2006 Law Enforcement Contract
BACKGROUND
Attached to this report is the proposed 2006 Contract for Police Services with
Carver County Sheriff's Office. In following the practice established for the 2005
contract, the City of Chanhassen will be contracting for full-time equivalents
(FfEs). The proposed contract for 2006 will include 13 sworn officers divided
into the following structure:

Total
The night differential is required for any officers working a majority of their shift
after 3:00 pm.
This proposed contract calls for the same number of officers as in 2005, but with
one change. Instead of only having one corporal to supervise the deputies at
night, staff is proposing to replace one deputy with an additional corporal. This
will mean that a corporal will be present for each night shift, instead of only half
the night shifts, as is the current practice.
RECOMMENDA TION
Staff recommends that the Chanhassen City Council approve the attached contract
for police services with the Carver County Sheriff's Office in the amount of
$1,169,375.15 for 2006 policing services. This action requires a majority of the
city council for approval.

2006 CONTRACT FOR POLICE SERVICES
THIS AGREEMENT, made and entered into this day of
2005, by and between the County of Carver, through its Sheriff's Office (hereinafter, "County"),
and the Cityrrownship of Chanhassen, (hereinafter, "Municipality"), and, collectively known as
the "parties".
WHEREAS, the Municipality desires to enter into a contract with the County whereby the
County will provide police services within the boundaries of the Municipality; and
WHEREAS, the County agrees to render such services upon the terms and conditions hereinafter
set forth; and
WHEREAS, said contract is authorized by Minn. Stat. Sec. 471.59, 436.05, and Minn. Stat. Sec.
366 and 367;
NOW, THEREFORE, it is agreed between the parties as follows:
ARTICLE I
1. POLICE SERVICES. The County agrees to provide police service within the corporate limits
of the Municipality to the extent and in the manner set forth below:
1.1 Police services to be provided under this contract shall encompass those police duties and
functions which are the type statutorily deemed to be the responsibility of the local
communities;
1.2 With input from the Municipality, the County shall assign personnel as necessary;
1.3 All matters incident to the performance of such service or the control of personnel
employed to render such service shall be and remain in the control of the County;
1.4 In the event a dispute arises between the parties concerning the type of service to be
rendered, or the manner in which such service is provided, the County shall retain sole
discretion in determining a solution to said dispute; (i.e., re-assignment of personnel,
types of patrol, level of service available); and
1.5 The police services will be provided to the Municipality for the selected number of
contracted hours and/or full time equivalent (FTE) personnel. Such services shall not
include situations in which, in the opinion of the County, a police emergency occurs
which requires a different use of the personnel, patrol vehicle, equipment, or the
performance of special details relating to police services. It shall also not include the
enforcement of matters which are primarily administrative or regulatory in nature, (i.e.,
zoning, building code violations).
ARTICLE II
1. SPECIAL EVENT OR ADDITIONAL SERVICES. If the Municipality desires additional
police services over and above the hours and/or PrE's contracted for in this Agreement, the
municipality shall contact the Sheriff's Office contract manager or designee noted in this
agreement. The County will invoice the Municipality for these additional services pursuant to
Minn. Stat. Sec. 471.425.*
ARTICLE III
1. COOPERATION AMONG PARTIES. It is hereby agreed that the parties and all of their
officials, personnel, agents and employees shall render full cooperation and assistance to each
other to facilitate the provision of the services selected herein.
ARTICLE IV
1. PROVISION OF EOUlPMENT. It is agreed that the County shall provide all necessary
labor, supervision, vehicle, equipment, and supplies to maintain and provide the police services
selected herein.
2. OFFICE SPACE. If an PrE is requested, the Municipality shall provide office and work
space for the assigned personnel.
3. FINANCIAL LIABILITY. The Municipality does not assume liability for the direct payment
of any salaries, wages, or other compensation to personnel employed by the County to perform
the selected services. It is agreed that all personnel shall be employees of the County and the
County shall be responsible for providing worker's compensation insurance and all other benefits
to which such personnel shall become entitled by reason of their employment with the County.
4. MUTUAL INDEMNIFICATION. Each party shall be liable for its own acts to the extent
provided by law and hereby agrees to indemnify, hold harmless and defend the other, its
personnel and employees against any and all liability loss, costs, damages, expenses, claims or
actions, including attorney's fees which the other, its personnel and employees may hereafter
sustain, incur or be required to pay, arising out of or by reason for any act or omission of the
party, its agents, servants or employees, in the execution, performance, or failure to adequately
perform its obligations pursuant to this Contract. Liability of the County or other Minnesota
political subdivisions shall be governed by the provisions of the Municipal Tort Claims Act,
Minn. Stat. Ch. 466, and other applicable laws.
5. INSURANCE. The County agrees that all insurance required to adequately cover vehicles,
personnel and equipment used by the County in the provision of the selected services will be
provided by the County.
ARTICLE V
1. TERM. The term of this contract shall be January 1,2006 to December 31,2006.
2. RATE. For contract year 2006 the Sheriff's Office has presented the municipality with a
recommended police plan which includes the police contract rates.

