EXECUTIVE SUMMARY
The applicant is proposing the excavation and maintenance of five (5) storm water
ponds for the purpose of improving water quality in the Rice Marsh Lake and Lake
Riley subwatersheds. The wetland alteration permit is necessary because the
applicant proposes the excavation and fill of existing wetlands.
ACTION REQUIRED
City Council approval requires a majority of City Council present.
PLANNING COMMISSION SUMMARY
The Planning Commission held a public hearing on March 1,2006 to review the
proposed wetland alterations. Several residents with property near the wetlands
adjacent to Rice Marsh Lake appeared to obtain additional information about the
project. The property owner at 8131 Dakota Lane expressed concern that the project
proposed excavation on his property, but that he did not receive prior notification
from the watershed district that the project would impact his property. The plat for
the Hidden Valley subdivision was reviewed by staff during the meeting and it was
found that a drainage and utility easement covers the rear portion of his yard.
Because a drainage and utility easement was dedicated with the plat, the project does
not propose impacts to the property for which additional easements or land
acquisition would be necessary. ill response to the lack of communication with
affected residents, the Planning Commission recommended adding a condition to the
conditions of approval that would require the applicant to obtain all appropriate
easements and permissions from affected property owners.
The Planning Commission voted 5 to 0 to recommend approval of the proposed
project subject to the conditions of the staff report plus condition 14, which reads:
"All appropriate easements and permissions must be obtained prior to commencing
work."

RECOMMENDA TION
Staff and the Planning Commission recommend adoption of the following motion:
"The Chanhassen City Council approves Wetland Alteration Permit #06-06 subject to the
following conditions:
1. Wetland replacement shall occur in a manner consistent with the Minnesota Wetland
Conservation Act (MR 8420) at a ratio of 2: 1.
2. The applicant shall notify nearby property owners of the proposed project at least two
weeks prior to beginning work. The notice shall, at a minimum, provide a summary
of the purpose of the project, the timeline for project completion, and contact
information for someone with RPBCWD who is able to provide more information
about the project. It is recommended that the applicant work with the City to identify
property owners receiving notice and to provide a link to a project website from the
City's website.
3. The applicant shall restore any disturbed areas and restore or replace any damage to
infrastructure on City property.
4. All exposed soils from temporary haul routes, exposed slopes above the normal water
level (NWL) and adjacent areas to the project shall be temporarily stabilized and
seeded within the 7, 14,21 day time frames depending upon slopes. Any
concentrated flow areas shall receive temporary protection within 24 hours of
connection to surface waters.
5. Erosion control blanket shall be used in concentrated flow areas and for slopes of 3:1.
All remaining areas shall be mulched and seeded to control erosion.
6. The applicant shall provide information regarding the disposal of the
excavated/excess material, as well as the stabilization and/or containment of the
material.
7. Temporary energy dissipation shall be installed at existing flared end sections to the
bottom of the basin at the end of each day to protect against erosion. This could
include temporary plastic sheeting or geotextile fabric secured to the soil.
8. All existing outlets/proposed outlet structures shall be temporary riser structures until
the ponds and adjacent areas are stable.
9. Street sweeping and scraping shall be completed daily (more often, if necessary)
during acti ve haul times. A dedicated site pickup sweeper may be needed.
10. The applicant shall provide details as to how dewatering will be accomplished for the
basins in this project.

11. The applicant shall have a flocculent available on the project to facilitate sediment
removal from sediment-laden water.
12. Energy dissipation shall be provided at all discharge points from dewatering pumps.
Waters receiving dewatering discharges should be large enough to handle the volume
and velocity of the water.
13. The applicant shall apply for and obtain permits from the appropriate regulatory
agencies (e.g., Minnesota Pollution Control Agency (NPDES Phase IT Construction
Permit), Minnesota Department of Natural Resources (for dewatering; impacts below
the OHW of Rice Marsh Lake), Minnesota Department of Transportation) and comply
with their conditions of approval.
14. All appropriate easements and permissions must be obtained prior to commencing
work."

