Date: March 6, 2006 Re: National Pollutant Discharge Elimination System (NPDES) Phase II Municipal Separate Storm Sewer System (MS4) Permit 2005 Annual Report SUMMARY Staff is requesting the City Council: 1. Receive public comment on the City's NPDES Phase II MS4 Storm Water Pollution Prevention Program and annual report; and 2. Review the City's progress on meeting the requirements of its MS4 permi t. ACTION REQUIRED Hold a public hearing for the 2005 NPDES II annual report. BACKGROUND In June 2002, the Minnesota Pollution Control Agency issued a MS4 general permit for cities discharging storm water into waters of the state. Shortly after the permit was issued, the Minnesota Center for Environmental Advocacy filed an appeal for the permit indicating that it was inappropriate to issue a general permit in place of individual permits. The failure to address non-degradation and education as part of the permit were also reasons for the appeal. In May 2003, the Minnesota Court of Appeals ruled in favor of the MCEA. The MPCA has since revised their permit to address additional requirements. The revised permit resulted in three contested case hearing requests from the City of Eagan, the League of Minnesota Cities and Riley-Purgatory-Bluff Creek Watershed District. The City of Eagan and the League of Minnesota Cities have since withdrawn their contested case hearings. On March 1,2006, the MPCA denied the contested case hearing from RPBCWD. NPDES Phase II MS4 Permit Annual Report March 3, 2006 Page 2 of 3 As part of the revised permit, Chanhassen and 29 other communities are required to address the non-degradation of all state waters. This requirement has been added to determine if any new or expanded discharges beyond 1988 baseline conditions (MR 7050.0815) exist within the selected communities. As part of the non-degradation requirements, Chanhassen will be required to model their storm water discharges to determine if expanded discharges exist and what reasonable measures can be taken to return pollution loading of receiving waters to levels consistently achieved during 1988 baseline conditions. A new permit application is required to bring the City in compliance with the revised permit. Staff intends to use the revised permit application as an opportunity to modify the current Storm Water Pollution Prevention Program (SWPPP) where current measurable goals are inadequate or are no longer practical. This will ensure that the City of Chanhassen is well prepared to remain compliant with the permit and provide the additional necessary information during future annual reports. The current permit requires the City to submit an annual report for each year. The annual report documents progress Chanhassen has made toward measurable goals for each best management practice (BMP) listed in permit. Input has been solicited from City departments as well as some of the City's consultants on progress towards the City's measurable goals listed in the SWPPP. The yearly reporting assists Chanhassen by ensuring that annual goals set forth in the SWPPP are addressed. HIGHLIGHTS OF PROGRESS . Finished Surface Water Management Plan Update inventory of 6,000+ storm water structures, 400+ wetlands and 350 storm water ponds. . Included articles relating to storm water quality in each Chanhassen Connection since March 2003. . Continued tracking SWPPP progress with ASIST software purchased in 2003. . Chanhassen Residents made 5,067 visits to the Carver County Environmental Center (333 more than 2004 and 31 % of total Carver County resident visits) . Recycled 850 gallons of waste oil from municipal operations (450 gallons less than last year) . Approximately 595 tons of debris removed from streets as a result of street sweeping activities (2004 = 1,732 tons of debris removed). . Located and corrected 3 illicit discharges within Chanhassen (Commerce Drive, Market Square, West 78th & Great Plains Boulevard). . Performed maintenance activities in storm water infrastructure that experienced problems during late summer rain events. Ensure Erosion and Sediment Control meets MPCA minimums. . Critical Construction Site BMPs to be required with permits. . Inspections, Reports and Maintenance activities needed to keep on track with MS4 permit. . Ordinance Review and update if needed. Staff plans to submit the final annual report to council for approval on a future Council consent agenda. Staff is currently waiting for MPCA to provide the 2005 annual report format. Once the report is complete it will be submitted to Council for approval. RECOMMENDA TION Staff recommends the City Council hold a public hearing to consider public input on current City SWPPP. Staff will incorporate all comments received on the SWPPP in the 2005 annual report to be approved on a future Council consent agenda. Surface Water Management Plan Update. o Consultant has finished collecting data (x-y-z location, size, condition) on over 6,000 storm water structure during the SWMP update inventory. o Discovered and addressed 2 illicit discharges during structure inspection and inventory. (1 additional illicit discharge was discovered through other means in 2005) o Finished MN-RAM assessments of Chanhassen's 400+ wetlands. o Located and inventoried over 350 storm water ponds. . Through the continued contract with the City, Carver Soil and Water Conservation District reviewed erosion and sediment control plans for 22 development sites and performed 100 documented construction site inspections within these sites during the 2005 construction season. Generally 2005 had some large construction sites that had more problems with sediment and erosion control, especially during the large rain events in September and October. . Included articles related to storm water quality in each Chanhassen Connection in all 2005 issues. Articles included: o "Top 5 Shoreland Issues" o "Street Sweeping" o "Clean Water Hotline" o "Chanhassen Lake Users" o "2004 Lake Monitoring Results" o "Lawn Smart" o "Water Conservation" o "2005 Lawn Fertilizer Restrictions" o "Lake Susan Update" o "Managing Yard Waste" . Continued the input of SWPPP activities into ASIST database (purchased 2003) for NPDES II MS4 permit progress tracking. . Inspected 1 newly installed septic systems and sent out approximately 100 reminders to property owners for the septic maintenance program. . Inspection of 58 of 58 sump pollution control devices. Maintenance planned once spring thaw is complete. (Currently frozen) . Recycled 850 gallons of waste oil from municipal operations (450 gallons less than 2004). . 20 gallons of vehicle washing soap were used (5 gallons more than 2005). . Chanhassen residents made 5,067 visits to Carver County Environmental Center (333 more visits than 2004 and 31 % of total visits by Carver County residents). . 327 Christmas Trees recycled by Boy Scouts troops (approximately 270 more trees picked up than in 2004). . During spring and summer street sweeping activities, the 100+ miles of Chanhassen streets were swept yielding approximately 595 tons of sand/debris from streets. Sweeping activities have been logged and recorded by streets department personnel. (Down from 1,732 tons in 2004, reduction of 1,137 tons) o 2005 sweeping activities generally were prioritized around Chanhassen water resources first to minimize impacts to the resources. . 27 tons of phosphorous-free fertilizer was used in municipal parks in 2005 (1 Y2 tons less than 2004). 2006 activities planned include soil sampling to assist in determination of fertilizer needs. .