3. NOTICE.
3.1 If the County does not desire to enter into a contract for police service for 2007, the
Municipality shall be so notified in writing six (6) months prior to the expiration of the
current contract.
3.2 On or before August 15 of the current contract year, the County shall notify the
Municipality of the police contract rates for the following year.
3.3 The Municipality shall notify the County of its intention to contract for police services for
the following year no later than October 15 of the current contract year.
3.4 In the event the Municipality shall fail to give notice as required above, the County shall
presume the Municipality does not desire to enter into an agreement with the County for
police services.

MENU OF POLICE SERVICES
1. 2006 POLICE STAFFING OPTIONS
1.1 HOURLY POLICE SERVICE OPTION
1.1.1 Deputy Sheriff @ $51.85 per hour. For performing the services contemplated
herein, the Municipality agrees to contract for a total of hours in 2006
for Deputy Sheriff services at the hourly rate of $51.85 per hour in the amount of

1.2 FULL TIME EQUIVALENT (FTE) PERSONNEL OPTION
1.2.1 FTE personnel are full time employees dedicated to the contract community. The
FTE deputy's compensated time includes patrol, training, holidays, vacation, sick
leave and other benefited time. The FTE deputy position is not automatically
backfilled when the deputy is away from patrol for the above types of compensated
time. The FTE deputy cost includes: salary, benefits, supervision, administration,
training, clerical support, insurance, vehicle, fuel, equipment, supplies and county

overhead. The FIE costs do not include additional hours which are necessary for
court or filling a shift for a compensated day off. If the Municipality requests
coverage for any compensated days off noted above, it is recommended the
Municipality set aside a contingency for additional hours.
Additional hours for Deputies will be billed at $43.79. Liaison Sergeant additional
time will be billed at $56.16 per hour.*
1.2.2 For Police Services the Municipality agrees to contract for the following Menu of
Police Service FIE's. (A night differential charge of 65 cents per hour will apply
for sworn FIE's working a majority of their shifts after 3:00 PM.)

2. PAYMENT
2.1. The Sheriff shall invoice one-half of the total amount of the current year police
staffing option cost due hereunder, or $585.687.55, to be paid on or before June 30, of
the current contract year. The Sheriff shall invoice the remaining one-half, or
$584.687.55 to be paid on or before November 30, of the current contract year.
3. MINNESOTA STATE POLICE AID: The County upon receiving the Minnesota State Police
Aid shall reimburse the Municipality its share pursuant to Minn. Stat. Sec. 69.011.
. Minn. Stat. Sec. 471.425 Prompt payment oflocal government bills. Subd. 2.(a) For municipalities who
have governing boards which have regularly scheduled meetings at least once a month, the standard
payment period is defined as within 35 days of the date of receipt.

