76-45 """" CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA RESOLUTION DATE: July 19, 1976 MOTION BY COUNCILMAN RESOLUTION NUMBER: 76-45 Hobbs SECONDED BY COUNCILMAN ESTABLISHMENT OF ANIMAL CONTROL VIOLATION BUREAU Shulstad WHEREAS, the City Council of the City of Chanhassen did on July 12, 1976, adopt Ordinance 24C relating to the licensing, impounding and regulation of both cats and dogs in the City of Chanhassen; and WHEREAS, the provisions of said ordinance provide that upon conviction of any owner whose dog or cat is found to be in violation of any provision of said ordinance is guilty of a misdemeanor and may be fined up to the sum of $300.00; and WHEREAS, the City Council of the City of Chanhassen deems it ~ in the best interests of the City to establish a policy as to fines for certain violations of said ordinance; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Chanhassen, Minnesota: 1. It is hereby determined to be the policy of the City of Chanhassen as it relates to any animal or any owner of any animal found in violation of any provisions of Orldinance 24C of the City of Chanhassen: a) Upon the City Pound Keeper, or any animal control officer or any peace officer of the City of Chanhassen issuing a ticket or a citation to the owners of any animal found running at large, or found without a valid license, or found to be constituting an "animal nuisance", as that term is defined in said ordinance, the City Clerk shall notify uhe said owner by letter that unless the fine, in accordance with the schedule hereinafter set forth, is paid within seven (7) days of the receipt of said letter a formal complaint in county court of said violation will be issued. 1) First Offense 2) Second Offense 3) Third Offense 4) Fourth Offense $15.00 $25.00 $35.00 $45.00 ,..., .. ....... b) The above schedule shall be applicable to any of the above stated violations of saMd ordinance by any person within any 365 day period or by any animal or animals from the same household within any 365 day period; upon the fifth offense in any 365 day period a formal complaint upon the violation shall issue. 2. The above policy shall remain in effect until such time as changed by resolution of this council. Passed and adopted by the Council of the City of Chanhassen this 19th day of July, 1976.
