Chanhassen Lions Club Selling Pull Tabs at the 4th of July Celebration
The Chanhassen Lions Club would like the opportunity to sell pull tabs on Thursday, July
3 at Chanhassen's Annual 4th of July Celebration.
The Lions need a resolution from the City Council allowing them to conduct this one-day
off-site gambling at the celebration. This is required by the Minnesota Gambling Control
Board.
RECOMMENDATION
Approval of a one-day off-site gambling permit for the Chanhassen Lions Club on
Thursday, July 3 at Chanhassen's ~il4th of July celebration is recommended.

This item was tabled at the May 27, 1997 city council meeting. I have reviewed the
minutes of the meeting and will attempt to respond to the city council's inquiries.
Issue of Conducting Pull Tab Sales on City Property: The city accepts contributions
from the Lions Club which are derived from charitable gambling. To date, the Lions
have allocated in excess of$125,000 to park and recreational facilities. Of this amount,
$75,000 remains uncollected. We all have personal convictions, one way or another,
about the level of gambling in our society. However, the individual who coined the
phrase, "Don't bite the hand that feeds you" had something to say.
The Lions Club would enjoy the support of the city council. In the event the city council
is unable to support this one-day off-site gambling permit, the council may wish to
elaborate on their position regarding the acceptance of future contributions. The Public

Safety Department and Senior Center are also beneficiaries of the Lions Club charitable
gaming operation.
As the council is aware, the Lions are currently not operating a pull tab sales site, as
Pauly's Restaurant and Bar no longer exists.

Councilman Senn: We have to let them all into the right-of-way. I mean that's contrary to what I was
hearing before.
Roger Knutson: There's a new State law which was just passed, and I assume it was signed by the
Governor. .. I'm quite confident that it was. I dido't hear that it was vetoed. The 14 days isn't up yet but
I believe it passed which gives us some authority.
Councilman Senn: Okay, so should we just table this?
Roger Knutson: I wasn't involved in this issue so I don't.
Mayor Mancino: Let's table it and just get it back next time.

Councilman Berquist: I pulled it.
Councilman Senn: I did too.
Councilman Berquist: I understand the Lions do a wonderful job. They do a lot of good. It's all money
that ends up coming back to the City in a beneficial manner. The problem that I have, and I think I'll
abstain from the vote is that we're permitting this to occur on city property. .. .critical at times and
maybe this is one time but there's just something about it that I don't like.
Mayor Mancino: Doing pull tabs on the 4th of July celebration?
Councilman Berquist: Pull tabs on the 4th of July celebration on city property.
Councilman Engel: Would you be okay with it ifit was elsewhere?
Councilman Berquist: I'd definitely rethink it. You know I can't tell you for sure.
Todd Gerhardt: On behalf of the Lions, they did have their pull tab operation as a part of Pauly's. Since
they've closed they've...
Mayor Mancino: Tell me, how much does the City get from the pull tabs?
Todd Gerhardt: Well only what they want to...
Councilman Senn: Yeah, I had questions on that. I mean I had asked to pull this too and I just thought
we should really get more information as it relates to specifically how, what can happen with these funds.

