97-94 CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA DATE: December 8, 1997 RESOLUTION NO: 97-94 MOTION BY: Berquist SECONDED BY: Mason A RESOLUTION APPROVING AN AMENDMENT TO THE VACATION OF THE UNUSED PORTION OF LYMAN BOULEVARD LYING ADJACENT TO OUTLOT A, OAKWOOD ESTATES WHEREAS, the City of Chanhassen adopted Resolution 97-05 on January 13, 1997; however, the legal description was erroneous. The amended legal description is as follows: All that part of Lyman Boulevard described as follows: Commencing at the southwest comer of Outlot A, Oakwood Estates, Carver County, Minnesota thence south 0 degrees 16 minutes 44 seconds east a distance of 7.0 feet. Thence south 89 degrees 57 minutes 32 seconds east a distance of 271.29 feet, thence north 0 degrees 18 minutes 08 seconds west a distance of 7 feet to the southeast comer of Outlot A, Oakwood Estates, thence north 89 degrees 57 minutes 32 seconds west a distance of 271.29 feet to the southwest comer of Outlot A, Oakwood Estates, Carver County, Minnesota. WHEREAS, a public hearing was held on said petition on January 13, 1997; and WHEREAS, said public hearing was preceded by two weeks published and posted notice as required by Section 412.851 of Minnesota Statutes; and WHEREAS, there is no public interest to be served by the continued public ownership of that portion of the described easements. NOW, THEREFORE, BE IT RESOLVED that any and all of the described easements are hereby vacated. Passed and adopted by the Chanhassen City Council this 8th day of December, 1997.
