A RESOLUTION VACA TING A PORTION OF WEST 78TH STREET,
ADJACENT TO LOT 1, BLOCK 3, BURDICK PARK ADDITION
WHEREAS, the.City of Chanhassen has received a petition from Mr. B. C.
Burdick, property owner of Lot 1, Block 3, Burdick Park Addition, to vacate the unused
portion of West 78th Street as described on Exhibit A and Exhibit B; and
WHEREAS, a public headng was held on said petition on January 9, 1995; and
WHEREAS, said public headng was preceded by two weeks published and
posted notice as required by Section 412.851 of Minnesota Statutes; and
WHEREAS, there is no public interest to be served by the continued public
ownership of that portion of the described easements.
NOW, THEREFORE, BE IT RESOLVED that any and all of the described
easements are hereby vacated.
Passed and adopted by the Chanhassen City Council this 9th day of January,
1995.

EXHIBIT "A" ADDITION, being a part of the Northwest Quarter of the Northwest Quarter of
Section 13, Township 116, Range 23, Carver County, Minnesota, described as
fo l lows: :
Commencing at the northwest corner of the Northwest Quarter of
said Sectlon 13; thence South 02 degrees 03 minutes 45.' seconds
East, on an assumed bearing, along the west line of the North-
west Quarter of the Northwest Quarter, a distan.c.e of 50.06
feet, to the point of beginning of the land to be described~
thence continue South 02 degrees 03 minutes 45 seconds East
along the west line of th.e Northwest Quarter of the North-
west Quarter, a distance of 21.49 feet to the northwest corner
of Lot 1, Block 3, BUROICk PARK ADDITION; thence South 87
degrees 23 minutes 29 seconds East, along the north l%ne of
said Lot 1, a distance of 282.71 feet; thence southeasterly,
a distance of 32.68 feet along a tangential curve concave to
the southwest having a radius of 20.00 feet and a central
angle of 93 degrees 36 minutes 32 seconds; thence north-
easterly, a distance of 4.39 feet, along a non-tangential
curve concave to the northwest having a radius of 183.16 feet
and a central angle of 01 degree 22 minutes 24 seconds, the
chord of said curve bears North 05 degrees 31 minutes 54
seconds East; thence North 04 degrees 50 minutes 43 seconds
East, tangent to the last described curve, a distance of
25.09 feet; thence northerly and northwesterly, a distance of
32.72 feet, along a tangential curve concave to the southwest
having a radius of 20.00 feet and a central angle of 93
degrees 45 minutes 11 seconds; thence North 88 degrees 54
minutes 28 seconds Uest, tangent to the last described curve,
a distance of 285.20 feet to the point of beginning.
Subject to an easement for drainage, utility and landscape purposes over,
£XHIBIT "B" under and across that part of the above described property; lying northerly,
easterly, northerly and easterly of the following described line~
Commencing at the northwest corner of the Northwest Quarter of
said Section 13; thence South 02 degrees 03 minutes 45 seconds
East , on an assumed bearing, along the west line of the North-
west Quarter of the Northwest Quarter, a distance of 63.00 feet,
to the point of beginning of the line to be described; thence
North 89 degrees 59 minutes 58 seconds East, a distance of 258.00
feet; thence South 00 degrees 00 minutes 02 seconds East, a
distance of 10.00 feet; thence North 89 degrees 59 minutes 58
seconds East, a distance of 30.00 feet; thence South 00 degrees
00 minutes 02 seconds East, a distance of 85.77 feet more or less
to its intersection with the westerly right-of-way line of Mandan
Drive, and said line there terminating.