IN RE: The application of the Riley~Purgatory-Bluff Creek Watershed District
Planning Case No. 06-06
On March 21, 2006, the Chanhassen Planning Commission met at its regularly scheduled
meeting to consider the application of the Riley-Purgatory-Bluff Creek Watershed District for a
wetland alteration permit for the excavation and maintenance of five (5) storm water ponds for
the purpose of improving water quality in the Rice Marsh Lake and Lake Riley watersheds.
The Planning Commission conducted a public hearing on the proposed development which was
preceded by published and mailed notice. The Planning Commission heard testimony from all
interested persons wishing to speak. The Planning Commission has made recommendations to
the City Council. The Chanhassen City Council now makes the following:
FINDINGS OF FACT
1) The properties are currently zoned RSF (Residential Single Family), BH (Highway and
Business Services) and BN (Neighborhood Business).
2) The properties are guided by the Land Use Plan for commercial and parks/open space.
3) The properties are located in Chanhassen, Minnesota (Sections 12 and 13, Township 116
North, Range 23 West), Carver and Hennepin Counties:
(a) One (1) storm water pond in the southeast quarter of the southeast quarter of Section 12;
(b) One (1) storm water pond in the northwest quarter of the northwest quarter of Section
13;
(c) One (1) storm water pond in the southwest quarter of Section 13; and
(d) Two (2) storm water ponds in the southeast quarter of Section 13.
4) One natural wetland, one aglurban wetland and one utilized wetland are located on the
subject properties.
5) The total amount of wetland impact proposed is 142,950 square feet (3.28 acres).
6) The replacement of wetland at a 2: 1 ratio will be accomplished through the withdrawal of
wetland credits from the Minnesota State Wetland Bank and storm water ponding for
public value credits.
7) Section 20-404 of the City Code stipulates that there should be no net loss of wetlands.
Finding: The project proposes wetland replacement through the purchase of wetland
credits from the state wetland bank therefore there will be no net loss of wetlands.
8) Section 20-407 of the City Code requires an applicant for a wetland alteration permit must
demonstrate compliance with the sequencing requirements set forth therein.
Finding: The proposed project is compliant with the sequencing requirements.
9) Section 20-408 of the City Code requires a wetland alteration permit for excavation within
wetlands.
Finding: Upon receipt of a wetland alteration permit, the project will be in compliance
with this requirement.
10) The planning report for Planning Case #06-06, dated April 10, 2006, prepared by Lori
Haak is incorporated herein.
DECISION
The City Council approves the Wetland Alteration Permit for Planning Case #06-06 for the
alteration of wetlands for the excavation and maintenance of five (5) storm water ponds.

BACKGROUND
On January 21, 2003, the City of Chanhassen submitted a petition to the Riley-Purgatory-Bluff
Creek Watershed District requesting the watershed district construct the storm water ponds and
conduct the alum treatments recommended within the Lake Riley and Rice Marsh Lake Use
Attainability Analyses to improve the quality of storm water runoff that ultimately enters Lake
Riley. The City of Eden Prairie submitted a similar petition concurrently. Several of the ponds
will be constructed in conjunction with Trunk Highway 212 or future development. The
remaining ponds are proposed to be part of this project, or have been eliminated due to the
redesign of downstream facilities.
In May 2005, a wetland delineation was completed by Barr Engineering. On June 23,2005, City
staff verified the delineated wetland boundaries. On July 28, 2005, City staff approved the
wetland delineation for the areas where work will occur in conjunction with the proposed
project.
Two of the proposed ponds are within wetlands adjacent to Rice Marsh Lake. The Ordinary
High Water Level (OHW) of Rice Marsh Lake is 877.0. Any wetland impacts occurring below
the OHW require permits from the Minnesota Department of Natural Resources (DNR).
WETLANDS
Existing Wetlands
Five wetland basins are proposed to be impacted within the project area.
Basin RM-1.1 is located just south and west of Rice Marsh Lake Park. It is a Type 4/3/1 wetland
adjacent to Rice Marsh Lake (DNR Protected Water 10-1P). The basin is dominated by reed
canary grass, sandbar willow, cattail, black willow and box elder.
Basin RM-2.1 is located adjacent to the railroad tracks, just north of Lotus Lawn and Garden. It
is a Type 4 wetland dominated by open water and fowl bluegrass.
Basin RM-2.5 is located just west of the ChanhassenlEden Prairie border along a small ravine. It
is a Type 4/6 wetland dominated by reed canary grass, box elder, red-osier dogwood, buckthorn,
aspen and black willow.
Basin RM-2.6 is located just south of Basin RM-2.5 adjacent to Rice Marsh Lake (DNR
Protected Water 10-lP). It is a Type 412/3/6 wetland dominated by reed canary grass, Canada
watermeal, sandbar willow and black willow.
Basin RM-6.5 is located in the northwest quarter of Market Boulevard and Trunk Highway 101.
It is a Type 4/312/6 wetland dominated by cattail, pondweed, reed canary grass, willow, red-osier
dogwood and cottonwood.

