S;37.136.oo CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA ADDENDUM "A" TO SPRINGFIELD 1ST ADDITION DEVELOPMENT CONTRACT/PUD AGREEMENT SPECIAL PROVISIONS AGREEMENTS dated October 13,1997, by and between the CITY OF CHANHASSEN, a Minnesota municipal corporation ("City"), and LUNDGREN BROS. CONSTRUCTION, INC., a Minnesota corporation (the "Developer"). 1. BACKGROUND. The parties have previously entered into a development contract/PUD agreement for Springfield 1st Addition dated May 12, 1997 (the "Development Contract"). The Development Contract was recorded on June 3, 1997 as Carver County Abstract Document No. 211503 and on June 3, 1997 as Carver County Torrens Document No. T96915. The developer is now requesting to expand the grading limits to include portions of Springfield 2nd Addition under the Development Contract for Springfield 1st Addition. 2. EXTENSION OF DEVELOPMENT CONTRACT. The Development Contract shall remain in full force and effect with the modifications listed in the special conditions below. 3. SPECIAL CONDITIONS. In addition to the terms and conditions outlined in the development contract/PUD agreement, the following amendments shall apply: a) Plan "B" Grading, Drainage and Erosion Control Plans dated April 21, 1997, revised May 20, 1997, shall also include the Grading, Drainage and Erosion Control plans for Springfield 2nd Addition dated August 28, 1997, revised September 22, 1997, prepared by Pioneer Engineering. b) Access to the site shall be limited to Lyman Boulevard, Springfield Drive and/or Sunnyvale Drive. Access to the site from Kiowa Trail shall be prohibited. c) The Developer shall keep the existing gravel turnaround at the end of Kiowa Trail in place unless some other turnaround acceptable to the City is provided. d) The grading plans shall be revised to provide overland sheet drainage to Lake Riley Boulevard for those lots adjacent to Lake Riley Boulevard unless a storm sewer system is extended with Springfield 2nd Addition improvements to convey backyard runoff to a regional stormwater pond. e) The grading plans shall be revised to reflect the future 8- foot wide trail to be constructed from Lake Riley Boulevard to the extension of Sunnyvale Drive just north of cul-de-sac "A". The maximum slope on the trail shall be 6%. f) The temporary and permanent stormwater ponds and associated storm sewer pipe shall be constructed prior to grading the rest of the site. g) 4. RECORDING. The Development Contract and this Addendum "A" shall be recorded against all lots and blocks and outlots in Springfield 1st Addition. Construction, Inc. - Project No. 97-20 Dear Resident: The developer of Springfield Addition (Lundgren Bros. Construction, Inc.) is requesting the C:ry to expand the grading construction limits previously approved for Phase I construction. Tne construction work will be limited to the area shown on the attached map. Construction hours ?.Ie 7:00 a.m. to 6:00 p.m. Monday through Friday and 9:00 a.m. to 5:00 p.m. on Saturday with no work on Sundays or legal holidays. The work is expected to commence around October 14, 1997 subject to City Council approval on October 13, 1997 and last approximately to November IS, 1997. The purpose of grading at tilis time of year is to resolve an ongoing drainage problem in the southerly portion of the project near Sunnyslope Addition as well as prepare the site for n~ ,~ spring's street and utility construction.
