REQUESTED ACTION
Approve extending work hours for the TH 212 contractor.
BACKGROUND
The contractor for the TH 212 project (ZRC) is requesting the City Council extend
the working hours of the TH 212 project to allow a for a second shift for removal of
muck within the city limits at the new TH 101ITH 212interchange. It is estimated
that 480,000 cubic yards of muck material is located at this intersection and is as deep
as 60'. The muckwilLberemoved andreplacedwithgranularbackfill., The muck
will be truckedtoShakopee and land filled. Winteristhebesttime forremoval of
muck because the material is easier to handle. in cold weatherconditions.The
estimated quantitypfmaterial cannot be removed during,the winter months under the
current contract working hours.
City staff has reviewed this request and supports the request for a second work shift
for the removal of the muck at this time. It is anticipated that evening working hours
will be limited because of snow or precipitation. The State of Minnesota limits truck
hauling during snow events. Staff has discussed this issue with MnDOT and ZRC
and have requested ZRC notify the surrounding residents of the work hour change
and hold a public informational meeting. Most of the muck is located in a field well
away from any residential unit. The night working limits will be limited to 300'
away from any residential unit and should cause minimal disruption. The change in
the working hours is anticipated to help reduce the truck traffic during morning and
evening rush hour because shift changes are scheduled around these times. Also,
adding another shift will shorten the time for construction and minimized the length
of the construction work for the residents.
Staff will monitoftl1eworkand mayrecommendchangesto the workinghoursjf
problems with the current proposal arise. The City will still have the right to
discontinue the second shift operations if continuing problems arise.

Based on our Maintenance of Traffic Task Force Meeting November 23, 2005. Zumbro
River Constructors, liC (ZRC), is requesting a variance to the current Contract working
hours which IS Monday through Saturday from 7:00 a.m. to 7:00 p.m. for operations
relating to excavation of the future TH 101 Interchange in the City of Chanhassen. ZRC
is requesting to add a second shift during the nighttime to remove wetJ unsuitable
materials that currently surround the area of the Interchange. Due to the characteristics of
this material being removed it is advantageous that this material is removed during the
cold months of the year. The estimated quantity of material can not be removed during
the cold months of the year under the current Contractual working hours. It is ZRC's
intentions to utilize a second shift which will increase the likelihood that this material
will be completely removed during the winter months and in addition a shorter overall
time frame. The area is along the east side of existing TH 101 to approximately 3000 feet
to the east and from Lyman Blvd to a point approximately 500 feet south of 86th Street.
ZRC understands the sensitivity of the areas surrounding the work site. As such, ZRC is
committed to mitigating the potential impacts to the areas surrounding the work site.

ZRC is requesting a variance to the allowable Contract w'orking hours to allow a second
shift for the removal of unsuitable material at TH 101. This operation. if allowed, would
start approximately December 21 S\ 2005 and be completed by April 21 sl 2005. The
proposed second shift would set on a schedule starting on Monday night at 7:00 pm
through 6:00 am nightly through and including Friday night into Saturday moming. The

day shift would also start on Monday at 7:00 am and run until 4:30 pm Saturday
afternoon. No overnight operations will be planned on Saturday and Sunday nights.
ZRC has weighed many factors prior to requesting this vanonce. As a result of our
analysis it is our opinion that a second shift starting in mid December running through
April will afford the least amount of impact to surrounding residents, by the mere fact
that during this period most of the residents time is spent indoors the with the windows
closed, as is not the case during the other periods of the year thus minimizing potential
noise complaints. The timing of the second shift allows a break on the weekends to
preserve quality of life issues. The breaks between the day shift and night shift will
minimize the impacts to the traveling public during peak. flows on collector and arterial
streets. Lastly. the second shift allows the duration of the impact to be shortened, and
insures that a second season of this activity will not be endured.
Upon approval of this request, ZRC commits that a press release will be immediately
distributed and their will be weekly progress updates. ZRC will also send out a mass
mailer informing the adjacent residents of planned activities including a hot line number
to address individual concerns. ZRC will schedule prior to commencement and at least
once during the operation a neighborhood meeting to inform and again address any
individual concerns. For the purpose of this variance daytime operations will include
both import and export activities, whereas night time operations will be limited to solely
to export activities. In addition. work zones within 300 feet of reliidences will be limited
to daytime operations only. ZRC will list this operation as an agenda item to be reviewed
each week in the Maintenance of Traffic Task Force meeting, with an evaluation of the
previous weeks activities. and will continually strive to mitigate impacts to surrounding
neighborhoods and the resident of the City of Chanhassen.
ZRC does not take lightly this request, or the responsibilities that it bestows.
Zumbro River Constructors is committed to being a good neighbor and creating the least
amount of inconvenience to the areas surrounding the TH212 corridor. Your
