Dear Mr. Cook:
This letter is a formal notification that the revocation of interim use permit #96-2 will be
reviewed by the City Council on June 8, 1998. Staff believes that the operation located at 850
Flying Cloud Drive is in violation of the permit. Recent activities include unauthorized grading,
the operation of a landscape contractor's business and the installation of a sign without a permit.
All of these issues were addressed in previous correspondence without a response from you or
your tenant, Mr. Dick Henning.
The City Code requires a permit for the grading of more than 50 cubic yards of material (Sec. 7-
30). You were notified in a letter dated November 14, 1997 that grading had taken place in the
northern portion of the property and that a permit should be obtained from David Hempel in the
engineering department. Although you did contact Mr. Hempel regarding the permit, you never
completed the application. That is a violation of condition number 13 of the interim use permit.
The interim use permit allowed the operation of a wholesale and retail nursery. Staff believes
that the operation is a landscaping business. As mentioned in a letter dated December 8, 1997,
advertisements in the yellow pages state that Dick Henning Enterprises Inc. offers "complete
landscaping services" and "landscape design." You were notified in a letter dated December 16,
1997 that the landscaping activity must cease by January 31, 1998. Staff believes that this
activity is still taking place.
Also, a sign was installed on the property without a permit. Mr. Henning did submit an
application for a sign permit, however, it has not been approved. The building official was
awaiting footing specifications. Section 20-1258 of the zoning ordinance states that he has 10
days from the receipt of this letter to remove the sign.
If the site is brought into compliance with the conditions of the interim use permit prior to the
June 8th meeting date please contact me for a site visit. Should you have any questions, please

Dear Ms. Kirchoff:
Thank you for providing me with zoning and other information recently relating to Bruce
Johansson's property. As I informed you on the telephone, I have been retained to assist Mr.
Johansson in resolving two issues: saving his view of Lotus Lake, and retaining use of the public
right-of-way in front of his property.
After reviewing the Chanhassen City Code, I have several questions and concerns. Some
of these may more appropriately be addressed by another person or at another level. If so, please
forward them to the correct person. These issues are as follows:
Right-of-Way Use
1. Mr. Veltkamp has constructed retaining walls and placed landscaping into the public
street right-of-way to the north of his and Mr. Johansson's property, in what was originally
platted as Tamarack Road. This road never has been vacated, and numerous residents of the area
have long used it as a pedestrian access to Lotus Lake. This passageway has become narrower
and steeper with Mr. Veltkamp's encroachments, and presently is hazardous to use. This could
result in liability for the City, if someone were to fall and sue the City for the condition of its
right-of-way.
2. Mr. Veltkamp apparently wants to take over the right-of-way, but is unwilling to wait
until it is vacated. Dave Hempel, Assistant City Engineer, has advised me that on April 23,
1998, he mailed Mr. Veltkamp an application to vacate a street. IfMr. Veltkamp files such an
application, please notify me at once.
3. Mr. Johansson opposes vacation, because he believes (and with strong evidence to
support him) that Mr. Veltkamp will completely block access to the lake if the street is vatfl:(~EfVED

