96-63 CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA DATE: July 22~ 1996 RESOLUTION NO: 96-63 MOTION BY: Dockendorf SECONDED BY: Berquist A RESOLUTION REQUESTING TRIAX TO PROVIDE CUSTOMER SERVICE INFORMATION WHEREAS, the City of Chanhassen, Minnesota ("City") is charged with the obligation to enforce the Cable Television Franchise by and between the City and Triax Midwest Associates, L.P. ("Triax"); and WHEREAS, the City has received complaints from residents within the City who are also cable television subscribers regarding the service provided by Triax; and WHEREAS, the Federal Communications Commission ("FCC") has adopted customer service obligations outlined in 47 C.F.R. Section 76.309; and WHEREAS, franchising authorities across the country are charged with enforcement of the FCC's customer service obligation should they so desire; and WHEREAS, in order to require Triax to comply with the FCC;s customer service obligations, the FCC requires that the City provide Triax 90 days advance written notice of the City's intent to enforce the FCC's customer service obligations; and WHEREAS, based on the complaints and other information reviewed by the City, the City has determined a need to enforce the FCC's customer service obligations. NOW, THEREFORE, BE IT RESOLVED, that the City of Chanhassen, Minnesota hereby resolves as follows: The City shall enforce the FCC's customer service obligations found at 47 C.F.R. Section 76.209. , The City staff is hereby directed to forward to Triax a written notification letter providing Triax with 90 days advance written notice of the City's intention to enforce the FCC's customer service obligations. . The City shall review Triax's compliance with the FCC's customer service obligations so that the FCC's customer service obligations can be correctly implemented and enforced.
