Attachments B and C give detailed summaries of the total indirect and
construction costs respectively.
The final construction cost for the project is approximately $40,000.00 less than
anticipated at the time of the final Engineer's Estimate. The final indirect costs
for the project are approximately $300,000.00 greater than anticipated based upon
the typical 30% estimate that the City uses for public improvement projects. The
resulting total project cost (construction cost plus indirect cost) is, therefore,
approximately $250,000.00 greater than expected.
The greater indirect costs can be attributed to the following reasons:
1. Multiple Bid Packages
It appears that the indirect costs include administrative and engineering
costs for two separate bid packages related to the roadway reconstruction
project. These bid packages are as follows:
Surcharge Improvements
The first bid package included work to place a surcharge embankment
along the east side of CSAH 17 south of Lake Drive. This work was
necessary to consolidate soils prior to the planned roadway construction.
Wetland MitilZation and Pathwav Improvements
The second bid package included work to construct a wetland mitigation
area to replace wetlands disturbed as a part of the final roadway
construction. This bid package also included the construction of a trail
along the wetland mitigation area as requested by City staff.
2. Legal Fees
The project included a substantial amount of permanent and temporary
easement acquisition to construct the proposed improvements. The City
incurred additional legal and engineering services as necessary to acquire
the easements.
3. CSAH 17 North Improvements
The reconstruction of the northern portion of this segment of CSAH 17
was originally proposed to be performed in 1991-1992. The northern
portion included the segment of CSAH 17 from T.H. 5 to just south of
Lake Drive. The plans and specifications for this segment of the roadway
were completed; however, the project was not approved by the City
Council at that time due to funding concerns. It appears that the costs to
complete this set of plans and specifications are included in the indirect
costs.

The final assessment roll (Attachment A) identifies the amounts proposed to be
assessed to the individual property owners along CSAH 17 considering the fmal
total project costs. It should be noted that the final assessment amounts are within
one percent of the amounts estimated at the time of the feasibility study
amendment. A copy of the feasibility study amendment preliminary assessment
roll is included as Attachment E for your information.
The following is a summary of the methodology used to determine the final
assessment amounts.
Indirect Costs
The total indirect cost was divided by the total construction cost to calculate the
percentage of indirect to construction cost. This percentage was added to the
itemized construction costs for the Roadway, Storm Drainage, and Water Main
improvements to calculate the total project cost of each item.
Total Indirect Cost = $1.350.000.00 x 100 =39.0%
Total Construction Cost $3,458,244.00
Storm Sewer
The assessable area for storm sewer was assumed to be approximately 30% of the
total project drainage area. The costs for additional storm sewer improvements to
the Instant Web property were subtracted from the total storm sewer construction
costs and added to the Instant Web assessment. As per the feasibility study
amendment dated, November 30, 1995, only 1/2 of the storm sewer costs are to be
assessed. Storm sewer assessments were calculated as follows:

Roadwav
Roadway assessment costs were calculated by comparing the roadway segment

assessable front footage to calculate the roadway assessment per front foot.

Assessment hearing notices have been sent out to individual property owners
notifying them of the assessment hearing on September 22, 1997, and of their
individual assessment amounts. Individual assessment amounts are itemized in
Attachment A.
In addition to the individual property owner assessments detailed above, the
project was originally proposed to include trunk sanitary sewer and water main
charges to properties along the south end of CSAH 17. As discussed, the City has
elected to not include these assessments as a part of the assessment hearing with

the understanding that the property owners will be billed connection charges if
and when they connect to the trunk sanitary sewer and water main facilities.

CSAH 17 (POWERS BOULEVARD) IMPROVEMENTS
PROJECT NO. 93.29
Notice is hereby given that the Chanhassen City Council will meet at 6:30 PM on Monday,
September 22, 1997 t at the City Hall Council Chambers to pass upon the proposed assessments
for the CSAH 17 (Powers Boulevard) Improvements Project No. 93-29. Abutting properties and
those properties deriving benefits from this project are proposed to be assessed. Specifically,
properties in Sections 19,27 and 56 are proposed to be assessed which include:

The proposed assessment is on file for public inspection at the office of the City Engineer.. The
total amount to be ultimately assessed is $1,305.968.93. Written and oral objections win be
considered at the meeting, but the Council may consider any objections to the amount of the
proposed individual assessment and adjourn the meeting upon such further notice to the affected
property owners as it deems advisable.
An owner may appeal an assessment to the District Court pursuant to Minnesota Statute 429.081
by serving notice of the appeal upon the Mayor or City Clerk of the City of Chanhassen within
30 days after the adoption of the assessment and filing such notice with the District Court within
lO days after service upon the Mayor or City Clerk. No appeal may be taken as to the amount of
any assessment adopted unless a WRITTEN NOTICE signed by the affected property owner is
filed with the City Clerk prior to the assessment hearing or presented to the presiding officer at
the hearing.
Residents who are 65 years of age or older, or retired by reason of permanent and total disability,
and may apply to have payment of the assessment deferred. The application shall be made to the
City Clerk within 30 days after the adoption of the assessment roll by the City Council.