This would not serve the public.
4. The encroachment into the right-of-way is hurting the neighbors now, and could harm
the City if a personal injury lawsuit were to occur.
5. City Code Sec. 13-1 defines a nuisance to include an act which "endangers the. . .
safety. . . of the public; . . . Unlawfully interference [sic] with the use of or obstructs. . . a . . .
street. . .; Depreciates the value ofthe property of the inhabitants of the city; . . ." Likewise City
Code Sec. 13-2 provides an example of a nuisance as "(6) Obstructions. . . affecting the use of
public streets. . ." Mr. Veltkamp's encroachment meets this definition.
6. Note: Mr. Johansson also has an encroaching fence, and he is ready to remove it
when Mr. Veltkamp's encroachments are removed.
7. We encourage the City to enforce its ordinance and require removal of all encroaching
structures and landscaping, as well as requiring removal of the fill that has increased the slope of
the street.
View of Lake
1. Mr. Veltkamp has constructed a fence and planted quick-growing trees and other
plants between his property and Mr. Johansson's, apparently with the sole purpose of blocking
Mr. Johansson's view of the lake. His latest attempt to block Mr. Johansson's view is a plan to
construct a new garage. He has indicated that he would raise his driveway eight feet, and have
the garage roof at the peak of his current roof. This would allow him to continue his roofline at a
high enough elevation to block Mr. Johansson's view.
2. City Code Sec. 20-482(b )(2) allows the removal of vegetation "to provide a view of
the water from the principal dwelling site". This clearly indicates that the City understands how
precious a lake view is, and how dearly a person would want to preserve their view. Mr.
Veltkamp is extremely upset at the threat of being denied his remaining view.
3. Numerous provisions ofthe zoning ordinance speak to the desire to protect and
preserve the value of property and the aesthetic appeal of neighborhoods. See. ~ Sec. 20-482
(quoted above), Sec. 20-1176 (want "to protect, preserve and promote the aesthetic appeal,
character and value of the surrounding neighborhoods"), Sec. 20-951 (avoid "conditions which
could adversely affect the surrounding area"), and Sec. 20-106 ("maintain and improve the city's
tax base", "mitigate to the extent feasible adverse impacts of one land use upon another"). These
same concepts apply to protecting lake views.
4. We recognize that current City Code may not contain a sufficient provision to protect
the lake views. However, the City could adopt a new ordinance consistent with these provisions
and concepts. Some very rough draft language is attached. If you are open to this concept, we
can draft far more precise and specific language.
Health and Safety Concerns
1. Mr. Ve1tkamp's house is approximately fourteen feet from Mr. Johansson's home. On
the side of his roof nearest Mr. Johansson's home, Mr. Veltkamp is storing a six-foot wreath,
landscape material, an aluminum ladder, and other items. Not only are these unsightly, but they
create a fire hazard for both Mr. Veltkamp and Mr. Johansson. With the houses as close as they
are, a fire could easily travel from Mr. Veltkamp's structure to Mr. Johansson's home.
2. The City Code, in Sec. 9-43, adopts the Minnesota Uniform Fire Code and the
National Fire Codes by reference. As I recall, these Codes have rather strict requirements
regarding creating fire hazards.
3. City Code Sec. 16-2 also requires that refuse be removed from a site weekly, and not
be allowed to accumulate "so as to create a fire or health hazard."
4. City Code Sec. 20-909 prohibits outdoor storage with few exceptions. The wreath,
landscape material, aluminum ladder, and other items presently being stored on Mr. Veltkamp's
roof do not come within any of these exceptions.
5. We strongly encourage the City to take appropriate steps to protect its residents from
unreasonable and illegal fire hazards.
I will be calling you shortly after Memorial Day to set up a time when we can meet to
discuss what action can be taken to deal with these concerns.

enjoyed by all residents; and
WHEREASt the view from the water to the shore is protected by ordinances controlling
shoreland development; and
WHEREASt the view of the water from the shorelands also should be protected; and
WHEREASt a view of the water enhances the value of property; and
WHEREASt unobstructed views of our lakes enhance the quality of life for all
Chanhassen residents and visitors.
NOWt THEREFOREt be it ordained by the City Council of the City ofChanhassen:
Section 1 - That Chanhassen City Code is hereby amended by adopting one new section
which shall read as follows:
Sec. 20-***. (a) The view ofa lake from residences shall not be obstructed by hedgest
fences, or similar landscaping.
(b) The view of a lake from residences shall not be obstructed by building additions.
(c) The Planning Commission may grant a variance to these restrictions under the
customary variance provisions when an improvement to land is necessary and there is no feasible
or prudent alternative.

The City of Chanhassen will begin construction on a portion of the Bluff Creek
Trail Corridor within the next sixty (60) days. A diagram depicting this trail
segment is attached. In conversations with Bob Obermeyer and Hal Runke of
Barr Engineering, and Phil Elkin of our office, I understand that matching funds
may be available for portions of this project. An agreement to share responsibility
for certain costs would be covered in a Petition for a Basic Water Management
currently being reviewed by the district.
Mr. Obermeyer encouraged me to forward documentation of eligible expenditures
to the district. It is my understanding that up to 50% of trail costs and up to 25%
of land acquisition costs are eligible. I will submit future correspondence
accordingly. Conrad, I appreciate your continued support of mutually beneficial
projects within the district.

