SOUTHWEST TWIN CITIES HIGHWAYS CHANGE OWNERSHIP
(RosevilIc, Minn.) -- Ownership and responsibility for several roadways in the southwestern
Twin Cities suburbs has changed between the Minnesota Department of Transportation and
local counties.
The following jurisdiction changes arc in effect today:
"'Highway 101 from Highway 12 in Wayzata to Twilight Trail on the Chanhassen/Eden
Prairie border is now part of the Hennepin County highway'system.
"'Highway 101 ti'om the fonner IIwy. 169 to the new Hwy. 169 (Shako pee Bypass) has
heen transferred to Scott County.
*1'hc former Highway 169 from the north Scott County line to new Hwy. 169
(Shakopcc Bypass) also is transferred to Scott County.
*Hennepin County Road 18 from 1-494 to the Minnesota River in Hennepin County
and Scott County Road 18 from the Minnesota River to approximately Highway 101 is now
under the Minnesota Department of Transportation's jurisdiction and is par,t of Highway 169.
Signs designating the madway as Hwy. 169 were installed last year.
Note: Highway 101 in Carver County remains under Mn/DOT until further notice.

Pursuant to authorization by the Minnesota Pollution Control Agency (MPCA), and in
accordance with the provisions of Minn. Stat. chs. 115 and 116, plans are approved and a
permit is hereby granted to the above-referenced Permittee for the construction and
operation of a sanitary sewer extension in Chanhassen, Minnesota.
The facilities will consist of2,935 linear feet of 8-inch and lO-inch sanitary sewer pipe.
The facilities are further described in MPCA approved plans and specifications designated
as:
"Arboretum Business Park Area Phase 1 Utility & Str~_et Improvements.City Project
Number 97-1 File 39352" received September 2, 1997, prepared by Bonestroo, Rosene,
Anderlik & Associates for the city of Chanhassen.
It is the Permittee's responsibility to assure compliance with any special conditions and the
general conditions that are required by this permit. This includes taking all necessary
measures needed to comply, including, but not limited to, the notification of contractors or
others who may be carrying out this work.

MINNESOTA POLLUTION CONTROL AGENCY
GENERAL CONDITIONS FOR SANITARY SEWER EXTENSION PERMITS
GENERAL CONDITIONS:

Material, labor and equipment for temporary erosion control measures and
the acceptable maintenance thereof shall be provided during the life of the
project, to effectively prevent water pollution through the use of berms,
dikes, dams, sediment basins, fiber mats, netting, gravel, mulches, '
grasses, slope drains, and other erosion control devices or methods.
Surface cover materials shall be anchored to reasonably prevent their
entering waters of the State by erosion or rising water levels.'
Temporary pollution control measures shall be included for all construction
activity associated with the project where such work is necessary, for
example borrow pit operations, haul roads, equipment storage, and plant or
waste disposal sites:
The temporary pollution control provisions contained herein shall be
coordinated with any permanent erosion features to the extent practical to
assure economical, effective, and continuous erosion control throughout the
construction and post-construction period.
The surface area of erodible earth material exposed by clearing and
grubbing, excavation, borrow and fill operations shall be minimized and
immediate permanent or temporary control measures shall be taken to prevent
contamination of adjacent streams and oth~r water courses, lakes, ponds,
and areas of water impoundment. Cut slopes shall be stabilized by methods
such as seeding and mulching as the excavation proceeds to the extent
considered practicable. Slopes shall be graded properly to minimize
erosion.

The Applicant will be required to incorporate all permanent erosion control
features into the project at the earliest practicable time. Provisions
should be made for continual checking and maintenance of all control
measures, particularly during periods of rainfall, to ensure maximum
effectiveness. Temporary pollution control measures will be used to
correct conditions that'develop during construction that were not foreseen
during the design state; that are needed temporarily to control erosion
that develops during normal construction practices, but are not associated
with the permanent control features on the project.

The Applicant will control the area of excavation, borrow and embankment
operations commensurate with his progress with finish grading, mulching,
seeding, and other such permanent erosion control measures. Should
seasonal limitations make such coordination unrealistic, temporary erosion
control measures shall be taken to the extent feasible.
Oil and other liquid substances capable of polluting water of the State
will be stored in accordance with the requirements af MPCA Miscellaneous
Water Quality Rules Chapter 7100.0010 - 7100.0090 (formerly Minnesota Code
of Agency Rules 6 MCAR 4.8004) (formerly WPC-4).