Introduction
The Work Plan is designed as a guide for the delivery of law enforcement services and
coordination with city resources. The work plan allows for input from the City and
Sheriff's Office to develop a list of goals, objectives, work direction and/or focus areas.
The Work Plan is not meant to be all inclusive of the law enforcement mission in
Chanhassen, but instead, helps identify specific work direction, concerns, priorities, or
areas of interest brought forth by City and Sheriff's Office officials and personnel.
The Work Plan has been divided into four main categories:
CONTRACT ADMINISTRATION
Goals, objectives, work direction, focus areas related to
administration of the police contract and the work conducted by the
Contract Supervisor.
LAW ENFORCEMENT OPERATIONS
Goals, objectives, work direction, focus areas related to the work
conducted by the Contract Deputies and other law enforcement
services provided by the Sheriff's Office.
CRIME PREVENTION I PUBLIC SAFETY EDUCATION
Goals, objectives, work direction, focus areas related to the
coordination of work between the City Crime Prevention/Public
Safety Education Specialist and the Sheriff's Office.
COMMUNITY INVOLVEMENT I PARTICIPATION
Goals, objectives, work direction, focus areas related to citizen
involvement in law enforcement and crime prevention issues and
the Sheriff's Office involvement in the community.

CONTRACT ADMINISTRATION
Law Enforcement Records/Reports
The contract supervisor will work with the Sheriff's Records Division to develop reports
for the city council that outlines all of the felony and gross misdemeanor arrests that are
made in the city. The contract supervisor will include that information in the monthly
reports that are made to the city council. The contract supervisor and the crime
prevention specialist will continue to work with the Sheriff's Records Division to develop
reports for use in crime prevention programs, deputy and community service officer
updates, Project LeadFoot, etc.
The contract supervisor will continue to work on getting accurate and complete
information needed and requested by the city manager, city council, and crime
prevention specialist.
The contract supervisor will review deputy schedules and manpower with city staff
throughout the year.
Project LeadFoot
Project Leadfoot is a community approach to calming speed and traffic safety on
neighborhood streets. Traffic complaints are a community problem and it needs a
community approach. We have a number of options with Project Leadfoot and can
design a program for that neighborhood based on what their issues are. Those options
can include educational strategies such as neighborhood flyers, the new speed trailer,
different signage, and education for the complainant. Traffic details and increased
enforcement are also components that can be included. We have a radar gun that we
can allow citizens to check out. This allows them to monitor the traffic themselves and if
they do see a violation provide law enforcement with a license plate number. We can
then send the registered owner a letter advising them of the problems in the
neighborhood.
The contract supervisor and crime prevention specialist will continue to promote Project
Leadfoot through the newspaper, neighborhood watch meetings, and at city council
meetings. Project Leadfoot is a valuable education tool. The contract supervisor and
crime prevention specialist will direct the CSO'S on placement of the speed trailer. An
annual program review will be conducted with the goal of updating and improving
program components where necessary.

Deputy Supervision
The contract supervisor will continue to have a direct role in supervision over the
contract deputies for the City of Chanhassen.
The contract supervisor will continue to meet with the city manager to discuss law
enforcement issues pertaining to the city.
LAW ENFORCEMENT OPERATIONS
Traffic Enforcement/Education
Traffic issues are the number one public safety complaint in the city. The deputies have
focused on traffic for the past year. The Deputies will continue to focus on traffic
education and enforcement. We will also look at ways to not only educate individual
drivers but also the residents at large about traffic laws and problem areas. The
contract supervisor will continue to talk about problem traffic areas at council meetings
and in the paper. The contract supervisor along with the crime prevention specialist will
monitor and direct Deputies to areas where they are seeing problems.
We will continue to have a traffic education/enforcement deputy in the city. This deputy
will take direction from the contract supervisor. This position will be scheduled primarily
Monday - Friday during the day to monitor rush hour. The duties will be traffic related
and will include traffic complaints and traffic accidents. The hours and days will be
variable depending on complaints and events. This deputy will be proactive as well as
reactive to problems and complaints that come in regarding traffic issues. This deputy
will work with the contract supervisor and crime prevention specialist to try to creatively
come up with solutions to problems with an emphasis on prevention.
The contract supervisor along with city staff will review empirical data regarding the
2005 traffic education/enforcement efforts with the new traffic car position.
Parks
As time and staffing allow deputies along with the community service officers will do
patrol in city parks to help to ensure the safety of park users and deter problems.
Contract deputies will also do periodic foot patrol as time permits in city parks looking
for underage drinking, curfew, and other offenses.
The contract supervisor will work with city staff to implement a permit process for
different events, races, and large gatherings that affects roads and or parks.

