Approval of Registered Land Surveys

EXECUTIVE SUMMARY
The applicant is requesting approval of two Registered Land Surveys adjusting
the lot lines for Lots 6 and 7, Block 1, Christmas Acres in connection with the
transfer of a portion of Lot 6. Block 1. to Lot 7. Block 1. Christmas Acres, and for
property located at 860.890 and 910 Pleasant View Road. The approvals will
simplify legal descriptions for the properties.
ACTION REQUIRED'
City Council approval requires a majority vote of City Council present.
PLANNING COMMISSION SUMMARY
The Planning Commission held a public hearing on September 6, 2005 to review
the proposed Registered Land Surveys. The Planning Commission voted 6-0 to
approve the requests. The summary and verbatim minutes are item la of the City
Council packet.
RECOMMENDA TION
Staff and the Planning Commission recommend the City Council adopt the
following motion:
"The Chanhassen City Council approves the Registered Land Surveys attached to
the staff report, referred to as Exhibits A and B."

The City has been asked to approve a Registered Land Survey adjusting the lot
lines for Lots 6 and 7, Block 1, Christmas Acres in connection with the transfer of
a portion of Lot 6. Block 1. to Lot 7. Block 1. Christmas Acres, and for property
located at 860. 890 and 910 Pleasant View Road.
Christmas lake
In the case of both of these requests, the applicant is adjusting a property line (!!
new lot is not beine created as a RSUlt of this action). This request meets the
City's exception to platting, and may be approved as an administrative
sulxlivision. Thus, no plat is required.
A Registered Land Survey (RLS) accompanies this request. RLS is defined as: A
survey of "registered" (Torrens-title) land, usually done to shorten len2thv leeal
descriutions, or divide larger parcels of "Torrens-title" land into smaller tracts.

Minnesota State Statute ~508.47, subd. 4 requires that the RLS be approved "in the manner
required for the approval of subdivision plat." Thus, although the City's ordinance does not
require anything more than an administrative subdivision for approval, Minnesota Statutes
require the City to approve the RLS as they would a subdivision plat. To satisfy this
requirement, the City must hold a public hearing prior to approval of the RLS.
City and County staff reviewed the legal description of the RLS, which was prepared by a
Registered Land Surveyor, and found it to be accurate.
Once the City has approved the RLS, the Mayor and City Manager will execute the RLS mylars
and provide the date of approval. These will then be forwarded to the City Attorney's office for
recording.
RECOMMENDA TION
Staff recommends the Planning Commission recommend approval of the attached Registered
Land Surveys referred to as Exhibits A and B.
