98-45DATE: MOTION BY: CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA May 13, 1998 RESOLUTION NO: 98-45 Berquist SECONDED BY: Mason RESOLUTION AUTHORIZING THE MAYOR AND CITY MANAGER TO ENTER INTO AND EXECUTE A LIMITED USE PERMIT WITH THE MINNESOTA DEPARTMENT OF TRANSPORTATION (MnDOT) FOR THE PURPOSE OF CONSTRUCTING, MAINTAINING, AND OPERATING TRAIL IMPROVEMENTS WITHIN MnDOT RIGHT-OF-WAY WHEREAS, the City of Chanhassen requests to work cooperatively with MnDOT to construct, maintain, and operate trail improvements along Highway 7, between Minnewashta Parkway and Washta Bay Road; and along Highway 101, between Highway 5 and Pioneer Trail; WHEREAS, the residents of the City of Chanhassen passed a park and trail referendum on June 14, 1997 for construction of trail improvements in the City of Chanhassen; WHEREAS, the City Council of the City of Chanhassen approved plans and specifications for the 1998 trail improvements project on March 9, 1998; WHEREAS, Carver County has reviewed and approved the plans for the trail project; WHEREAS, portions of the trail are located within the Minnesota Department of Transportation right-of-way; WHEREAS, the Minnesota Department of Transportation requires Limited Use Permits for trails within their rights-of-way; WHEREAS, the Limited Use Permit requires that the City agree to indemnify the Minnesota Department of Transportation from damage resulting from trail usage; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chanhassen, Minnesota as follows: That the Mayor and City Manager are hereby authorized and directed to enter into and execute a Limited Use Permit with the Minnesota Department of Transportation for the construction of trails along Highway 7 and Highway 101 in Chanhassen.