The contract supervisor will work with city staff to find ways to regulate and monitor the
city skate park. Our goal will be to make the skate park safe and enjoyable for visitors.
We will do this through enforcement, education, and prevention.
Lakes
The contract supervisor will work with the city council, city staff, and residents to
evaluate and help implement a no wake zone ordinance in the city. This ordinance will
include steps for education, notification, and enforcement. The Sheriff's Office will
continue enforcement and education in regards to boat safety on the area lakes.
Juvenile Violations
The contract supervisor will coordinate enforcement strategy for the curfew ordinance in
an effort to combat crimes often associated with juveniles.
Gang Activity
Gang activity is a recognized concern for our communities. It is important to recognize
this issue and develop strategies and programs to respond to any potential concerns.
Contract deputies in conjunction with other county and state resources will continue to
track and identify gang members in the City of Chanhassen.
Gang graffiti will be documented, photographed, and cleaned off as soon as possible
and feasible as per city ordinance.
Emergency Preparedness
The City Emergency Operations Plan is based on The Emergency Operations Plan for
the County. This is very beneficial from a coordination and communication standpoint.
This plan has been used frequently at different situations in the City as well as the
County and has been successful each time it has been used.
If the city activates their Emergency Operations Center the contract supervisor will be
notified so that they can help coordinate City, County and Fire Personnel.
The contract supervisor as well as other county personnel will coordinate, disseminate
information, and meet with the City of Chanhassen's emergency manager and the city
manager on a regular basis.

CRIME PREVENTION I PUBLIC SAFETY EOUCA TION
Rental Housing - Conduct on Premise
The contract supervisor will work with the crime prevention specialist and other city staff
with enforcement of the Rental Housing Code.
Crime Prevention Programs
The contract supervisor will work with the crime prevention specialist in developing new
crime prevention programs. The contract supervisor along with the crime prevention
specialist will continue to do a monthly newspaper column in the local newspaper as
well as articles in the Maple Leaf and Chanhassen Connection.
The contract supervisor will continue to assist the crime prevention specialist with
different events. These events include neighborhood watch meetings, Safety Camp,
Senior Safety Seminar, and other programs that are organized.
City Council Meetings
The contract supervisor will continue to attend City Council meetings on a monthly
basis. The Contract Supervisor will update the Council and citizens about public safety
issues in the city.
The contract supervisor will introduce the contract deputies at various City Council
meetings.
COMMUNITY INVOLVEMENT I PARTICIPATION
Community Events
The Sheriff's Office and City will discuss and make recommendations reference
sponsoring community events, or participating in current community events, utilizing
informational booths and presentations to educate the public on current public safety
issues, crime prevention, and/or the role of the Sheriff's Office in the community. The
Sheriffs Office and Crime Prevention Specialist also encourage and welcome Council
members' participation in these events. Some of the events that the Sheriff's Office will
participate in are National Night Out, Safety Camp, and the Fire Department Open
House.

The contract supervisor will continue to help coordinate traffic control for the July 4th
parade and other festivities that occur in Chanhassen throughout the year.
Vision 2007
The City of Chanhassen has had 10,392 calls for service from January 1st 2005 through
the end of September. This compares to 9,633 calls for the same time period in 2004.
There were 810 criminal calls for service in the same time period this year compared to
950 last year. The county currently has one county wide investigator to follow up on all
of those crimes. I would recommend for 2007 that Chanhassen contract for an
investigator from the Sheriff's Office. This position would be based out of city hall and
would be supervised by the contract supervisor. The contract supervisor would assign
the contract investigator cases. These types of cases would include theft from vehicles,
vandalisms, minor assaults and other cases as needed. The county wide investigator
would continue to concentrate on the larger felony type of cases. The Sheriff's Office
and city staff will continue to monitor case loads and will evaluate staffing options for the
2007 police contract.
