Approval of Joint Powers Agreement for County Auditor
Ballot Board
Attached please find a Joint Powers Agreement from the Carver County
Auditor's Office concerning absentee voting procedures. As detailed in the
agreement, the Auditor's Office serves as the absentee voting polling place for
the entire county. They process all of the applications, validate the voted
ballots, and then deliver them to the appropriate precincts on Election Day for
counting. This is the same procedure that has been used for years, and there is
no charge for this service. This agreement is identical to the one the city signed
in 2004. The City Attorney has reviewed the agreement and finds it in order.
RECOMMENDA TION
Staff recommends approval of the attached Joint Powers Agreement for County
Auditor Counting Center. Approval requires a simple majority vote of those
City Council members present.

JOINT POWERS AGREEMENT
FOR COUNTY AUDITOR COUNTING CENTER
THIS JOINT POWERS AGREEMENT is made and entered into by and between the County
of Carver, a political subdivision of the State of Minnesota, and the City ofChanhassen located
within the County of Carver, to provide pursuant to Minnesota Statute S 206.85 a clear
understanding of their respective duties and financial responsibilities through the use of the
Carver County Auditor as a counting center for the 2006 elections, specifically in reference to
absentee ballots.
WHEREAS, the Carver County Auditor pursuant to Minnesota Statute S 203B.04, Subd. l, is
responsible for the preparation of absentee ballot application forms and also receives applications
for said absentee ballots from residents of Carver County; and
WHEREAS, it is the intention of the Carver County Auditor pursuant to Minnesota Statute S
203B.05 to retain responsibility of administering the absentee voting laws in Carver County and
which the City of Chanhassen is in agreement with; and
WHEREAS, the Carver County Board of Commissioners pursuant to Minnesota Statute S
203B.13 has authorized an absentee ballot board; and
WHEREAS, it is the desire of the City of Chanhassen to have the absentee ballot board, as
administered by the Carver County Auditor, issue all absentee ballots for the primary and general
elections in 2006 and to receive, examine, validate, accept or reject said absentee ballots and to
provide the voter(s) with a replacement ballot(s) for any spoiled ballot where legally authorized;
and
WHEREAS, the City of Chanhassen shall retain the right to open and count the absentee ballots
for the primary and general elections in 2006 after they have been delivered to the appropriate
local election judge on the day of the primary and general election by the Office of the County
Auditor and included in vote totals tabulated.
NOW, THEREFORE, in consideration ofthe mutual covenants and agreements contained
herein, it is hereby agreed by and between the County of Carver, through the Board of
Commissioners, the Carver County Auditor, and the City of Chanhassen, through its Council,
that:
l) The absentee ballot board as authorized by the Carver County Board of
Commissioners shall issue all absentee ballots for the primary and general elections in
2006 in place of any absentee ballots being issued by said City.
2) The absentee ballot board shall receive, examine, validate, accept or reject said
absentee ballots and provide the voter(s) with a replacement ballot for any spoiled ballot
where legally authorized.
3) The absentee ballot board, through and with the assistance of the Carver County
Auditor, shall deliver to said City on the day of the primary and general elections in 2006
the absentee ballots for purposes of having the local election judges open and count the
absentee ballots and include in vote totals tabulated.
4) The County Auditor shall be responsible for any costs associated with administering
the absentee ballots during the primary and general elections in 2006, including the
transport of the absentee ballots out to the City on the day of the primary and general
elections in 2006.
IN WITNESS WHEREOF, each of the parties has caused this Agreement to be executed by its
appropriate officers and with the consent and approval of its appropriate governing bodies.

Attached you will find the "Joint Powers Agreements" needed for us to again act as the
Absentee Ballot Board for the upcoming elections in 2006. We will serve in that capacity
for the Township Elections as well as the Primary and General Elections this fall. Please
obtain the appropriate signatures and return this agreement to us at your earliest
convenience. Upon return of all agreements, we will present this to our county board for
approval.
Townships conducting an election in March must deliver a sufficient amount of ballots to
our office to be issued to absentee voters no later than 8:00 a.m. Friday, February 10,
2006.
