Parcel I will be available for a relocated home. Parcel II contains a single family home. The site is located southwest of Rice Marsh Lake and west ofTigua Lane. The site will be accessed via Tigua Lane. The proposed lots meet the minimum requirement of the Zoning Ordinance. Park and trail fees will be paid in lieu of park land. The site generally slopes to the northeast. The natural drainage of the site will be maintained with this subdivision. It is heavily wooded, therefore, the applicant intends to place the home at the 30 foot front yard setback to minimize tree loss due to grading and house placement. Furthermore, the applicant intends to select a sewer alignment that would have the least impact on mature trees. This alignment will be verified on site at the time of building permit. Staffwill ensure that tree loss does not exceed that permitted by ordinance. Staff believes that this plat request is a reasonable one and consistent with guidelines established by the Comprehensive Plan and Zoning Ordinance. We are recommending that it be approved with conditions as outlined in the report. BACKGROUND On June 26, 1980, the City Council approved the subdivision of 39.8 acres into 8 single family lots, Rice Lake Manor. In the current request, the applicant is proposing to subdivide Lot 2, Block 1, Rice Lake Manor, into two lots. On May 26, 1998, the City Council recommended approval of a house moving permit. At that time, staff explained that should the City Council approve the house moving request, the applicant would make an application to subdivide Lot 2, Block 1, Rice Lake Manor into 2 lots to provide a site for the home. SUBDIVISION The applicant is proposing to subdivide a 6.32 acre site into 2 single family lots. The density of the proposed subdivision is 0.3 units per acre. Both lots far exceed the minimum 15,000 square foot of area. Parcel I is proposed to have an area of2.57 acres, and Parcel II, 3.75 acres. Parcel I will be reserved the relocated house. Staff notes that the proposal is consistent with the Comprehensive Plan and generally consistent with the Zoning Ordinance. Metes and Bounds Subdivision #98-10 August 24, 1998 Page 3 WETLANDS The City's wetland map indicates the existence ofa wetland on the site east of the sanitary sewer easement. The buffer strip width required for natural wetlands is 20 feet. The principal structure setback for the wetland is 40 feet measured from the outside edge of the buffer strip. RIPARIAN RIGHTS Riparian rights are property rights arising from owning shoreland. Riparian status allows a property owner to "wharf out to a navigatable depth." According to the shoreland ordinance, a riparian lot on a natural environment lake (Rice Marsh Lake) must have a minimum width of 125 feet. However, a non-riparian lot, or a lot with no lake access, needs only to have a 90 foot minimum width. Parcel I is only 100 feet in width. Therefore, if the applicant submits the lot split as per plan, Parcel I will not have riparian rights to Rice Marsh Lake. Parcel II will lose all riparian rights with the metes and bounds subdivision. If the applicant wishes to secure riparian rights for Parcel I, they must reconfigure the subdivision so that the parcel maintains the 125 foot minimum width. GRADING AND DRAINAGE Only minor grading is anticipated for utility installation and driveway construction for the new home site. This work will most likely occur when the building permit has been issued for the home. The survey does show existing contours, however, it does not show proposed contours or the exact driveway location. Staff recommends that a detailed grading (proposed and existing), drainage, erosion control, and tree removal plan be submitted for review and approval by staff prior to issuing the building permit. In addition, the exact location of the sewer and water line should be determined and shown on the survey as well. The applicant shall be responsible for SWMP fees pursuant to City ordinance. Currently, the SWMP fees for water quality and quantity are $800 and $1,980 per acre, respectively. These fees are based on .86 acres of buildable upland. Therefore, the applicant is responsible for $698 in water quality fees and $1,727 water quantity fees. UTILITIES Municipal sewer and water service is available to the property. Water service is actually located along the east boulevard of Tigua Lane. The water line was previously installed by the developer, however, no individual water services were extended to the property, therefore, it is the responsibility of the developer for the cost of the City extending the water line underneath Metes and Bounds Subdivision #98-10 August 24, 1998 Page 4 Tigua Lane to the property line. It is estimated to be $3,500 to complete this work. It is recommended that the applicant escrow with the City $3,500 for this work. The new lot will be subject to sanitary sewer and water hook up charges in accordance with city ordinances. Currently, the hook up fees are $1,216 for sanitary sewer and $1,584 for water service. These fees are payable to the City at time of building permit issuance. Sanitary sewer is located on the property approximately 350 feet east of the proposed house. Since the lot is fairly wooded, field verification for the sewer alignment should be done to minimize tree loss. STREETS Tigua Lane is constructed in general accordance with the City's urban street section. No additional right-of-way or street construction is required. The exact alignment of the driveway needs to be shown on the Certificate of Survey. GIS FEES According to city ordinance, the applicant will be responsible for paying the City GIS fees in the amount of $35 ($25 per plat, $10 per parcel). According to City records, an existing 20-foot wide pedestrian easement for trailway purposes over and across this lot exists. The Certificate of Survey should be revised to reflect all existing easements of record, i.e. drainage, utility, sanitary sewer and trail. Staff recommends allowing a maximum 20 foot width clearing for the sewer and driveway and a 20 foot tree removal area around the building pad. RECOMMENDATION Staff recommends the City Council approve Metes and Bounds Subdivision #98-10, Rice Lake Manor Estates, as shown on the plans dated received August 5, 1998, subject to the following conditions: 1. The applicant shall submit a tree survey for the new parcel identifying all significant trees on the property. 2. Tree removal limits around the building pad shall be shown on the building permit survey. A maximum of20 feet is allowed around the building pad and as the width for the driveway. 3. Tree protection fencing shall be installed around any areas designated for preservation. 4. A maximum width of 20 feet shall be allowed for clearing vegetation in order to hook-up to utilities. 5. Prior to issuance of a building permit for Parcel I, a detailed grading, drainage, erosion control, and tree removal plan shall be submitted to the City for review and approval. In addition, the Certificate of Survey shall include all existing easements of record, the proposed driveway location and proposed sewer and water lines. 6. Back!!round: If the house move is approved. the applicant plans to subdivide 8571 Tigua Lane into two complying lots and move this dwelling to the new lot. The home on the current lot, Lot 2, Blockl, Rice Lake Manor, was built in 1989, Chanhassen City Code, Article III, Section 17-43 (enclosed) requires a hearing be conducted by City Council after notification of property owners within 350' of the subject property. A Notice of Hearing was mailed to property owners on the enclosed list on 5!l5/98. Analvsis: City code requires a moved home to: comply with the Uniform Building Code; be well maintained and in a good state of repair; comply with Chanhassen City Code, Chapter 20; and not materially depreciate surrounding property values. Uniform Building Code. Inspections Division staff inspected the home on 5/8/98. The applicant was given a list of items (enclosed) required to bring the home up to current code. These items will be incorporated into the building, plumbing and HV AC permits that will be required as part of the move. Dwelling Condition. The home, which was built in 1957, has been generally well maintained. The roof is old, with evidence of leaking, and should be replaced.