Stream Bank Stabilization shall be utilized if it is needed to prevent
erosion, and shall be constructed of materials which will not pollute
waters of the State.
If an effluent will result from the project the Contractor shall submit to
the MPCA plans, for approval, to provide for the following:

Water from dewatering operations including effluents from construction
activities shall only be discharged when the effluent complies with
the applicable water quality and effluent standards. Dewatering shall
be performed using well points where feasible and practical, all other
dewatering shall be performed so as not to result in increased
turbidity in the receiving water. This may require the use of
desilting ponds to reduce suspended solids. When the MPCA requires,
permits must be obtained.
A Disposal System Permit shall be obtained by the Contractor from the
MPCA prior to any hydraulic dredging or tunneling, or other activity
including an effluent which may contain potential pollutants.

10) This permit shall not release the permittee from any liability or
obligation imposed by Minnesota or Federal statutes or local ordinances and
shall remain in force subject to all conditions and limitations now or
hereafter imposed by law. The permit shall be permissive only and shall
not be construed as stopping or limiting any claims against the permittee
for damage or injury to persons or property, or any waters of the state
resulting from any acts, operations or omissions of the permittee, its
agents, contractors or assigns for damage-to state property, or for any
violation of the terms or conditions of this permit.
11) No assignment of this permit shall be effective until it is executed )n
writing and signed by the parties thereto and thereafter approved by the
Agency.
12) No major alterations or additions to the disposal system shall be made
without the written consent of the Agency.
13) The use of the disposal system shall be limited to the treatment and/or
disposal of the sewage, industrial waste, other waste materials or
substances described in the plans and/or permit application and associated
material filed with the Agency.

14) The Agency may modify, suspend, or. revoke in whole or in part, this permit
after giving notice and providing an opportunity for a public hearing or by
taking direct enforcement action, or any just cause including failure:
(a) to comply with the terms stated herein, or (b) to comply with Agency
water quality regulations and standards presently in force. Nothing herein
shall prohibit the Agency from exercising its emergency powers.

The permittee acknowledges that nothing contained herein shall prevent the
future adoption by the Agency or its predecessors of any pollution control
regulations, standards, orders or statutes more stringent than those now in
existence or prevent the enforcement and application of such regulations,
standards, orders or statutes to the permittee.
The Agency, its officers, employees and agents review and comment upon
engineering reports and construction plans and specifications regarding
this permit solely for the limited purpose of determining whether such
report, plans and specifications will enable the facilities subject thereto
to reasonably comply with the regulations and criteria of the Agency.
17) This permit has not been reviewed by the U. S. Environmental Protection
Agency and is not issued pursuant to Section 402 of the Federal Water
Pollution Control Act Amendments of 1972.

18) The pla~s for the project have been approved with the reservations stated'
on the a~tached sheet entitled "Information Relative to Review of Plans and
Permit Application."
19) The permitt'ee shall 'comply with all rules, regulations and requirements of
the Minnesota Environmental Quality Board prior to construction of the
proposed project. This permit is not effective until the permittee
completes all applicable environmental review (Environmental Impacts
Statement or Environmental Assessment Worksheet) which may be required for
the project.
20) This permit authorizes the Holder to perform the activities described
herein under the conditions set forth. "In issuing this permit, the
state/agency assumes no responsibility for any damage to persons, property
or the environment caused by the activities of the Holder in the conduct of
its actions, including those activities authorized, directed or undertaken
pursuant to this permit. To the extent the state/agency may have any
liability for the activities of its employees, that liability is explicitly
limited to that provided in the Torts Claims Act, Minnesota Statute ~
3.736.

