Preliminary Review, 1998 Trail Project

Attached please find a variety of documents related to the 1998 trail project. On
Tuesday, January 20, the Park & Recreation Commission recommended approval
of the following segments: Highway 7, Highway 101 Connection, Highway
101/Pioneer Trail, and the Bluff Creek Trail. Two segments--Galpin Boulevard
and Powers Boulevard--were tabled until January 27. The Planning Commission
reviewed all six segments on January 21. Upon taking public testimony, they too
recommended approval of the Highway 7, Highway 101 connection, Highway
10 lIPioneer Trail, and Bluff Creek Trail, electing to table the Galpin Boulevard
and Powers Boulevard Trail.
Dave Nyberg of Howard R. Green and I will be present Monday evening to
discuss the current status of this project with the council.

The purpose of this correspondence is to respond to various letters and notices recently sent out
by your organization and the City of Chanhassen. As you are aware our property is included in
the future plans for the new "Trail Project". Since the first correspondence your firm bas
represented in \\'ritten form and verbally in the informational meeting on December 3, 1996, that
the property owners would be contacted for compensation on land encroachment of the trail and
new easements required Additionally, at the infoTInational meeting it was indicated that Carver
Cowrty was contacted regarding placement of the trail closer to the Cowrty road to mitigate all of
the problems pertaining to property compensation and tree destruction. The latest
correspondence indicates that "Individual On-site Meetings" have been completed. TIus is false.
To date your firm has not contacted Sharon, myself or any of our neighbors, nor have the survey
stakes been moved to indicate placement of the trail has changed.
We are in favor of the new trail, but will not tolerate encroachment on our propeny, the
destruction of trees as indicated in your plans and as indicated on the physical survey of the future
trail, or false representation in both \\'ritten and verbal fOIDI. Your fiml has chosen to totally
ignore all of the comments from the landowners pertaining to the preservation of the existing
trees in our neighborhood and especially on our property. The trees were planted and/or moved
to provide a barrier from the busy streets arOlDld our neighborhood at substantial cost. Your plan
provided \'vith the January 14, 1998 notice (which is barely readable) details complete "dear and
grub" areas and makes no mention of preservation of our assets, let alone compensation of your
encroachment on our property.
We request you contact us before the end ofthe day Monday, January 19, 1998 or we will contact
legal COlll1Sel to participate ill negotiations and/or assist in stopping this project.

In December of 1997, you offered a donation of three trees to the City of
Chanhassen. The Chanhassen City Council has accepted your donation of these
trees to be planted in Bandimere Park. We understand the trees shall be up to 10"
in diameter and are valued up to $10,000. The trees shall be installed by Mark
Halla with a 90" tree spade. Jill Sinclair, Environmental Resource Coordinator
will work with Mark on the selection and plantings of these trees prior to
November 15, 1998.
The City is very pleased to have received this special donation. Your timing is

At the City Council's work session on Monday, February 2, 1998, representatives from MnDOT
will be present to discuss a couple of key issues/decisions which they would like direction on from
the City Council as they continue to proceed with the design of the above-referenced project. If
Councilmembers have any other general issues, questions, or concerns regarding Trunk Highway
5 in Chanhassen, i.e. signal timing, traffic control, etc., I would ask that you make a written list to
bring to this meeting. If there is time remaining at the end of our half-hour allotted project
discussion time, some of these questions can also be addressed. Written questions which do not
get covered at the work session can then be taken back by MnDOT representatives for research
and response at a later date.

Building permit activity is slow for traditional single family lots in the $275,000 price
range. The city has approved projects that have non-traditional housing types and these
should keep building pennit activity at around the 200 permits a year.
With the opening of the senior dining later this year, there may be a need for future senior
dining space. The current senior center has seating for 40 persons. Senior programming
has continued to grow as does the senior population. The Senior Commission will be
looking at ultimate needs as a part of the yearly goals.
Because Bandimere Park will be developed this year, the city has lost its compost site.
Recycling and composting is still available in Chaska, although staff is concerned that
illegal dumping will occur. Carver County Environmental Services wiIl assist the city in
providing a match grant to create a recycling center. Staff would like to explore
partnering with the Park and Recreation Department or Public Works Department to find
a pennanent location.
Services Lenl Issues/Unmer Needs
The work of the department involves a lot of public contact, especiaIly when there is a
controversial planning item. With the ability to use interns, the department is able to
meet the greatest demand on our resources during the spring and summer months.
Community Development
Mission and Current Services
Community Development includes the activities associated with Planning, Environmental
Services and Water Resources Management. These activities provide staff support to the
City Council, Planning Commission, Board of Adjustments and Appeals, Environmental
Commission, Senior Commission, and Southwest Metro Transit. Services include
administration of the Zoning and Subdivision Ordinance, Comprehensive Plan, forestry
services, lake management, Storm Water Management Plan, Community Development
Block Grant, and environmental services including compo sting, recycling, and hazardous
waste.
Budget Highlights
The proposed budget has no increase except for cost of living. Water Resources will
have an intem for the summer, but the Planning Department will not have one this year.

As the city continues to grow, complaints and code enforcement increases. Staff is
spending an increasing amount of time on this issue. The increase of enforcement and
the unwillingness to get compliance may increase the demand on legal services.
