The goal of which will be to determine the details of any proposed automatic slow-no wake proposed ordinance prior to a public hearing and Council consideration. BACKGROUND In 2005, Chanhassen experienced multiple rain events which caused abnormally high water conditions on area lakes. Lotus Lake was not an exception and enough concern was received from both riparian residents and internally from City staff to have the Chanhassen City Council pass an emergency slow-no wake resolution on September 6, 2005. The emergency slow-no wake resolution remained effective for a total of 15 days before the no wake ordinance was lifted. Shortly following the lifting of the no wake ordinance another heavy rain on October 4, 2005 caused the water to rise again above the Ordinary High Water Level (OHW). This event was not given a slow-no wake restriction due to a decrease in lake use with the cooler weather. Council instructed staff to draft an emergency slow no-wake ordinance that would administratively simplify the enactment of an automatic high water slow-no wake restriction. Staff has been collecting names of individuals who are interested in participating in a Lotus Lake slow-no wake task force and is seeking Council approval of the recommended task force selections. PURPOSE The roles of the task force have been identified by staff. At this time, the anticipated roles of the task force will be to: 1) Determine if an automatic ordinance for Lotus Lake is necessary. 2) Determine the details of an automatic slow-no wake ordinance (when it becomes active, for how long and when it is removed). 3) Forward a recommendation in the form of a proposed ordinance to Council. Lotus Lake Slow-No Wake Task Force February 13, 2005 Page 2 of 3 MEETINGS Three meetings will be held between February and March. Below is a general outline of the proposed meeting schedule: February 22: Introduction, Background on Lotus Lake, 2005 Lotus Lake conditions, Reasons for and against any proposed ordinance, Ordinances working in other communities, Identify difficulties with imposing an ordinance. March 8: Have discussion with Carver County Sheriff's Department about enforcement, Begin dialogue on drafting an ordinance. March 29: Staff will provide task force with proposed ordinance based on previous meetings. Task force makes any necessary changes. Build consensus and forward recommendation to Council. MEMBERSHIP The task force should be a relatively small group of people who are generally interested in Lotus Lake. An article appeared in the January 12, 2006 Chanhassen Villager indicating that interested persons were needed to participate in the Lotus Lake slow-no wake task force. Additionally, the Lotus Lake Homeowners Association President, Beth Bitney, forwarded an invitation to participate in the task force to everyone listed within the association, including all individuals who had contacted the mayor with interest in the slow-no wake issues. Staff indicated to all interested persons that if not selected, they will still be able to participate by attending the public hearing for any proposed ordinance. Staff also advised interested persons that we would make the meeting minutes and other important information available to them on the City web page. Staff will keep all interested persons and the Lotus Lake Homeowners association informed on the status of the slow-no wake issue. Staff was contacted by 16 interested Lotus Lake users to participate in the task force. Staff is requesting that Council approve membership as recommended or make changes necessary to form the Lotus Lake Slow No-Wake Task Force. LAKE SUSAN AND LAKE RILEY Lake Susan and Lake Riley will not be considered as part of the Lotus Lake Task Force. Each lake will be addressed individually so that lake specific concerns can clearly be identified during proposed ordinance development. Lake Susan task force is currently accepting interested individuals until February 10, 2006. Staff anticipates forwarding Lake Susan task force recommendations to Council on the February 27 consent agenda. The Riley-Purgatory-Bluff Creek Watershed District is in the process of designing an outlet improvement which may change the desire/need for a slow-no wake restriction on Lake Riley. Staff is currently waiting on the final design of an outlet improvement project on Lake Riley before any no wake ordinance is pursued. Any slow-no wake restriction on Lake Riley will need to be pursued in conjunction with The City of Eden Prairie. RECOMMENDA TION Staff recommends the City Council approve adopt the following motion: "The Chanhassen City Council appoints the following riparian and non-riparian property owners to the Lotus Lake Slow-No Wake Lake Task Force: 1) Bob Aayotte, Cascade Pass 2) Doug Bitney, Horseshoe Curve 3) Mary Borns, Frontier Trail 4) Steve Donen, Frontier Trail 5) Rick Eberhart, Minnetrista 6) Greg Fletcher, South Shore Drive 7) Dave Howes Santa Fe Trail 8) Shelly Strohmaier, Sandy Hook Rd" The goal of selected task force members shall be to determine the details of a proposed automatic slow-no wake ordinance and forward a recommendation on to City Council for a public hearing and consideration for adoption.
