EXECUTIVE SUMMARY
Request of Enterprise Rent-A-Car for Conditional Use Permit approval to rent
automobiles on property zoned Highway and Business District (BH). Since
this case appeared before the Planning Commission staffdiscovered that due to
the construction of the East Water Treatment Plant the suill,' ect property will be

Notice of this public hearing has been mailed to all property owners within 500 feet.
LEVEL OF CITY DISCRETION IN DECISION-MAKING: The City's discretion in approving
or denying a conditional use permit is limited to whether or not the proposed conditional use permit
meets the standards outlined in the Subdivision Regulations and Zoning Ordinance. If it meets these
standards, the City must approve the conditional use permit. This is a quasi-judicial decision.

PROPOSAL/SUMMARY
Enterprise Rent-A-Car is seeking a Conditional Use Permit to rent automobiles on property
zoned Highway and Business District (BH). The proposed site is located north of Highway 5
and east of Great Plains Boulevard at 227 West 79th Street. Access to the site is gained via West
79th Street. The applicant is proposing to occupy approximately 200 square feet of office space
in the northeasterly part Of the building which is occupied by Master Collision. Enterprise
anticipates the need for 1-2 employees on a daily basis.

BACKGROUND
On Febmary 14,2000, the City Council approved Zoning Ordinance Amendment #99-3 to
permit automobile rental facilities as a conditional use in the Highway and Business District, BH,
with conditions (reference Section 20-284 of City Code).
ANALYSIS
The subject property is located in the Highway and Business District (BH) with automotive
repair as its primary use. The site contains a principle stmcture approximately 19,000 square
feet in area with approximately W 62 parking stalls.
City Code Section 20-1124 states:
The minimum number of required on-site parking spacesfar thefallowing uses shall be:
b. Auto sales, trailer sales, marine and boat sales, implement sales, garden supply store,
building materials sale, auto repair, automobile rental facilities--One parkin!! space for
each 500 Sl/uare feet ofl100r area.
According to City Code, given the principle use, the subject property must contain a minimum of
38 parking stalls. With W 62 existing parking stalls the site has more than h.\'0 times exceeds
that which is required by ordinance. Section 20-284 of the City Code states: "The number of
rental vehicles shall not exceed 15". Three additional parking spaces shall be allocated for the
use of employees and customers for a maximum of 18 parking stalls designated for Enterprise
Rent-A-Car use. The parking lot is screened by a combination offence, retaining wall and
landscaping. The East Water Treatment Plant is currently being constmcted directly to the east
of the subject property and will provide an additional landscape buffer for the automobile
rental use.

The standards for car rental established with Zoning Ordinance Amendment #99-3, now
contained in Section 20-284 of the City Code, will be effective in regulating the requested use.
Furthermore, the request for operation of an automobile rental facility at the subject property will
compliment the existing use and will serve as a convenient amenity for the community.
Therefore, staff is recommending approval of Conditional Use Permit #05-41 to rent automobiles
on property zoned Highway and Business District (BH) located at 227 West 79th Street.
CONDITIONAL USE PERMIT FINDINGS
The Planning Commission shall recommend approval of a conditional use permit and the
Council shall issue such conditional use permits only if it finds that such use at the proposed
location:
1. Will not be detrimental to or damage the public health, safety, comfort, convenience or general
welfare of the neighborhood of the city.
Findilll:!: Approval of the conditional use permit will add to the comfort and convenience of the
residence of the city.

with the existing or intended character of the general vicinity and will not change the essential
character of that area.

On December 6,2005, the Chanhassen Planning Commission met at its regularly
scheduled meeting to consider the application of Enterprise Rent-A-Car for a Conditional
Use Permit to rent automobiles on property zoned Highway and Business District (BH) at
225 West 79th Street. The Planning Commission conducted a public hearing on the proposed
conditional use permit that was preceded by published and mailed notice. The Planning
Commission heard testimony from all interested persons wishing to speak and now makes
the following:
FINDINGS OF FACT
1. The property is currently zoned Highway and Business District (BH).
2. The property has a Land Use Designation of Commercial.
3. The legal description of the property is: Lot 3, Block 1, Gateway East.
4. The Planning Commission shall recommend a conditional use permit and the council
shall issue such conditional use permit only if it finds that such use at the proposed
location:
