House moving to 8561 Tigua Lane.
Backe:round:
If the house move is approved, the applicant plans to subdivide 8571 Tigua Lane into two
complying lots and move this dwelling to the new lot. The home on the current lot, Lot 2,
Block 1, Rice Lake Manor, was built in 1989.
Chanhassen City Code, Article III, Section 17-43 (enclosed) requires a hearing be conducted by
City Council after notification of property owners within 350' of the subject property. A
Notice of Hearing was mailed to property owners on the enclosed list on 5/15/98.
Analvsis:
City code requires a moved home to: comply with the Uniform Building Code; be well
maintained and in a good state of repair; comply with Chanhassen City Code, Chapter 20; and
not materially depreciate surrounding property values.
Uniform Building Code. Inspections Division staff inspected the home on 5/8/98.
The applicant was given a list of items (enclosed) required to bring the home up to
current code. These items will be incorporated into the building, plumbing and HV AC
permits that will be required as part of the move.
Dwelling Condition. The home, which was built in 1957, has been generally well
maintained. The roof is old, with evidence of leaking, and should be replaced. I have
enclosed exterior pictures of the dwelling taken by Inspections Division staff as well as
a copy of a realtor's brochure.
Chapter 20. As stated earlier, the applicant plans to subdivide an existing lot ifthe
house move is approved. The applicant is aware the proposed lot split is subject to the
requirements of the Chanhassen City Code. The main level of the home is 1250 square
feet. This exceeds the minimum required area for all types of homes in Chanhassen.
The home currently has a two car garage. Plans have not been submitted for the
foundation or additions to the moved building, but a two car garage will be required.
Additionally, the proposed building location will be required to comply with all
building setback requirements.

No one may move a used building into or within the city except upon issuance of a permit
issued by the city council.

Sec. 17-42. Application.
(a) A person required to obtain a permit by this division shall file an application with the
city, accompanied by a fee in the amount established by resolution.

Greetings:
This office is counsel for Bloomberg Companies Incorporated,
the applicant requesting approval of the Site Plan for the
renovation of the Frontier Center.

This letter is submitted in support of the Bloomberg proposal,
requesting approval of the Site Plan application, with the
conditions as set forth in the attached proposed Resolution.
Attached are a revised proposed Resolution, which we request
the Council adopt; and a letter from Robert Davis regarding use of
brick on the south wall.
The Frontier Building was built by Herbert Bloomberg in
approximately 1965. Herbert Bloomberg had a national reputation
and business as a builder of Behlen buildings. Frontier was a
"Behlen" building, constructed with exterior bearing walls of
formed structural steel panels, bolted together. The entire west
wall, the north and south end of the east wall, and the east and
west ends of the south wall, consist of Behlen panels.
The building was used as a retail and wholesale lumber yard.
Since the closing of the Frontier Lumber, that part of the
building has had various uses. The northerly portion, of wood
frame constuction, f+onting on West 78th Street, has always been
retail and office. h

Bloomberg now seeks approval of its Proposed Site Plan for
retail tenant usage in the southerly portion.
City Staff and Bloomberg have had many meetings and
conferences to iron out differences and disagreements. Significant
disagreements between Staff and Bloomberg have been reduced to:
a. May Bloomberg retain, as an architectural element
in its design, the Behlen steel panels on the west wall?
[see paragraph # 6 of attached proposed Resolution, in alternate
form] ;
b. Is the Bloomberg design for the South Elevation
within the standards of Sec. 20-110 and Sec. 20-116 of the Zoning
Code?
[see paragraph I 7 of the attached proposed ReSOlution].
a. WEST WALL.
Bloomberg proposes the retention of the Behlen steel panels
as the exterior wall surface because:
1. The sculpted effect of the panels provides:
complimentary difference in materials;
texture and additional dimension;
excellent backdrop for Bloomberg I s proposed
three dimensional murals.
2. The steel panels are:
a structural part of the building;
undiminished in function and effectiveness.
3. The steel panels are to be painted.
4. As an existing part of the Building I we do not
believe its retention as an architectural element of design, if
otherwise acceptable, is precluded by the Sec. 20-116(b) phrase
"use of metal trim on building exteriors shall be limited. "
b. SOUTH ELEVATIOII.
Bloomberg seeks Council approval of its design as submitted
(Sheet A 3, "ExterioI; Elevations") because:

1. The design and architectural detail are consistent
with the 78th street frontage of the north portion of the Frontier
Building and the Chanhassen Dinner Theatres Building, of which the
subject building is an integral part, with unified exterior design.
2. Bloomberg's design reduces appearance of breadth and
mass by:
Lap siding to frame the windows at the east and
west ends;
A central mansard,
flanked by smaller mansards;
Cedar columns to support the mansard.

without structural changes;

The design is flexible, to enable such
remodeling or changes that the retail
leasing market would require in the
future.
5. The proposed design suits tenants' needs in that:
Visibility is vital to the retail tenant;
Sign visibility is vital to the retail tenant;'

6. Bloomberg does not choose the all-brick facade
because:
An all-brick facade would emphasize any
perception of mass and height;
Brick is not practical for tenant construction
flexibility [see Robert Davis letter];
Brick does not create transition from the
"Cinema" building;
Bloomberg's proposed use of brick as a
foundation accent is consistent with its
use elsewhere in the Frontier Building in
the 78th street frontage.
Approval as submi tted, wi th exceptions as noted in the

The following resolution is proposed by,Bloomberg Companies,
the Applicant, requested to be adopted by the Chanhassen City
Council, at its Meeting on Tuesday May 26, 1998..

RESOLUTION
Whereas, The Planning Commission on May 6, 1998 approved the
site Plan for the Frontier Building (#98-7 SPR), with sign
variance, according to plans dated March 23, 1998 and revised April
27, 1998, subject to certain conditions; and
Whereas, The site Plan and Applicant's submission comply with
the requirements of the Chanhassen City Code; and
Whereas, The Frontier Building was originally constructed in
1965 as a "Behlen" building, with exterior bearing walls of formed
structural steel panels, to be a facility for the wholesale and
retail sale of lumber and building materials; and
Whereas, The Frontier Building, since the closing of the
Frontier Lumber business, has had various uses; and
Whereas, Applicant's proposed renovation and redevelopment of
the Frontier Building represents a significant improvement and
regeneration of the building, which is expected to be a significant
contribution to the commercial life of Chanhassen;
Whereas, Applicant's financing for construction of the
renovation and improvements contemplated is in place; and
Whereas, Applicant's negotiations with prospective tenants for
leases have been ongoing, and signing of and commitment for leases
have been deferred pending City approval of the Site Plan; and
Whereas, Applicant and the Staff of the City Planning
Department have resol ved by agreement many of the issues of
exterior design, finish, and materials, with some differing points
of view remaining;
Whereas, Approval of the EDA for the Site Plan and the project
for the purposes of Tax Increment Financing and approval and
execution of an appropriate Redevelopment Agreement is essential
to the Applicant's completion of the project, which approval of
the EDA will be sought by Applicant;
NOW THEREFORE, BE IT RESOLVED, The City Council approves the
Site Plan for the Frontier Building (#98-7 SP~), with approval of
a variance to allow signs [as shown on the plans submitted] on the
building which does not have direct frontage on a public street,
as shown on the site plan dated March 23, 1998, as revised on April
27, 1998, with the following conditions.
1. Roof Top Equipment. All existing and proposed roof
top equipment shall be screened from views, specifically from
Highway 5.
2. Sign Peraits and Variance. Applicant must obtain
a sign permit prior to erecting any signage on the site.
3. Signs. The location of letters and logos shall
be located as shown on the plans submitted. The letters and logos
shall be restricted to 30 inches in height. All individual letters
and logos comprising each sign shall have a minimum depth of five
inches and shall be constructed with a translucent facing over neon
tube illumination. Tenant neon illuminated signage shall consist
of store identification only. Copy is restricted to the tenant's
proper name and major product or service offered. Corporate logos,
emblems and similar identifying devices are permitted provided they
are confined within the signage band and do not occupy more than
15% of the sign area. Applicant shall consider utilizing a
font/sign style that is compatible with the building.
4. Sewer and Water Hook-up. Applicant and/or its
assignee shall be responsible for any additional sewer and water
hook up charges associated with remodeling the building based on
the number of SAC uni ts determined by the Metropoli tan
Environmental Sewer Commission.
5. Fire Policies. Fire Department recommends tha

6. West Elevation - Behlen Steel Panels. Applicant's
treatment of the exterior of the west elevation, with exposure of
a portion of the original "Behlen" exterior wall of formed
structural steel panels, and wi th three dimensional murals, is
accepted. [Applicant's preferred approval.]
OR: [Alternate] The west elevation shall be altered
from Applicant's submitted plans to cover the Behlen steel panels
with painted wood panels, (board and batten) similar to and
continuing the existing paneling to the southerly extension of the
west wall.
7. South Elevation. Applicant's proposed South Elevation
design, as depicted on Sheet A 3, "Exterior Elevations", with
Mansards, signage location, foundation brick accent, cedar lap
siding, windows and tenant entry door concept, is accepted.
8. Flower Boxes. Flower boxes shall be installed at
the base of the columns along the south elevation.
9. Roof Drainage. Applicant's plan for disposition of
roof drainage on the west elevation is accepted, subject to
Applicant's revision of the plan if it is found to be unworkable.
10. EDA Approval. This Site Plan approval shall be
effective only upon approval of the EDA for the site Plan and the
project for the purposes of Tax Increment Financing to be applied
for by Applicant.
11. site Plan Agreement and Security. Applicant shall
enter into a site plan agreement with the city and provide
necessary financial security in the form of letter of credit or
cash escrow to guarantee compliance with the conditions of
approval.

Regarding the feasibility of installing a brick facade on the south elevation
of the Frontier Building:
The South Wall of this building is a curtain wall; it has no roof load imposed, roof
load being carried entirely by the East and West Walls. The wall section above
the window area has only its own dead load and wind loads, which are currently
handled by the window mullions.
If this area were to receive brick, the additional load would require re-designing
the total wall, including a continuous steel beam supported by 4 or 5 steel
columns. If the columns were to be brick or brick-clad, the flexibility of the
division of tenant spaces would be greatly compromised. To maintain necessary
flexibility in dividing into tenant leasehold spaces, I recommend minimizing any
necessary columns in order to keep the modular window mullion pattern that can
receive entry doors at any point along its length.
Another factor is that the lintel area is protected by the mansard, and is subject
only to mild weathering, not to wear and tear of passers-by or traffic. Except for
purely subjective considerations of appearance, the lintel need not be of
exceptionally durable and expensive material such as brick.
