Resolution Authorizing Storm Sewer & Street Improvement Project No. 75-11
BE IT RESOLVED by the City Council of the City of Chanhassen,
Minnesota, as follows:
1. It is hereby found and determined that notice of hearing on
a street and storm sewer improvement in the City was duly mailed as
required by law and published in the Carver County Herald, the
official newspaper of the City, on April 1 and April 1, 1976, as
required by M.S. Chapter 429, and as ordered by Resolution of this
Council adopted on March 29, 1976.
2. A public hearing having been held on April 12, 1976, and
opportunity having been given at such hearing to all persons to make
~ known their views on said improvement, and this Council being fully
advised of the pertinent facts, does hereby order the construction of
said improvements as follows:
a. The improvement of Erie Avenue from West 78th Street
northerly and northeasterly approximately 2000 feet
to the northerly terminus of the existing private street
on the Zetah/Fenger/Char-Lynn properties;
b. The improvement of West 77th Street from Great Plains
Blvd. easterly approximately 1500 feet to its terminus
at the Chanhassen Well Site property; and
c. The improvement of ChanView from Frontier Trail easterly
approximately 820 feet to its terminus at the Chanhassen
Well Site property.
Said proposed street improvement to consist of the construction and
installation of seven ton bituminous roadways, 28 feet in width, with
three inch bituminous curb and gutters, including removal of existing
blacktop, excavation, furnishing and installation of crushed rock and
bituminous base and wearing courses, lowering of existing street
elevations as necessary, installation of sanitary sewer and water
services as needed, construction of two cul-de-sacs of 100 foot diameter

with acquisition of additional right of way, filling of ditches and
removal of culverts as necessary, sodding, seeding, restoration of
existing driveways, adjusting sanitary sewer manholes and relocating
water hydrants, acquisition of right of way for street widening
purposes.
Said storm sewer improvement to consist of the construction and
installation of a storm sewer and storm water drainage system within
West 77th Street, ChanView and Erie Avenue and contiguous areas, and
including the removal of existing drain pipes, furnishing and installation
of corrugated metal pipe, catch basins and erosion control systems,
and acquisition of drainage way easements as necessary.
3. Said improvement is hereby designated and shall hereafter
be referred to as Storm Sewer & Street Improvement Project No. 75-11.
4. Schoell & Madson, Inc., the consulting engineers for the City,
are hereby authorized and directed to prepare final plans and specifi-
cations for said improvement and to submit them to this Council.
5. The City hereby determines that it is necessary to acquire
all property rights which will be needed for the construction and
location of the storm sewer mains and related facilities described in
Paragraphs 2 and 3; and that such acquisition isin the public interest
and for the public purpose authorized by M.S. S444.075.

6. Russell H. Larson, Attorney at Law, is hereby authorized and
directed to proceed with the acquisition of all such property rights by
negotiation, contract or condemnation, and is authorized to do all
things necessary to secure the right of entry or possession of such
property for construction purposes as soon as possible, provided, how-
ever, that no such property rights shall be acquired until after the
City Council has actually awarded contracts for the construction of
Project 75-11.
Passed and adopted by the Council of the City of Chanhassen this
