Pursuant to paragraph 5 on page SP-2 of the development contract the developer may request an extension of time to install the improvements. Please send me a letter addressed to the Mayor and City Council requesting an extension to the development contract and reasons for the request. I will need your letter by October 1, 1997 in order to be on the October 131 1997 City Council meeting agenda. This would. also be an a.ppropriate time to also ask for an amendment to the development contract to include a revised grading plan for the addition berms that were constructed over the last few months. Please submit 12 folded copies of the revised grading plan to my attention fat' review and City Council approval by October 1, 1997 as welL If you have additional questions, feel ~e to contact me. Box 147 Chanhassen, Mn. 55317 Dear Mayor and members of City Council: 1 would like to request a two year extension on the Great Plains Addition Project No. 95-13 . The reason for the request is the lot sales have been minimum. Only three lots of the first nine lots have been sold to date. In addition, 1997 was too wet tor development. It would have required considerable additional expense due to the soi17s high moisture content, making the project unfeasible. Thank you for your consideration. /1 ..M ;ro./ O'~ 1--/ A. The Developer may, however, request an extension of time from the City. If an extension is granted, it shall be conditioned upon updating the security posted by the Developer to reflect cost increases and the extended completion date. 6. Securi ty. To guarantee compliance with the terms of this Contract, paYment of special assessments, paYment of the costs of all public improvements, and construction of all public improvements, the Developer shall furnish the City with a letter of credit from a bank, cash escrow, or equivalent ("security") for $ 730,000.00.