INFORMATION RELATIVE TO
REVIEV OF PLANS,AND PERMIT APPLICATIONS

The review of plans and specifications for sewage, industrial waste or other
waste disposal systems and application for permits is made in accordance with
the authority conferred by law (see MS, Section 115.07). Approval of plans and
permits is based upon the assumption that the information provided by the
applicant is correct and that all necessary legal requirements have been or will
be satisfied.
Plans for sewage, industrial.waste or other waste disposal systems are examined
with regard to the design features which apply to operation and maintenance of
the treatment works or sewer system, the degree of treatment to be provided, the
effectiveness and reliabilitY,of the system or methods employed, and compliance
with applicable standards systems. The bulletin entitled Recommended Standards
for Vastewater Facilities, 1990 Edition, and supplements thereto, as well as
other information are used in examination of the design, operation and
maintenance aspects of the proposed system.
Sewer plans are recommended for approval on the basis that the system is to
collect only domestic sewage and such industrial or other waste as may have been
provided for in the design. Foundation or footint drains to collect ground
water and roof drains or other surface water_conduits should not be connected to
the sanitary sewer system. Adequate field supervision and inspection by a
qualified representative of the owner should be provided at all times during
construction to assure that the project is constructed in compliance with the
approved plans and specifications.
The Agency assumes no responsibility for the integrity of structures or physical
features, or for the reliability, durability or efficiency of specific items of
propriety equipment or material. All applicable federal, state and local laws,
regulations or ordinances must be followed in the design, location. and
construction of proposed sewer systems or treatment works.
The Agency reserves the right to withdraw its approval of plans if construction
is not undertaken within a reasonable period after issuance of the permit.

Meeting called to order by Vli Sacchet at 7: 10 p.m.
MEMBERS PRESENT: Andrew Leith, Susan Morgan, VIi Sacchet, Bill Coldwell, and Susan Markert
MEMBERS ABSENT: Jack Atkins, Susan Wright Greg Havlik, and Maureen Farrell

SEMINARY FEN TOUR: "It was a blast!" Tour attendees included: Maureen Farrell and her
daughter, Bill Coldwell, Andy Leith, Jack Atkins and his wife. It was noted that you had to look hard to
see the unique species. A good tour.
RECYCLING INFO. PROJECT: Andy and VIi updated the Commission on the project progress.
Ideas generated as to how to distribute the magnets included inserting them in the Villager, a separate
mailing, or inserting them in the city newsletter. Staff will research the cost of each option. Content of
the magnet will include phone number, website address, and what can be recycled. A suggestion to add
unordinary items to the list was made. Staff will check if phone extension can have its own menu. Andy
suggested doing a show on public access t.v.. Sue suggested a ore-use' campaign. VIi suggest that we fit
the basics on the magnet and expand as needed. Project should be completed by Dec. 31. Staff will
check with manufacturing company to see if large magnets are available.
ATTENDANCE: A discussion of the problem included viewpoints such as the need to know if
members were still committed, it is a nuisance to come, wait and take no action on the agenda, attendance
may be reflective oflack of goals (i.e. no 'fires' to put out), commissioners have an opportunity to create
their own identity - no fires are needed, there are too many ordinances, the agenda items are not
important enough - the commissioners are girl scouts due-to issues that are too goody-goody. Also noted
was that commissioners should be advocates and push the envelope and be more decisive. An outreach
poll of commissioners could be done to survey their environmental concerns. Commission could also
canvas neighbors to attend neighborhood meetings about environmental issues and advocate/follow-up
on city environmental issues. Problem may be that things aren't so bad in Chanhassen therefore no
burning issues.
Meetings will continue to be held on the second Wednesday of the month. Jill will send a yearly
schedule for 1998 in the next packet. The commission will review goals next month.
GENERAL DISCUSSION: Dr. Leith thought it would be a good idea to find out what needs to be
improved in Chanhassen (i.e. what don't we have?). Ms. Morgan suggested surveying what people
want/need/think. Mr. Coldwell thought residents could leave a voice-mail message to the survey. The
survey would find out what direction the commission should go take and what education is needed.
Another idea was to take an ad out in the Villager for the survey with the phone number, deadline, etc..
Can also place it in the "Briefly" column.
Suggestion to designate one member to attend other city meetings and update Commission on a monthly
basis.
Bill Coldwell updated the commission on the 'Green Builder' program from Austin. It's an education
program whose goal is to educate consumers on green building in order to create a demand for 'green
building'. Involves Realtors, consumers, and builders. It started as a part of an energy rating program
and had imtial resistance from builders. Mr. Coldwell said he could have enough information by ? in
order to update city council and get feedback on the next steps. Commissioners thought existing homes
should be included in the program. There will be an update at the next meeting.