Wetland Impacts
The proposed project proposes fill and excavation within all five wetland basins within the
project area. Proposed wetland impacts are as follows:

The total amount of impact proposed by the project is 142,950 square feet (3.28 acres).
Wetland Mitigation
Wetland replacement is required at a 2 to 1 ratio (6.56 acres). The replacement of wetland will
be accomplished through the withdrawal of 5.95 acres of New Wetland Credit (NWC) v/etIand
credits from the Minnesota State Wetland Bank and the creation of 0.84 acres of Public Value
Credit (PVC) through the construction of storm water ponds. The current proposal
exceeds the required mitigation by 0.23 acres.
ANALYSIS
Initially, additional ponding sites were considered for this project. However, as the RPBCWD
analyzed the sites, several sites were found to be unnecessary if existing downstream ponds were
enlarged. By taking a more comprehensive regional ponding approach, the smaller ponds were
eliminated. This reduced the cost of the project due to easement acquisition and site access
difficulties. In addition, it will likely increase the effectiveness of the ponding while increasing
the efficiency of future pond maintenance.
The RPBCWD has not yet notified property owners near the proposed pond improvement
projects of the work that will be done. The applicant must notify nearby property owners of the
proposed project at least two weeks prior to beginning work. The notice should, at a minimum,
provide a summary of the purpose of the project, the timeline for project completion, and contact
information for someone with RPBCWD who is able to provide more information about the
project. It is recommended that the applicant work with the City to identify property owners

The proposed project is dependent on access onto and across City property. The applicant
should restore any disturbed areas and restore or replace any damage to infrastructure.

Sediment Control
All existing outlets/proposed outlet structures should be temporary riser structures until the
ponds and adjacent areas are stable. During excavation and work in the spring, rains may cause
re-suspension of solids within the ponds. A temporary riser will ensure minimal sediment
discharge will be possible.
Street sweeping and scraping will be needed daily (potentially more often) during active haul
times. A dedicated site pickup sweeper may be needed.
Runoff ControIlDewatering
The applicant should provide details as to how dewatering will be accomplished for the basins in
this project. A temporary standpipe and rock cone could be used to draw down the ponds, or a
floating skimmer pump could be used. Initially the drawdown of the ponds will likely not be an
issue. If it rains and re-suspension of sediment occurs the water will have to sit in the pond until
it is clear enough to discharge to receiving waters. A standpipe and rock cone with the pump
drawing water from the pipe would help minimize the lag time after a storm to begin drawing the
ponds down again.
The applicant should have a flocculent available on the project to facilitate sediment removal

receiving dewatering discharges should be large enough to handle the volume and velocity of the
water.
Other Agencies