Planning Department
. Attached is an invitation to the
Groundbreaking Ceremony for the new
Highway 212 Corridor on May 29 at
8:00 a.m. at the new Southwest Metro
Transit Hub site in Eden Prairie.
. 96th Street Wetland Restoration/
Flood protection project: Last week I
held a neighborhood meeting for
properties located at the intersection of
Pioneer Trail and Great Plains Boule-
vard. I have received several calls from
residents regarding the flooding
problems in this area; particularly the
three homes whose access is located
along Pioneer trail.
These homes have a long history of
flooding problems. Before these homes
were built, this area was farmed and
effectively kept dlY by draintile. After
the land was subdivided into SRF lots,
these tiles have gradually filled and
have created (or returned) the area into
wetlands. This does not have much of
an impact on the homes located along
96th Street; although it hinders some
efforts to maintain a crop, it has at
times, entirely flooded the garages,
sheds and animals of the southern lots.
The flood waters are also threatening
the septic systems of these homes. The
current area eventually drains into the
gorge portion of Bluff Creek.
I explained at the meeting it was my
recommendation to design a drainage
plan that will restore wetlands in this
area to create holding ponds to provide
water quality and to provide rate
control to protect against erosion along
Bluff Creek. I also had to explain that
this area is classified as wetlands and
draining the area dry was not an option.
The meeting was well attended and I
was pleased with the response.
I would like to order a feasibility study.
This project was not in my 1998 budget,
but I would like to fund this project and
omit the Longacres wetland restoration
project as well as the Lake Ann Park
stormwater ponds. The work on Lake Ann
Park should be in conjunction with road
upgrades and the Longacres project will be
more cost effective if easements are
obtained from properties to the south in
conjunction with development.
This project is included in our petition to
the Watershed District, so we would be
reimbursed for the project once the Basic
Water Management Plan is approved.
Public Works/Engineering
· Utility Operator Jerry Johnson was bit
by a dog on Tuesday while reading water
meters. The dog has been quarantined
and the matter has been turned over to
Public Safety.
· The Public Works Department held an
employee picnic in honor of National
Public Works Week.
Public Safety Department
· Storm damage from the recent two
storms was, fortunately, minimal as
compared to neighboring cities. We did
lend fire, police, and inspections
assistance as needed.
· FYI: Did you know that even with the
hi-tech resources, cities still use good
old fashioned weather storm spotting by
emergency response personnel? Police
and fire personnel are dispatched to
predetermined observation points.
· I want to assure the council that no
misinformation regarding Monday
night's council meeting regarding sirens
was intentionally given out by me. I
interpretted the discussion and motion
to bring more information back to the
council, which is what I told the
Tribune. I was not interviewed by
Kathy Nelson regarding her article.
One of my secretarial staff was admon-
ished for giving out incorrect informa-
tion about her own interpretation of
what she had heard.
· Mark Littfin was questioned about
the fire hydrant placement at the
Heartland building on Century Boule-
vard. When the first set of plans were
submitted, there were no indications of
vehicle parking on the west side,
therefore hydrants located behind the
curb were acceptable. As plans were
changed and resubmitted, perpendicu-
lar vehicle parking was shown. At that
time, Mark requested the hydrants be
relocated to the current location so they
could be quickly located and readily
accessible by firefighters. If they would
have been left in their original location,
the vehicle parking would have blocked
their view or possibly made them
inaccessible. Oftentimes in lieu of
bollards, concrete curbing is used to
protect and help identify the hydrant
location.
Administration
. Southwest Transit: Len Simich called to
confirm that three new programs would
be offered by Southwest Metro Transit
starting immediately, i.e:
- Free Public Service Transportation:
This program would allow each of the
three cities to determine how approxi-
mately 20 hours offree bus service could
be used. It could be used to allow the
council and/or commissions to tour
public projects, review the status of
current projects, etc. The hours could
also be used for various park and
recreation programs and/or senior
outings; and
- Emergency Shelter: This service would
involve being able to immediately
dispatch whatever number of buses to
temporarily house people displaced from
their homes/apartments because of
storms/fire/etc; and
_ Community Billboard: Most ofthe new
buses have a billboard which could be
used by any of the cities for public
purposes, i.e. "Don't forget to vote on the
Chanhassen Park Referendum on (Date),"
"Don't forget Chanhassen's 4th of July
Celebration (Dates);" etc.
. Pedestrian Bridge: The city was once
again recognized for our pedestrian bridge
on Highway 5 (see attached article from
the The City Pages entitled, "Best of the
Twin Cities 1998."
. Tobacco Licensing: Am I glad that we
got out of the tobacco licensing business!
As can be seen from the attached report,
the Chanhassen Bowl is in trouble again.
. Hansen Property: Negotiations are
proceeding very well with Doug Hansen in
regards to the city being able to acquire a
portion of his property for the expansion
of City Center Park. We are currently
working out the details of an offer that
could produce a win/win/win situation.
. Sirens: I think the city council will be
very happy with the presentation to be
made next Tuesday. This will be a work
session item with staff simply presenting
the specifications that have been prepared
as well as the map showing coverage
areas, overlap (hopefully there won't be
any), etc. As we have had calls from
citizens wishing to hear that presentation,
staff proposes that the first part of the
meeting (5 p.m. portion) be held in the
council chambers. I would hope that it will
be completed before 5:30 p.m. and can
then move to the Courtyard Conference
Room to complete the normal review of
agenda items in a work session fashion.

