First Reading of Ordinance Amendment - City Code Sections 19-
21, 23, 27, 43,;~6, 49 and 50; Assessment Terms and Criteria for
Establishing Number of Hook-up Units - PW373
Over the last few months, the Inspections Division and Engineering staff have met
to review and discuss existing City code sections 19-21 through 19-50 in an
attempt to clarify some of the text in the code which has created controversy
and/or interpretation from staff in the past. Attached are the revisions to Section
19 as prepared by the city attorney's office for consideration. The changes are
shown by strike out and/or shaded. Listed below are the specific changes and the
methodology behind them.
Section 19-21 (b. 4) - Sewer Hook-up and Section 19-46(b. 4) - Water Hook-up
The ordinance amendment clarifies how the number of hook-up charges (units) are
determined and provides continuity with other metropolitan agencies. The existing
city code equates one hook up unit as 274 gallons of water/sewer estimated to be
discharged from the property which is the same methodology as the Metropolitan
Council uses to determine the number of sewer availability charges (SAC units) to
charge on building permits. The ordinance amendment contains language to
modify 274 gallons of water/sewer usage to a SAC unit of measure. The City
currently relies on the Metropolitan Council to determine the number of SAC units
for each industrial, commercial, and office building permit. The City then applies
the same number of units as hook-up charges less any previous assessments to the
building permit. There has been in the past, debates on how the estimate for
number of units are arrived at. This revision will eliminate controversy and
simplify the process in determining the number of unit sewer and water hook-up
charges to apply to a building permit.

Section 19-2Hc)
This ordinance amendment contains language to simplify the process in reducing
the number of hook-up charges by eliminating the necessity to receive City Council
approval. As stated in the previous ordinance section, the City will use the number
of SAC units to determine the number of sewer and water hook-up units to charge.

The City pays the Metropolitan Council a service fee based on sewer flows from
the City. If the Metropolitan Council reduces the number of SAC units for the
applicant, the City would then also reduce the hook-up charges accordingly. This
ordinance amendment will eliminate the need for City Council action to reduce the
number of hook-up charges. Although the City has not in the past had any request
to reduce the number of hook-ups charges, staff believes from a uniformity
standpoint, that this amendment is appropriate.
Section 19-21 (d) and Section 19-46(d) - Connection Required
This ordinance amendment is more of a housekeeping item. The City currently
allows sewer and water hook-up and connection charges to be specially assessed
against properties at time of building permit issuance. The current city code
requires the City Council to determine the number of years to assess a hook-up
charge and the interest rate (terms). Most of the hook-up charges applied to the
building permit are requested to be specially assessed against the property. Staff
has no documentation whether a previous City Council approved the current terms
for assessing hook-up charges. This ordinance amendment would clarify the terms
and reflect current policy for assessing sewer and water hook-up charges at time of
building permit issuance.
Section 19-23(L j. k & n and Section 19-43(i, j. k. & n - Permits for Connections
The Inspection Division has requested amendments to this section in the city code
to provide continuity with the Uniform Plumbing Code administrative provisions.
Changes include language from "building" or "architect" to plumbing. The
amendment also refers to reinspection fees for plumbing permits. Again, this item
is more of a housekeeping item to eliminate controversy or staff interpretation and
reflect current practice.
Section 19-27 and 19-50 - Inspections and City Supervision of Work
The ordinance amends the inspection time to be between 9:00 a.m. and 3:00 p.m.
on weekdays to match current inspection scheduling.
Section 19-28(c) - User Rates and Charges

The ordinance amendment changes the requirement from an architect to a master
plumber to provide the Inspections Division with the necessary plans and
calculations or other data related to issuing a plumbing permit.

Section 19-49 a - Concernin Water Sewers and Sewa e Dis osal
The ordinance amendment adds language to include the City's standard
specifications and detail plates in preparing construction plans for public and
private development improvements. Staff requested this change to apply
uniformity in construction practices in all development since the development
ultimately impacts the City's infrastructure system, i.e. infiltration, exfiltration (III).
RECOMMENDATION
It is therefore recommended that the City Council adopt the first reading of
Section 19-21(b, c and d), Section 19-23(i, j, k and I), Section 19-27(a), Section
19-43(c, i,j, k and 1), Section 19-46(b, c and d), Section 19-49(a), and Section 19-
50(a) ordinance amendments as prepared by the city attorney's office.

official may require plans, computations, and specifications to be prepared by and the plumbing

The building official may waive the submission of plans, calculations, or other data if the nature
of the permit applied for is such that reviewing of plans is not necessary to ensure compliance
