Adoption of Assessment Roll for TH 312/212 Improvements

REQUESTED ACTION (Simple Majority Vote Required)
Staff requests that the City Council consider a resolution adopting the Assessment
Roll for the TH 312/212 Improvements.
BACKGROUND
On February 14,2005, the City Council ordered the portion of the 2005 MUSA
Improvements to be built in conjunction with the TH 312/212 Project. These
improvements include the following:
1. Roadway improvements as follows:
. Turn lanes on Powers Boulevard at the East-West Collector Roadway.
. Turn lanes on Powers Boulevard for future roadways, south of the south TH
212 ramp.
. Turn lanes on Pioneer Trail at the future north cul-de-sac across from Bluff
Creek Drive.
. Turn lanes on Pioneer Trail at the South Connector Roadway.
. An additional through lane for the westbound TH 212 off ramp at Powers
Boulevard and the East-West Collector Roadway.
2. A traffic signal at the Powers Boulevard and East-West Collector Roadway
intersection.
3. A stormwater pond at the southeast quadrant of the Lyman Boulevard and
Powers Boulevard intersection.
4. Trunk watelmain improvements as follows:
. Along Pioneer Trial.
. Along Powers Boulevard.
5. Trunk sanitary sewer improvements as follows:
. Along Powers Boulevard.
. Along Pioneer Trail.

There are also some TH 212-related improvements that are proposed to be assessed to
benefiting property owners that are outside the 2005 MUSA Improvement area.
These include the following:
1. Roadway improvements as follows:
. Turn lanes on Lyman Boulevard at old TH 101.
· Signal improvements at TH 101 and Lake Susan Drive.
2. Sanitary sewer and water improvements on Lyman Boulevard at old TH 10 1.
All of these improvements will be constructed as part of the TH 312/212 design-build
project through a cooperative agreement with MnDOT. MnDOT has provided costs
for all of these improvements consistent with the feasibility study for the 2005
MUSA Improvements. A majority of these costs are proposed to be funded through
assessments to the benefiting property owners. Bonding for the assessments will be
from the State of Minnesota Loan Agreement the City approved on April 11, 2005.
On September 26,2005, the City Council called the assessment hearing for these
improvements. The Notice of Assessment Hearing was published in the October 6,
2005 edition of the Chanhassen Villager.
The assessment hearing was held on October 24,2005. Objections were filed for the
following properties:
. G & M Laurent Family LTD Partnership

. Arthur B. Johnson
PIN 250260610
. Jeffrey and Terry Fox
PIN 250230320
. Fox Properties, LLP
PIN 250230300
Revisions have been made to the final assessment roll based upon additional
information that has been provided for the Laurent and Johnson parcels. In both
cases, the assessment area has been changed based on new information from the
property owners because of additional property taken as a part of the TH 212/312
project.
The following is a summary of the assessment revisions for these two parcels:

Both properties have withdrawn their assessment objections. A revised final
assessment roll is attached including these changes. The difference between the

revised assessment amount and the original assessment amount, the City is proposed
to pay.
The Jeffrey and Terry Fox, and Fox Properties, LLP parcels are currently undergoing
concept planning for future development and the property owners are not ready to
accept the assessments. Staff is continuing to work with the property owners to
address their concerns.
Staff is requesting the Council adopt the assessment rolls in order for the process to
stay on schedule.
FINANCIAL SUMMARY
The total project cost for these improvements, including engineering and
administrative costs, is $2,632,421.16. The proposed funding allocation, considering
the revised assessment roll, is:

Dear Paul,
This letter is a follow-up to our discussion last week related to the proposed assessments
against the above referenced property ("Property"). My client has authorized me to
withdraw the objection to the proposed assessments based upon the following:
1. It is our understanding that you have reviewed the area of the assessment and
reduced the assessment area based upon the Minnesota Department of
Transportation taking that occurred this summer. The following table summarizes
the area reduction based upon your calculations.

2. The assessment will be deferred, and interest will not be charged against the
assessment, until the Municipal Urban Service Area ("MUS A") is extended to
include the Property. Currently, the City's comprehensive plan calls for MUSA
to be extended to the Property in 2010. To the extent that the extension of MUS A
is advanced or delayed due to a policy shift, there will be a corresponding
advance or delay of the assessment and accrual of interest.
Based upon the City's agreement to the above conditions, my client will withdraw their
appeal to the proposed assessments against the Property.

proposed assessments against the above referenced property ("Property"). My client has

1. It is our understanding that you have reviewed the area of the assessment and

to the creek. The right-of-way deduction is recalculated to be 2.79 acres and the
floodplain deduction is calculated to be .94 acres. The following table
summarizes the area reduction based upon the revised calculations.

3. The project will include installation of trunk sewer. This sewer will service Mr.
Johnson's property upon the extension of the MUSA area. Also, the trunk lines to
be installed are planned to service properties south of Pioneer Trail.
4. Mr. Johnson is particularly concerned about access to his property. Based upon
our discussions, and the condemnation documents, it is our understanding that a
plan for access to Mr. Johnson's Property is not defined; however, ingress to and
egress from Mr. Johnson's property to Pioneer Trail has not been taken. Further,
the only opportunity for such access to Mr. Johnson's Property is to Pioneer Trail.
Accordingly, unless other suitable access is provided, upon development, access
will be provided to Pioneer Trail.
Based upon the City's agreement to the above conditions, Mr. Johnson will withdraw his
appeal to the proposed assessments against the Property. Please call with questions and
thank you for your attention to this matter.

project. The City does not have adequate staff to perform all of the related engineering review and approval process that will be required as part of this project.
Rather than increase staff levels for a single project, consultant services will need to be used to ensure the City responsibilities and needs are met.

Description I
A two lane east/west collector road in the Bluff Creek Lowlands neighborhood area is required to access the new development. The road is proposed to be built
~etween Audubon Road and new Powers Boulevard and includes signals, turn lanes and a landscaped median. The roadway is proposed to be a two-lane section
with turn lanes. The widening ofthe roadway to make it function as a collector roadway is proposed to be funded by the city. In addition to the east/west collector
roadway improvements, the intersection at Audubon Road and Lyman Blvd is also necessary. These improvements include tumlanes and signal improvements.
The improvements are consistant with the future improvements to the Lyman Blvd corridor.

Justification I
AUAR document for the Bluff Creek Lowlands neighborhhod area (2005 MUSA) and the feasibility study for the area have identified these improvements. A large
portion of the improvement costs will be paid by development with the City paying for oversizing of the road section and the city's share of turn lane and signal costs.
