Approve Ownership Transfer of Outlot B, Highover
Project No. 97-15
In conjunction with final platting of Highover, the developer, Mr. Jerome Carlson,
deeded Outlots A, C and 0 to the City for park and trail purposes. In addition,
Mr. Carlson deeded Outlot B which contains a temporary stormwater pond to the
City as well. This temporary pond is designed to be abandoned and relocated
downstream and the property incorporated into lots with the future subdivision of
the adjacent parcel (Wirtz Addition).
At this time the City of Chanhassen is the owner of Outlot B and the developer,
Mr. Carlson, is requesting the City transfer ownership back to him. Initially, Mr.
Carlson believed it was necessary, due to the pond, to transfer ownership of Outlot
B to the City. He always believed that the City would transfer ownership back
when the temporary stormwater pond was no longer needed. Staff has reviewed
this request and believes that like most developments a drainage and utility
easement is the appropriate document to address the situation.. Mr. Carlson has
agreed to convey such easement. Therefore, it is recommended that the City
Council direct the City Attorney's office to prepare a warranty deed to transfer
Outlot B, Highover from the City of Chanhassen to Mr. Jerome Carlson and
prepare a drainage and utility easement agreement for Mr. Carlson to convey to
the City of Chanhassen. The legal description of the ponding area shall be
provided by Mr. Carlson.