These ideas were gleaned from the 1997 monthly meeting minutes. Please use them as idea
generators and come prepared to the meeting with suggestions.
. Survey residents, commissioners, and/or city council to determine environmental concerns
and 'hot topics'.
. Education and public relations blitz for a specific issue.(advocacy)
. Create telephone chain of neighborhood associations for quick notification of community
environmental issues.
. Provide education to city council on environmental issues.
. Identify what is special to Chanhassen and educate residents about it before it's destroyed.
. Organize 'mini-tours' of environmental features. Self-guided garden or nature tours, etc.
. Organized and committed rally around annual events.
. Developer/Builder/Citizen 'Green Star' award. Supported by Mayor. Given to those who have least
impact on environment and save the most natural features.
. Address loss of wildlife.
. Could design 'environmental detective' lesson plans for teachers and children in order to take note of
specific Chanhassen environments.
. Tools for Schools should be given to area schools.
. CompIle list of recommendations of what residents can do to improve their
environment/neighborhood.

Dear Don:
After review of the revised Site Grading, Drainage and Soil Erosion plan prepared by Roger
Anderson & Associates dated May 26, 1997, revised November 3, 1997, I found that the plans
are not in an acceptable format or ready to be considered by the City Council. Therefore, I am
returning the 10 copies of the revised grading and drainage plans. The following items must be
shown on the plans in order to be considered for approval by the City Council:
1. The Grading, Drainage, and Erosion Control plan must be signed by a professional
engineer registered in the state of Minnesota.
2. The temporary berms must be shown with 2-foot contours lines which accurately reflect
the location and height and slopes. The slopes of the temporary berms shall not exceed
2:1.
3. Prepare a timetable in which the temporary berm will be removed by, Le. one year, two
years, etc.
Please resubmit 10 folded copies of the revised grading plans incorporating the items listed above.
The next City Council meeting is November 24, 1997. Please have the revised plans to my office
by November 14, 1997 to be considered on that agenda.
On another matter, your letter of credit is scheduled to expire on November 15, 1997. Please
have an amended letter of credit sent to my attention as soon as possible and no later than
November 10, 1997. The amended letter of credit should be in the amount of $602,148.00 and
extended until November 17, 1999. Failure to submit a new or amended letter of credit by
November 10, 1997 will result in the City drawing on the existing letter of credit.

On October 27, 1997, staff was directed to follow up on a letter received from Mr. William
Kemble regarding lights from the Postal Service Annex shining into bedrooms. Staff contacted
the project architect but was informed that all communications should take place through the City
Attorney's office to the Postal Annex Attorney's Office, who will in turn communicate the
information to them. The letter was forwarded through the above channels and attached you will
find the response of the Postal Service Annex representatives. The lights will be shielded.

Dear Nancy:
Thank you for urging the US Postal Service to complete final grading of the south side of
the berm at their new facility. I happened to speak with the construction worker as he
was grading this morning. He was well aware of, and in complete agreement with your
instructions for completing this work.
There is a recent issue raised by several of the neighbors which I would like to bring to
your attention. As you will recall, we were assured by the Postal Service that all outside
lighting would be shielded and directed downward, so as not to shine directly toward our
homes. The parking lot lights, while far greater in number than we were promised, are all
shielded and do not seem to be a problem to any of the residents. However, there are
several bright spotlights on the west side of the building, and another on the southeast
comer of the building. These lights are on a timer, so they turn on and off every day,
even though the building is not yet occupied. These lights are not shielded or directed
downward, and are bright enough that they cast shadows into the bedrooms of at least
four (4) homes adjacent to the property. Thanks to these spotlights, we no longer have
the need for night lights in our bedrooms!
I spoke to Lora Grgich of RSP Architects regarding these spotlights two weeks ago, but
have not heard back from her. The neighbors effected by these lights would like the City
of Chanhassen to request that the lights be directed downward in the same fashion as the
parking lot lights, or better yet, eliminated all together.
