Td -cd Gerhardt, City Manager CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA DATE July 8, 2019 RESOLUTION NO: 2019-34 MOTION BY: Coleman SECONDED BY: Campion RESOLUTION VACATING WELL AND WATER MAIN EASEMENTS AT 7141 GALPIN BOULEVARD (THE PARK) WHEREAS, pursuant to Minnesota Statutes § 412.851 the City Council of the City of Chanhassen has conducted a hearing preceded by the statutorily required two (2) weeks published and posted notice and mailed notice to the abutting property owners, to consider the vacation of the following easements for well and water main purposes: Easement dated December 28, 1972, recorded in the office of the Registrar of Titles of Carver County on January 25, 1973 as Document No. 18018; and Easement dated December 28, 1972, recorded in the office of the Registrar of Titles of Carver County on January 25, 1973 as Document No. 18019; (collectively the "Water Well and Water Easements"); and WHEREAS, following the hearing and consideration of the proposed vacation, the Council has determined that the Easements are no longer needed for public purposes. NOW, THEREFORE, BE IT RESOLVED by the Chanhassen City Council: T11P Water Well and Water Easements are hereby vacated. 2. The vacation shall not affect the authority of any person, corporation, or municipality owning or controlling the electric or telephone poles and lines, gas lines, sanitary and storm sewer lines, water pipes, mains, hydrants, and natural drainage areas thereon or thereunder, to continue maintain the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereof. 3. The City Manager is directed to file a certified copy of this Resolution with the County Auditor and County Recorder of Carver County.
