'{' FROM: Paul Oehme, City Engineer/Dir. of Public Works Mak Sweidan, Engineer ~ ()J'ff'- September 15,2005 "vq0 DATE: SUBJ: Vacation of Roadway Easement within Lot 8, Block 2, Timberwood Estates Addition - Vacation File No. 05-03 REQUEST (Simple Majority Vote Required) Staff has received a request from Thomas Perrier, owner, for the vacation of the roadway easement located over and across the northwesterly 30 foot of Lot 8, Block 2, Timberwood Estates Addition. BACKGROUND The existing 60-foot wide roadway easement was granted to the City per document No. 95292 over and across Lots 7 & 8, Block 2, Timberwood Estates Addition. On August 8, 2005, the applicant contacted staff to investigate the option of vacating 30 feet of the roadway easement along the northwesterly property line of Lot 8, Block 2. DISCUSSION The underlying Lots No.7 and 8, Block 2 were originally platted as a part of the Timberwood Estates Addition plat with the standard 6-foot wide drainage and utility easement along each side of the property line. Under the impression of future city road extension of Oakwood Ridge to the parcel on the east side of the Timberwood Estates Addition, a 60-foot wide roadway easement along the property line between Lots 7 and 8 was granted to the City per document No. 95292. In order to remove the 60-foot wide easement from Lots 7 and 8, Block 2, the owner of Lot 8 has requested that the City vacate the old easement. Staff has no objection to this since the easterly parcel has already developed (Creekside Addition) and the future road extension is no longer needed by the City and there are no existing public utilities. Staff could not verify any existing small utilities within the 60-foot roadway easement, as to this, staff recommend the applicant contact Gopher State One Call for locations before any construction commences.
