed. I felt as though the constituent voice didn't matter. There were four Chanhassen
residents who spoke asking you to deny the alcohol permit providing valid reasons. No residents
supporting the permit were present, and not only did you approve the recommendation, you extended
the time limit of the party until 1:OOam, despite all expressing concerns.
My concerns:
• The application for liquor license was incomplete and inconsistent to what was
asked and approved at the meeting. The Special Event Permit did not match
document found on city website under project documents as of 7:00pm on
12/5/2017. The application of record previously referenced on-line stipulates
no caterer on Page 3 of 3 or special event application.
The changes asked for and approved did not allow for any additional notification
to the public (changing the ending time from 11:00pm to 1:00pm is a significant
change)
Paisley Park management's failure to properly complete the application process
should raise concerns by our city planning commission and council. The integrity
of the public forum process is called into question when the applicant fails to
complete documentation, the printed document bundle distributed at 7:OOPM
meeting time were incomplete and would not pass a certified audit. Further,
these documents were in conflict with documents published on City of
Chanhassen web site at 6:0013M on same date. Yet, the commission made
modifications in favor of applicant, who had no other vocal support present at
meeting. Four Chanhassen constituent parties spoke against the request.
Even though something as simple as the application was not properly or fully
completed, the Planning Commission seems to feel the Paisley Park
Management will be competent managing large numbers of people in a first-
time environment with alcohol while multiple questions and concerns go
unanswered.
There were no concrete answers provided for the following questions:
o Who is enforcing and controlling numbers of attendees?
o Who is the catering company?
o Who is serving the alcohol?
o What type of training have they done?
o From where are the groups coming?
o The groups were said to be "Corporate Parties" but no other
information provided
o Did the Prince's family approve adding alcohol? (not my
question but still wasn't answered)
o What type of security will be present (what do we know about
this company?)
o What measures are being considered to prevent overserving?
o Will alcohol be present on the buses?
o What events in which the groups participating prior to coming
to Paisley Park and will alcohol be present at those?
o Will this set a precedence for future events by Paisley Park
and/or other private parties?
o What benefit other than Paisley Park's financial profit will
allowing alcohol provide? This is already listed as a top
destination of places to see while visiting MN during the Super
Bowl. (no alcohol present). Additionally, the Paisley Park
Management stated that one of groups is not including
alcohol. People are already coming so I'm struggling with
understanding the strong need to add alcohol.
(The last 4 questions were ones I just included on this email)
Chaska police department spent many hours preparing for the Ryder Cup,
specifically targeting sex trafficking. Despite that preparation, it still took
place. At least 9 arrests were made coinciding with that event, which has a
profile of corporate attendees. My point is not to criticize law enforcement
who prepared for the Ryder Cup, but rather to emphasize the point that
corporate events are a major environment for sex trafficking. The Paisley Park
Management as well as the Planning Commission used the terms "corporate"
and "professional" in an attempt to show non -criminal activity. That comment
makes me concerned that they are not familiar or recognizing the depth, nature

until 1:OOam. Additionally, they were not coinciding with events known for sex

tobacco and other substances on site (which if I'm not mistaken, is not
allowed?)
• Paisley Park seemed confident that because these will be Corporate Events, only

meeting. As of today, I am still waiting to hear back from any council member other than Elise Ryan.
Please look beyond the business aspect of approving this license and recognize the potential cost of
it. "Just because you can, doesn't mean you should." Many smart people have quoted that but I am
having trouble finding the originator to give them credit. It applies very well to this situation.

I made some assumptions that you were not going to approve the license for Paisley Park. It appears
that you haven't made your decision yet so I'll provide some information why I feel as it would not be a
good choice for our community. My email gets long but there is so much information I'd like to share!
Although the Super Bowl brings coming to MN offers some advantages for our city, it also comes with
it's set of challenges, especially from a safety perspective. Having large groups of people together in a
party atmosphere can be tricky but adding alcohol to the mix, makes it that much more reckless. (See

If I'm not mistaken, the intent of the liquor license for Paisley Park is for cocktail parties for 500-1000
people. That atmosphere seems to be consistent with problems associated with large parties leading
up to the Super Bowl. Their request shows that they are not providing food which should also be a
concern where alcohol is present. I'm also concerned that a venue that has not historically provided
alcohol is suddenly going to be serving large numbers of people.
"There's no doubt that when you have an increased amount of individuals congregating, and when
alcohol is involved, that you are going to have an increase in crime committed. It's naive to assume it
wouldn't be," said hnran Ali, Washington County's major crimes prosecutor.

Should you approve the license, can you please provide the answers to the following questions?
Who would be providing alcohol?
Who would be serving alcohol? (Would background checks be done? What type of training have they
done?)
From where are the 500-1000 people coming?
Who are the "groups"? (Private parties?)
How long are the cocktail parties going to run?
What type of safety/security measures are being provided?
I am asking you to please consider the risks. This is not just a simple request for a liquor license such as
fundraising event or a local celebration. Paisley Park is asking to provide liquor to 500-1000 people
multiple nights without serving food. Taking into consideration that there were trafficking incidents
surrounding the Ryder Cup and that its an ongoing battle everywhere, I feel that by not supporting
potentially dangerous environments that lend itself to sex trafficking, we could be protecting even just
one human. I believe that is worth it!

It all seems so logical and I support what you're saying about curtailing human trafficking.
However, your second paragraph seems out of place.
What precisely about approving the temporary permit would make no sense for our community?

areas of need. I'm reaching out as a resident to ask how we can work together on this
effort? (We are already aware of the NGOs in our area working to raise awareness,
etc) Is this already a priority of the City of Chanhassen? As city government leaders,
could you please share Chanhassen's community safety strategies related to human
trafficking?

Hello Kate, I hope you're well. I am a resident of Chanhassen (1945 Commonwealth Blvd) and fully support the liquor
license temporary permit. I am also very active on Prince Facebook groups. I know there is quite a bit of resistance
among fans but the fact that they are basing their disapproval on the belief that Prince wouldn't agree, is not only
incorrect, it is baseless.
As you know because you have access to permit applications, Prince often allowed alcohol at private Paisley Park events.
The criticism is unnecessary and is personal opinions only. I feel it will be a great revenue -generating resource for Paisley
Park for a limited amount of time. It's important Paisley Park thrives for me and other homeowners/citizens of the city.
We need to trust the people running the venue and the estate - and not the fans who are peeking in from an
uninformed distance. Many who will not financially support Paisley Park anyhow.
I am happy to attend the meeting if necessary but, otherwise will consider this a note in support of the application. Of
course, I assume that security will be properly handled and alcohol will be served in a responsible manner. Feel free to