assessment will be spread over eight (8) years, with installments appearing on your real estate
taxes beginning next year. Interest will be included at the rate of eight percent (8) of the unpaid
balance. .
The proposed assessment roll is on file with the City Clerk. Written and oral objections to the
proposed assessment by any property owner will be considered.
No appeal may be taken as to the amount of any assessment adopted unless a written objection
signed by the affected property owner is filed with the City Clerk prior to the assessment hearing
or presented to the presiding officer at the hearing.
All written objections to the assessment not received prior to or at the assessment hearing in the
above matter are waived, unless failure to object prior to or at the assessment hearing is due to a
reasonable cause.
An owner may appeal an assessment to the District Court pursuant to Minnesota Statute section
429.081 by serving notice of the appeal upon the Mayor or City Clerk of the City of Chanhassen
within (30) days after the adoption of the assessment and filing such notice with the District
Court within ten (10) days after service upon the Mayor or the City Clerk.
Residents who are 65 years of age or older, or retired by reason of permanent and total disability
may apply to have payment of the assessment deferred. The application shall be made to the City
Clerk within thirty (30) days after the adoption of the assessment roll by the City Council.
City staff will be available between the hours of 8:00 a.m. to 4:30 p.m. weekdays until the time
of the public hearing to answer questions about the proposed assessments. You may also
telephone City staff at (612) 937-1900 extension 106.
You will be notified by mail of any changes adopted by the City Council in interest rates,
prepayment requirements, or the amount of the adopted assessments from those contained in this
notice.

Madam Mayor and Gentlemen:
The undersigned affected property owner of the above-identified tax parcels hereby files
with you written objection to the following proposed assessments to be levied for
Improvement Project No. 93-29 of the City of Chanhassen, Minnesota, viz:
$160,369.12 against Parcel Number 25-5650080 (Lot 1, Block 3, Park Two)
$137,252.68 against Parcel Number 25-5650090 (Lot 2, Block 3, Park Two)
$155,383.98 against Parcel Number 25-5660010 (Lot 1, Block 1, Park Two,
Second Addition), and
$111,928.80 against Parcel Number 25-5650070 (Lot 1, Block 2, Park Two),
all in accordance with information contained in your mailed Notice of Special Assessment
for Improvement Number 93-29, (the County Road No. 17 upgrade).
The cost of the improvements assessed against each of the described parcels is far in
excess of any additional value created for each of the parcels respectively. Further, said
parcels have not been benefited, except in a very de minimis way, by said Improvement
because each of said parcels already had a relatively new, serviceable roadway and
drainage system serving them, and there were no compelling traffic overload or pressing

safety considerations requiring the modification of the rural section roadway in the plat of
said Park Two to an urban section roadway. The companies I represent certainly do not
generate enough traffic that, when added to other traffic, require it.
Additionally, I have been informed via letter from the Assistant City Manager, Mr.
Gerhardt, as well as by the City Manager and the City Council through my attorney at the
public hearing for this project on January 8, 1996, that the four parcels above-listed have
sufficient assessment credits to offset the proposed assessments as part of the HRA's
Special Assessment Reduction Program.
I write this letter as the Chairman and Chief Executive Officer of the three companies
directly affected - Instant Web, Inc., United Mailing, Inc. and Victory Envelope, Inc. - as
well as for myself and on behalf and with the permission of the other record owners who
share ownership with me of the parcels of land previously identified herein.

This letter is to confirm our conversation of April 21, 1992, regarding the estimated
assessments for the "County Road 17 Upgrade";project. As I mentioned to you, several
years ago both you and Mayor Tom Hamilton 'niet with Don Ashworth to discuss what
the remaining tax increment from your projects (Instant Web, United Mailing and
Victory Envelope) could be used for in the future.\Mr. Ashworth had mentioned that
County Road 17 would need to be upgraded in the~future and would qualify for the
HRA's special assessment reduction program. In researching the HRA files, you qualify
for approximately $675,000 worth of t~""j'ncrement '~sistance that can be used to write
down the proposed assessments that are\against all foqr of your properties. In order to
receive this assistance, I would ameng bur existing priv~te redevelopment contract to
reflect the changes in the total amQ~int of special assestinents that would be the
