2022-061 CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA DATE: January 10, 2022 RESOLUTION NO: 2022-06 MOTION BY: McDonald SECONDED BY: Campion A RESOLUTION APPROVING CONVEYANCE OF REAL PROPERTY LOCATED AT 670 CREEKWOOD DRIVE WHEREAS, the City of Chanhassen is the fee owner the property located at 670 Creekwood Drive, Chanhassen, Minnesota 55318 (“Property”); and WHEREAS, the Property includes a vacant home and is a remnant parcel following the taking of right-of-way for CSAH 101 (Great Plains Boulevard); and WHEREAS, the City proposes to convey the Property to Samantha Kegler and Christopher Hanson under the terms and conditions of the Purchase Agreement and Addendums attached hereto as Exhibit A (“Purchase Agreement”); and WHEREAS, Minn. Stat. § 462.356, subd. 2 requires that the Planning Commission review the City's proposed acquisitions and dispositions of property, and; WHEREAS, Minn. Stat. § 462.356, subd. 2 provides for an exception from the Planning Commission review requirement upon 2/3 vote of the City Council dispensing with the requirement and finding that the acquisition or disposal of the property has no relationship to the comprehensive municipal plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chanhassen, Minnesota: 1. The City Council finds that the conveyance of the Property has no relationship to the comprehensive municipal plan; 2. Review by the Planning Commission of the conveyance of the Property is hereby dispensed with, the proposed transaction and Purchase Agreement are hereby approved; 3. Pursuant to the terms of the Purchase Agreement, the Mayor and City Manager are authorized and directed to execute the deed to the Property and the City Manager is authorized to execute all documents necessary to transfer the Property in accordance with the terms of the Purchase Agreement.
