Approval of 1998/99 Liquor Licenses
Attached please find a summary listing of all Chanhassen liquor licenses that are
renewed annually by the city council. All applications received meet city
requirements; however, I am still working with several establishments who have
not yet submitted all of their paper work. This is not unusual and I will continue to
work with them. You will notice that Pass By Liquor (Highways 7 & 41) is not
included on the attached list. This establishment closed recently.
The Public Safety Department has completed background investigations on each
applicant, which included a criminal history, outstanding warrants, and driving
records. No negative comments were found on any ofthe applicants.
I have contacted the Carver County Treasurer's Office to determine if any liquor
establishment is delinquent on their property taxes. The only one is the
Chanhassen Bowl, which is delinquent on the second half of their 1997 taxes. As
they have filed for bankruptcy, their license is protected under bankruptcy laws.
If a reorganization plan is not submitted to bankruptcy court before March 19,
1998, the U.S. Trustee will make a motion to convert the case to Chapter 7. A
court assigned advisor would then liquidate all assets of the Chanhassen Bowl
(just the business, not the property), with proceeds going to creditors based on
priority. Payments will be made based on priority, with First Secured Creditors
(anyone filing a lien against the Bowl's receivables) being paid first, then
unsecured priority claims (employee's wages), followed by second unsecured
creditors. As far as the city is concerned, we are not involved in the bankruptcy
. because the taxes and utilities are secured through the property. We would
receive our money through a potential Sheriff's sale or resale of the property.
All liquor licenses will become effective on May 1, 1998; however, the state
requires that all licenses be submitted to the Minnesota Department of Public
Safety no later than April 1 , 1998. No license will be issued until all necessary
documents have been received.

RECOMMENDATION
Staff recommends that the City Council approve the 1998/99 liquor license
applications as listed on the attached sheet, contingent upon receipt of all
necessary documentation.
