FAX (612) 937-5739 MEMORANDUM TO: Don Ashworth, City Manager FROM: Sharmin AI-Jaff, Planner II DATE: May 21, 1997 SUBJ: Update on Postal Service Annex Berm: As part of the sound study which was conducted by Mr. David Braslau, the Postal Service was required to install a berm along the south lot line of the property. Also, this berm was to extend 95 feet onto the National Weather Service site, located east of the subject property. The City has contracted with an excavator to construct the portion of the berm on the National Weather Service site. The berm is currently under construction and is expected to be completed by the end of the month of May if the weather cooperates. Agreement between the City of Chanhassen and Postal Service: Tom Scott, City Attorney, spoke to Brian Marshall with the Postal Service and was assured that the Postal Service will approve the agreement "It is just a matter oftime to process it". Copy of the agreement is attached. The City Attorney expects the agreement to be signed by May 30, 1997. AGREEMENT BETWEEN CITY OF CHANHASSEN AND UNITED STATES POSTAL SERVICE RECITALS . The u.s. Postal Service is constructing a facility in Chanhassen, Minnesota located on Lot 4, Block 1, Chanhassen Business Center, Third Addition. . The U.S. Weather Service leases a facility in Chanhassen owned by Chanhassen Venture, Ltd., which abuts the Postal Service property to the east and is legally described as Lot 1, Block 2, Chanhassen Business Center, First Addition. . The City has a 100 foot wide conservation easement which runs along the south 100 feet of both the Postal Service and Weather Service properties. This Agreement sets forth the understanding of the parties relating to the construction and maintenance of a berm, fence, landscaping and trail relocation within the conservation easement. NOW, THEREFORE, the City of Chanhassen and U.S. Postal Service agree as follows: 1. The U.S. Postal Service will do the following: a. Construct an earthen berm and nine foot high fence within the conservation easement on its property in accordance with the [mal plans and specifications prepared by RSP Architects, Ltd. b. Pay to the City of Chanhassen by June 1, 1997, the amount of $32,325.00 for use by the City for seeding, landscaping, trail relocation, and other related site work within the conservation easement. 51085 ,0 c. Adopt and monitor a best practices policy aimed at reducing, to the extent feasible, facility noise impacts to adjoining residences. Copies of the policy will be provided to the City 0 d. The berm area will be seeded and landscaped in a manner which allows it to remain in a natural, unmaintained state. To the extent maintenance is necessary, the Postal Service will maintain the berm, fencing and landscaping on its property on an ongoing basis. e. Provide the City with final landscaping plans and specifications for the berm, fencing, seeding and landscaping in a format acceptable to the City. 2. The City of Chanhassen will do the following: a. Assume all responsibility for the construction of the berm extension onto the Weather Service property, including any landscaping or other site improvements relating to the berm extension. b.
