Recommendation to Submit an Application for Use of the
Southwest LRT Route as a Designated Snowmobile Trail,
2005-2006 Season
Annually for the past eleven years, the City has requested a winter use permit
from Three Rivers Park District allowing snowmobile usage on the Southwest
Light Rail Transit (LRT) trail in Chanhassen. The Chanhassen Snowmobile Club
marks the trail with signage and provides grooming when required. The trail
receives light to moderate use from snowmobiles due to limited access points
available to riders.
RECOMMENDA TION
It is recommended that the City Council submit an application to the Suburban
Hennepin Regional Park District for use of the Southwest LRT trail located in
Chanhassen as a designated snowmobile trail.

PLEASE RESPOND TO THIS REQUEST BY SEPTEMBER 24.2005
Enclosed is a copy of the 2005-2006 Winter Use Permit request form for regional trail segments located within
your community. Please determine the level of winter use you are requesting, fill out the application form and
follow the procedures outlined below. Attached for your convenience is a copy of your 2004-2005 permit
request. If your community does not plan to authorize any winter use activities, please indicate (none) in the
box at the top of the permit and return it so that the trail can be signed as CLOSED, by order of your city
council.
The Winter Use Permit ultimately authorizes your City to utilize the section of trail for the use you request.
Permitted activities are determined by individual communities, contingent upon approval from the Park
District's Board of Commissioners. An updated Certificate ofInsurance, naming Three Rivers Park
District as an additional named insured, should be submitted with the permit application. Coverage will
need to show inclusive dates from November 15,2005 and March 31, 2006. Please include proposed rules
and regulations for winter use, as well. Your current certificate of insurance on file with the Park District has
expired.
Permit requests should be submitted to Janet Haben, Administrative Assistant, and include verification of
formal City Council action approvinl! the proposed activities (a copy of appropriate meetinl! minutes).
Some cities have elected to pass board motions authorizing multi-year Winter Trail Activities Permit
applications. This is completely acceptable to the Park District and may save you administrative time.

Authorization is hereby requested from the Park District Board of Commissioners to use portions
of the Regional Trail Corridor for winter use activities between November 15,2005 and March 31,
2006, as determined by each municipality within guidelines set forth herein on District property
located within individual City boundaries.
It is understood and agreed that approval from the Park District Board of Commissioners is
contingent upon the following conditions:
· The City agrees to defend, indemnify, and hold harmless the Park District, its officials,
officers, agents, volunteers, and employees from any liability, claims, causes of action,
judgments, damages, losses, costs or expenses, including reasonable attorney's fees, resulting
directly or indirectly from any act or omission of the City, its respective contractors, anyone
directly or indirectly employed by the, and/or anyone for whose acts and/or omissions they
may be liable for related to the winter use of the Regional Trail Corridor. If City maintains
general liability insurance at the time this permit is issued, City shall provide the Park District
with a Certificate of Insurance, naming Three Rivers Park District as an additional named
insured.
· The City agrees to maintain the trail, including, but not limited to, any plowing, sweeping,
sanding, packing, trash pick-up, and sign replacement, between November 15, 2005-March 31,
2006. The City further agrees to immediately address all safety issues on or adjacent to trails.
· The City will provide signage at locations approved by the Park District, notifying the public of
authorized winter activities within its city limits; activities may include, but are not limited to,
hiking, biking, snowmobiling, cross-country skiing, snowshoeing, or pet walking. Winter use
signs must be installed by the City at designated locations prior to November 15, 2005 and
removed by the City no later than April 15, 2006. These signs are totally the responsibility of
each municipality.
· Snowmobiling is not allowed on asphalt trails. Permitted use for snowmobiles will be limited to
direct crossing and/or in areas where the snowmobile trail is kept from running on paved trails
and bridges. If snowmobiling is permitted, cities must take steps to keep snowmobiles from
damaging paved trails, bridges and other property.
· The City agrees to enforce rules and regulations established by the municipality as part of its
request for a Winter Use Permit.
· The City agrees to repair all trail surface damage that occurs as a result of winter trail activities
and/or maintenance, including, but not limited to, bituminous/concrete repair, bridge deck
repair, grading or adding aggregate pursuant to guidelines established by the Park District.
· The City agrees that winter trail use will be available to all persons, regardless of residence.
Each City is required to submit its annual permit requests, including proposed rules and
regulations, by September 30, 2005, after which the Park District may take up to 45 business days
to process. Each permit request must be submitted as a result of formal City Council action, with
accompanying verification, agreeing to the terms and conditions outlined by the Park District's
Winter Use Permit. It should be further understood that no winter activity will be allowed on
segments ofthe Regional Trail Corridor where municipalities do not request and receive permits.
The Park District reserves the right to terminate a permit at any time, if the conditions set forth
herein are not followed.

