REQUESTED ACTION (Simple Majority Vote Required)
Council is requested to call the assessment hearing for the TH 312/212
Improvements, Project Nos. 03-09, 04-05, and 04-06 for October 24, 2005.
DISCUSSION
On February 14,2005, the City Council ordered the portion of the 2005 MUSA
Improvements to be built in conjunction with the TH 212 Project. These
improvements include the following:
1. Roadway improvements as follows:
· Turn lanes on Powers Boulevard at the East/West Collector Roadway.
· Turn lanes on Powers Boulevard at the future west cul-de-sac, south of the
south TH 212 ramp.
· Turn lanes on Pioneer Trail at the future north cul-de-sac across from
Bluff Creek Drive.
· Turn lanes on Pioneer Trail at the South Connector Roadway.
· An additional through lane for the westbound TH 212 off ramp at Powers
Boulevard and the East/West Collector Roadway.
2. A traffic signal at Powers Boulevard and the East/West Collector Roadway.
3. A stormwater pond at the southeast quadrant of Lyman Boulevard and
Powers Boulevard.
4. Trunk watermain improvements as follows:
· Along Pioneer Trial.
· Along Powers Boulevard.
5. Trunk sanitary sewer improvements as follows:
· Along Powers Boulevard.
· Along Pioneer Trail.

These improvements are illustrated on attached Exhibit 1.
On March 28, 2005, the Council held a public hearing for the improvements
proposed to be assessed for the TH 212 project and also held a public hearing for
the TH 101 GAP project. No assessments are proposed for property owners in
conjunction with the TH 101 GAP project.
The improvements proposed to be assessed to benefiting property owners for the
TH 212 project that are outside the 2005 MUSA Improvement area include:
1. Roadway improvements as follows:
· Turn lanes on Lyman Boulevard and TH 101.
· Signal Improvements at TH 101 and Lake Susan Drive.
2. Sewer and water improvements on Lyman Boulevard.
All of these improvements will be constructed as part of the TH 212/312 design-
build project through a cooperative agreement with MnDOT. MnDOT has
provided costs for all of these improvements consistent with the feasibility study
for the 2005 MUSA Improvements, and as discussed at the public hearings. A
majority of these costs are proposed to be funded through assessments to the
benefiting property owners. Bonding for the assessments will be from the State of
Minnesota Loan Agreement the City approved on April 11, 2005.

A RESOLUTION CALLING THE ASSESSMENT HEARING FOR THE
TH312/212 IMPROVEMENTS - PROJECT NOS. 03-09, 04-05, AND 04-06
WHEREAS, Minnesota State Statute 429 regarding special assessments for public
improvement projects requires City Council to officially set the assessment hearing date for
capital improvement projects.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
CHANHASSEN, MINNESOTA:
1. A hearing shall be held on the 24th day of October, 2005 in the Council Chambers
at city hall at 7:00 p.m. to pass upon such proposed assessment and at such time and place all
persons owning property affected by such improvement will be given an opportunity to be heard
with reference to such assessment.
2. The city clerk is hereby directed to cause a notice of the hearing on the proposed
assessment to be published once in the official newspaper at least two weeks prior to the hearing,
and shall state in the notice the total cost of the improvement. The clerk shall also cause mailed
notice to be given to the owner of each parcel described in the assessment roll not less than two
weeks prior to the hearings.
3. The owner of any property so assessed may, at any time prior to certification of
the assessment to the county auditor, pay the whole of the assessment on such property, with
interest accrued to the date of payment, to the City of Chanhassen, except that no interest shall be
charged if the entire assessment is paid within 30 days from the adoption of the assessment. The
property owner may at any time thereafter, pay to the City of Chanhassen the entire amount of the
assessment remaining unpaid, with interest accrued to December 31 of the year in which such
payment is made. Such payment must be made before November 15 or interest will be charged
through December 31 of the succeeding year.