Dear West 96th Street Residents:
This letter is to ask for your participation in a neighborhood meeting regarding drainage issues
for the area located at the northwest corner of Pioneer Trail and Great Plains Boulevard (see
map). This past year the city has received several phone calls from residents in this area
regarding pipe locations, illegal berm construction and inquiries for making ponds.
The city recognizes this as a problem area and would like to work with homeowners to improve
the situation. It is the city's desire to create effective wetlands which increase water quality,
control runoff rates and protect the integrity of the area. I believe we can meet the water quality
expectations while protecting the property in this area from flooding. The city has money
available for wetland restoration projects of this nature.
I have scheduled a public meeting on Tuesday, May 12,1998 at 7:00 p.m. in the Chanhassen
City Council Chambers (next to the library) located in City HaIl, 690 City Center Drive. The
meeting will have an informal format and is for residents who have any questions and want to
know more about the project or would like to provide input on the design.

DETAILS:
On 04-23-98 the Carver County Chief Deputy Auditor Laurie Engelen, sent a certified letter to Rick
Sipperell, the general manager of the Chanhassen Bowl at 581 West 78th Street, Chanhassen. Mr.
Sipperell was informed that the county board had denied his application for a tobacco sales license
at the business. The basis of the denial was due to the real estate taxes for the business selling the
tobacco being delinquent. The letter, which is attached to this report, indicated that notice of denial
was also being reported to the Carver County Sheriff in order to ensure compliance with the denial.
Auditor personnel advised me that that a receipt card had been signed by Mr. Sipperell, indicating
he had received the notice.
It was decided I would wait approximately one week before attempting a purchase of tobacco at the
establishment. On 04-30-98 at approximately 1710 hours I went in plain clothes to Chanhassen
Bowl. I asked the clerk behind the counter in the bowling alley if they sold cigarettes. He indicated
that they did. I asked him how much they cost. He told me a pack cost $3.25. I gave the clerk a five
dollar bill and requested he provide me with a pack of Camel Lights. The clerk went to an area
behind the counter where a cigarette machine was located outside a public area. He placed the
money into the machine and produced a pack of Camel Light cigarettes which he gave me.
At that time I identified myself as a deputy with the Carver County Sheriff s Office. I advised him
it was illegal for him to make a sale of tobacco due to the fact that the establishment did not have
a license. The clerk was identified as Matthew John Myklebust, DOB 02-02-80. Mr. Myklebust
said he was unaware the bowling lanes did not have a license. No one had told him to discontinue
selling cigarettes or tobacco products. I advised Matthew.Myklebust that it was my opinion a
violation of the ordinance had occurred and I would prepare a report and forward it to the County
Attorney for review of possible charges. I told Mr. Myklebust that he should give my name and
telephone number to Rick Sipperell and tell him to call me. He told me Mr. Sipperell was out of
town but he would leave the message. I further advised Mr. Myklebust that the establishment
needed to immediately cease and desist with the sale of tobacco.
On 05-01-98 I placed a telephone call to the Chanhassen Bowl at approximately 1150 hours and
spoke to an employee who indicated Mr. Sipperell was out of town. I asked the employee if they