The Chanhassen Law Enforcement Department has received numerous complaints about
snowmobiles being operated illegally. We wish to remind Chanhassen residents of the following
ordinance regulating snowmobile operation:
It is unlawful for any person to operate a snowmobile:
1) On a public sidewalk or walkway provided or used for pedestrian travel, or on a boulevard
within any public right-of-way;
A) This means you cannot ride on the curb of Kerber Boulevard or any other curb, you must
ride on the STREET.
2) On private property of another without lawful authority or express consent of the owner or
lessee;
3) On any public or private school grounds except as permission is expressly obtained from
responsible school authorities;
A) Chanhassen Elementary School property and the property north of Chan City Hall are off
limits.
4) On any publicly owned lands, including but not limited to park property, playgrounds,
recreation areas and golf courses unless authorized for such use by the proper public
authority;
A) You cannot ride in Pond Park or on the pond.
B) You cannot ride in any Chan Parks.
C) You cannot ride in Lake Ann Park except on the designated trail.
5) To tow any person or thing on a public street or highway;
6) At a speed greater than 10 mph within 100 feet of any lakeshore, fisherman, fish or ice house,
or any sliding area or skating rink when in use;
7) In a manner as to create a loud, unnecessary or unusual noise which disturbs, annoys, or
interferes with the peace and quiet of other persons.
8) On west 78th Street.
To sum it up, the streets and the trail system is the only legal places you can ride. The road
banks of Kerber Boulevard, City Parks and private property are off limits!
In addition to the above, no snowmobile shall be operated on streets or highways at a speed
exceeding ten (10) miles per hour. At no time may a snowmobile be operated when the
operation would reasonably endanger other persons or property.
Organized patrolling will be taking place to enforce these laws!

Watercraft means any contrivance used or designed for navigation on water other than a
seaplane.
(b) Parking restrictions. No person shall park a boat trailer on South Shore Drive, South
Shore Court or Hill Street. The city engineer shall mark by appropriate signs each aforemen-
tioned street.
(c) Prima facie violation. The presence of any boat trailer parked on South Shore Drive,
South Shore Court or Hill Street is prima facie evidence that the registered owner of the boat
trailer committed or authorized the commission of the violation.
(d) Penalty. Any person violating this section shall be guilty of a misdemeanor. The
minimum penalty for violation ofthis section shall be a fifty-dollar fine. The maximum penalty
for violation of this section shall be the maximum penalty as set by state legislature for
misdemeanors.
(e) Impoundment. Any police officer may remove or cause to be removed an empty boat
trailer with or without the motor vehicle it is attached to from the street to a garage or other
place of safety when a vehicle is parked in violation of this section. Such trailer and/or vehicle
shall not be released until the fees for towing and storage are paid in addition to any fine
imposed for violation of this section.

The definitions in Minnesota Statutes section 84.81 apply to this article. The following
words, terms and phrases, when used in this article, shall have the meanings ascribed to them
in this section, except where the context clearly indicates a different meaning:
Boulevard means that portion of the street right-of-way between the curbline and the street
boundary line.
Organized race means a race sponsored and conducted by the park and recreation
commission, the chamber of commerce, jaycees, American Legion or similar council-recognized
civic groups or associations.

and lor other utilities or facilities. A right-of-way includes the land between the right-of-way
lines, whether improved or unimproved. "Right-of-way" includes, arterial, collector, and local
streets.
Roadway means that portion of the right-of-way improved, designed or ordinarily used for
vehicular travel, including the shoulder.
Safety or deadman throttle means a device which, when pressure is removed from the
engine accelerator or throttle, causes the motor to be disengaged from the driving track.
Street means a public right-of-way or a private right-of-way occupied by a roadway.