FINANCING
The cost of the improvements will be divided between the RPBCWD and the City. The City will
be responsible for 75% of the costs for easement acquisition. RPBCWD will pay all other costs.
The engineer's estimate for the construction of the 5 ponds is approximately $1,100,000.
One easement will be necessary to complete this project. All other improvements are on City
property. The total cost for easement acquisition is $15,000; the City's portion of the costs is
75% ofthat, or approximately $11,250. The City's portion of the improvement costs will be
paid through the Surface Water Management Fund's Capital hnprovement Program Property
Acquisition item (SWMP-014). In 2006, $200,000 was allocated for the acquisition of property
in accordance with the City's Comprehensive and Surface Water Management Plans.
RECOMMENDATION
Staff recommends the City Council Planning Commission adopt the following motion:
''The Planning Co:t11IllissioR reconutlends the Chanhassen City Council approves Wetland
Alteration Permit 06-06 subject to the following conditions:
1. Wetland replacement shall occur in a manner consistent with the Minnesota Wetland
Conservation Act (MR 8420) at a ratio of 2: 1.
2. The applicant shall notify nearby property owners of the proposed project at least two weeks
prior to beginning work. The notice shall, at a minimum, provide a summary of the purpose
of the project, the timeline for project completion, and contact information for someone with
RPBCWD who is able to provide more information about the project. It is recommended
that the applicant work with the City to identify property owners receiving notice and to
provide a link to a project website from the City's website.
3. The applicant shall restore any disturbed areas and restore or replace any damage to
infrastructure on City property.
4. All exposed soils from temporary haul routes, exposed slopes above the normal water level
(NWL) and adjacent areas to the project shall be temporarily stabilized and seeded within the
7, 14,21 day time frames depending upon slopes. Any concentrated flow areas shall receive
temporary protection within 24 hours of connection to surface waters.
5. Erosion control blanket shall be used in concentrated flow areas and for slopes of 3: 1. All
remaining areas shall be mulched and seeded to control erosion.
6. The applicant shall provide information regarding the fate of the excavated/excess material,
as well as the stabilization and/or containment of the material.

7. Temporary energy dissipation shall be installed at existing flared end sections to the bottom
of the basin at the end of each day to protect against erosion. This could include temporary
plastic sheeting or geotextile fabric secured to the soil.
8. All existing outlets/proposed outlet structures shall be temporary riser structures until the
ponds and adjacent areas are stable.
9. Street sweeping and scraping shall be needed daily (potentially more often) during active
haul times. A dedicated site pickup sweeper may be needed.
10. The applicant shall provide details as to how dewatering will be accomplished for the basins
in this project.
11. The applicant shall have a flocculent available on the project to facilitate sediment removal
from sediment-laden water.
12. Energy dissipation shall be provided at all discharge points from dewatering pumps. Waters
receiving dewatering discharges should be large enough to handle the volume and velocity of
the water.
13. The applicant shall apply for and obtain permits from the appropriate regulatory agencies (e.g.,
Minnesota Pollution Control Agency (NPDES Phase II Construction Permit), Minnesota
Department of Natural Resources (for dewatering; impacts below the OHW of Rice Marsh
Lake), Minnesota Department of Transportation) and comply with their conditions of approval.
14. AU appropriate easements and permissions must be obtained prior to commencing work."

Dear Mr. Obermeyer:
This letter serves as BWSR's official determination of wetland impacts related to the Lake Susan and Rice
Marsh Lake Water Quality Improvement Projects. According to draft project plans presented by Mark
Wilson and Bob Obermeyer of Barr Engineering, the District is proposing to treat stonnwater runoff by
increasing dead storage via berms and excavation within wetlands. The Minnesota Wetland Conservation
Act (WCA) Rules Chapter 8420.0105 "Scope" section, states ".,.This chapter regulates excavation...in all
wetland types if excavation includes filling or draining or results in conversion to nonwetland."
In addition, according to the WCA definition of "projectH, "_ _ -A project may not be split into components or
phases for the sole purpose of gaining additional exemptions"
Therefore this project as proposed on the attached sheets would require sequencing and full 2:1 mitigation
for all combined fill and excavation activities within the wetland boundary above the Ordinary High Water
Mark (or for combined activities in their entirety ifDNR categorically waives jurisdiction to WCA). Please

I've gone over the plans in detail with Mark Wilson, BARR, and have the following
comments:
Excavation in RM-2.6 has been determined to be above the OHW except for the outfall
which can be permitted by RPBWD under General Permit 97-6113.
Site RM-1.1 will include excavation, grading, and installation of a siltation sock
system below the OHW so this will require a DNR Waters permit. I've talked to Larry Zdon
(PCA, 651-297-8219); he says that the siltation sock system might be considered an
Alternative Method by PCA--he couldn't make that determination, though, unless he sees
details of the plans. Access to this site will be necessary for monitoring and
maintenance.
