2002-90CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA DATE: October 14, 2002 RESOLUTION NO: 2002-90 MOTION BY: Labatt SECONDED BY: Bovle RESOLUTION TO UPDATE SURFACE WATER MANAGEMENT WATER QUALITY AND WATER QUANTITY CONNECTION CHARGES WHEREAS, the City of Chanhassen's Surface Water Management Plan (SWMP) was adopted in February 1994, and WHEREAS, the Surface Water Management Plan recommended the City establish surface water connection fees as a means of financing the citywide improvements recommended therein, and WHEREAS, the rates should be increased annually in line with the construction price index, and WHEREAS, the rates have not been increased since their adoption, WHEREAS, the costs of land acquisition, project management and construction have IS increased since the rates were adopted, and WHEREAS, the Chanhassen City Code does not include a provision for the annual updating of the Surface Water Management Connection Charges. NOW, THEREFORE, BE IT RESOLVED, the fees for water quality and water quantity connection charges shall be as set forth in the following schedule: WATER QUALITY Charge per Land Use Acre Single -Family Residential $ 871 Duplex $ 949 �ownhome $ 1,666 School/Church $ 1,627 [Apartment $ 1,786 industrial $ 5,045 (Commercial $ 6,435 WATER QUANTITY Charge per Land Use Acre • Single-Family/Low Density $ 2,156 Medium Density $ 3,240 Pigh Density/CommerciaVIndustrial/Business $ 4,748 'arks/Open Space $ 1,296 • • BE IT ALSO RESOLVED that Section 18-63 of the Chanhassen City Code be revised as follows: (a) All subdivisions shall comply with the city's surface water management plan dated February 1994, which is incorporated herein by this reference. (b) In accordance with the city's surface water management plan as a condition of subdivision approval, subdividers shall pay a water quality and water quantity connection charge. The charge shall be based upon the gross area of the subdivision less the area to be dedicated to the city for ponding, parks and wetland, and right-of-way for state highways, county roads, and local arterial roadways. The subdivision will be given a credit for any onsite storm water improvement which has been oversized to serve property outside the subdivision. The charge for lots oversized due to individual onsite sewage disposal and water systems will be reduced to the charge that would be imposed on a one-half acre lot. An additional charge will then be imposed if the lot is further subdivided less a credit for the charge previously paid. The charge shall be paid in cash before the subdivision is approved by the city unless the city and subdivider agree that the charge may be assessed against the property. Property being subdivided shall be exempt from the water quality and water quantity connection charges imposed by this section if the charges were paid or assessed in conjunction with a previous subdivision of the property and if the property is not being zoned to a classification with a higher charge. (c) Within the Bluff Creek Overlay (BCO) District, meet the additional purpose, intent and standards of the BCO District. (d) The fees paid to the city for surface water management connection charges shall be as established by resolution."