All city traffic ordinances shall apply to the operation of snowmobiles upon streets and

out at length in this article.

snowmobile operation shall be permitted on all public bodies of water, provided that
the operation shall comply in all respects with all ordinances;
(5) So as to tow any person or thing on a public street or highway except through use of
a rigid tow bar attached to the rear of the snowmobile;
(6) At a speed greater than ten (10) miles an hour when within one hundred (100) feet of
any lake shore, except in channels, or of any fisherman, fish or ice house, nor shall

ring when in use, nor where the operation would conflict with the lawful use of
property or would endanger other persons or -property;
(7) In a manner so as to create a loud, unnecessary or unusual noise which disturbs,
annoys or interferes with the peace and quiet of other persons.

Sec. 12-34. Operation on streets and highways.
(a) No person shall operate a snowmobile upon the roadway, shoulder or inside bank or
slope of any trunk, county-state aid, or county highway, and in the case of a divided trunk or
county highway, on the right-of-way between the opposing lanes of traffic, except as provided
in this article, nor shall operation on any such highway be permitted where the roadway
directly abuts a public sidewalk or property used for private purposes. No person shall operate
a snowmobile within the right-of-way of any trunk, county-state aid, or county highway
between the hours of one"half (112) hour after sunset to one-half (112) hour before sunrise, except
on the right hand side of such right-of-way and in the same direction as the highway traffic on
the nearest lane of the roadway adjacent thereto. No snowmobile shall be operated at any time
within the right-of-way of any interstate highway or freeway within this state.
(b) A snowmobile may make a direct crossing of a street or highway except an interstate
highway or freeway, provided:
(1) The crossing is made at an angle of approximately ninety (90) degrees to the direction
of the street or highway and at a place where no obstruction prevents a quick and safe
crossing;
(2) The snowmobile is brought to a complete stop before crossing the shoulder or main
traveled way of the highway;
(3) The operator of the snowmobile yields the right-of-way to all oncoming traffic which
constitutes an immediate hazard;
(4) In crossing a divided street or highway, the crossing is made at an intersection of such
street or highway with another public street or highway;
(5) If the crossing is made between the hours of one-half hour after sunset to one-half(112)
hour before sunrise or in conditions of reduced visibility, only if both front and rear
lights are illuminated.
(c) No snowmobile shall be operated on streets or highways at a speed exceeding ten (10)
miles per hour.
(d) No snowmobile shall enter any uncontrolled intersection without making a complete
stop. The operator shall then yield the right-of-way to any vehicles or pedestrians which
constitute an immediate hazard.

(e) Notwithstanding any prohibition in this article, a snowmobile may be operated on a
public thoroughfare in an emergency during the period of time when and at locations where
snow upon the roadway renders travel by automobile impractical.

Every person leaving a snowmobile in a public place shall lock the ignition, remove the key
and take the same with him.

Sec. 12-36. Chasing animals.
It is unlawful to intentionally drive, chase, run over or kill any animal, wild or domestic,
with a snowmobile.

Sec. 12-37. Littering and obstructions.
(a) No person shall deposit paper, litter, rubbish or debris on public or private property, or
throw paper, litter, rubbish or debris from snowmobiles.
(b) No person shall place obstructions, including ice blocks, on publicly owned lands or
frozen waters so as to interfere with the lawful use thereof by the public.

No person shall conduct a snowmobile organized race at any place within the city without
first having secured a permit therefor from the council. Written application shall be made to
the council. The applicant shall give the information required on the form. A permit may be
issued upon such terms, conditions and permit fees as the council may prescribe. Upon the
granting of such permit, the provisions of section 12-35, paragraph (7) may be waived by the
council for the duration of the race.