I mean Steve's question I think is valid and justified but there may be a logical answer there. And if all
the funds, and I mean all the funds are going into help fund city requests or programs or. . . whatever that
we give them, you know then they're, I know Hopkins does that a lot and that is a stipulation they have
with the Jaycees on doing that. I mean more ofless, and no question. I mean 100% of the funds go into
basically kind of where the City Director wants them to go into the different programs and that sort of
thing. And I think that's, I mean that may make it easier to say well let's allow it at this type of an event
or whatever if it's basically to turn around and benefit you know our programs or whatever that can't be
funded other ways or whatever.
Todd Gerhardt: Well I think it is.. . their concerns are their project that they've already outlined for I
think Lake Ann.
Councilman Berquist: The lighting at Lake Ann?
Todd Gerhardt: Right. And this may jeopardize some of that funding for that.
Roger Knutson: You have an ordinance right now that says they have to give you 10% of the net
proceeds and 50% of the proceeds must be spent in the community.
Mayor Mancino: 50% must be spent in the community? It'd be nice to figure out how much they really
do plan on giving. I mean if it's over that. I mean that's the ordinance but they can give more.
Councilman Senn: Well and we don't have to okay it as part of a city event or on city property. I mean
again, I understand what's in the ordinance but I think that's something we should talk about in lieu of
this special situation here which is really a little bit more of the unusual versus just selling it in one of the
local bars.
Councilman Berquist: I hadn't realized that they, you know that the Pauly's being gone, that that was
also gone.
Councilman Senn: So I mean they may need it to even meet the funding commitments they've given us
now which means if we don't okay it, we're going to end up in the red on the project that we've gone
ahead and done them, right?
Todd Gerhardt: I don't know about that.
Mayor Mancino: Well let's find out a little bit more information. I have a hard time with pulltabs.
Councilman Senn: Well I think the lights are there aren't they?
Councilman Berquist: Are you suggesting tabling?
Mayor Mancino: Yeah.
Councilman Berquist: Well I would suggest, well I don't know.
Councilman Senn: Well we've got time to do it. We've got time to do it.
Councilman Berquist: Knowing a little bit more of the deal, I'm less inclined to be so principally pure.

Mayor Mancino: We'll just put these back on the next consent agenda and have, there is absolutely no
question that it certainly helps us having a work session before the City Council meeting and so I think
we may want to think through on January 2nd, EDA meetings. When they are. They now are before our
City Council meetings which didn't.
Councilman Berquist: January, I'm not waiting that long.
Mayor Mancino: Didn't work out. June 2nd.
Councilman Senn: Well the other thing we might do is consider setting a set time frame for some of
them. I mean the reason we ran into trouble, and I guess we let one item take an hour which was
absolutely unnecessary to have it take an hour. And so maybe what we should do is get a little more
pushy in terms of saying, here. You've got an item and you've got 20 minutes. Ifit doesn't get done,
come back the next meeting.
Councilman Engel: Yep, I think that makes a lot of sense.
Councilman Senn: I mean assign a time element to it and just make it clear to them. Ifwe don't get
through it in that time period.
Mayor Mancino: Bring your calendars for a visioning meeting June 2nd and we'll decide then when
we're going to do it.
Councilman Senn: Administrative Section discussion, can we push to the work session then please?

Once a year, each licensed Charitable Gambling operation is allowed to have an off-site (away
from the licensed address) event lasting no more than 10 hours. These opportunities are usually
community-sponsored or festival events which have never been taken advantage of by The Lions
Club of Chanhassen. Our request this year is to have a "charitable" pull-tab sale July 3 near the
beer concession during the city's July 4th celebration.
As the council is aware, our charitable gambling operations at Pauly's Bar & Restaurant has been
in limbo since September and into the foreseeable future due to circumstances beyond our control.
This has put our $98,000 commitment for a Lion's Ball Field at Lake Ann on hiatus after our initial
$24,000 donation in 1996. We felt we could generate some dollars towards this commitment with
a pull-tab concession July 3.
Since you tabled this request at your last meeting, we may now be in jeopardy of receiving
Gambling Control Board approval because they require that a City Resolution accompany the
licensee's request "30 days in advance of the occasion."
The Lions Club has been a contributing organization to the betterment of this community since our
inception in 1988. Our impetus to start Charitable Gambling here was so that we could be an even
larger financial contributor. And that is exactly what has occurred.
While all of our contributions cannot be directed to the City of Chanhassen, this municipality has
been - by far - the largest benefactor. We are including a list of most of the beneficiaries of our
donations during 1996 and thus far in 1997. (See attached list)
We have informed the Gambling Control Board of this situation and that a City Resolution would
be late in accompanymg our Off-Site Request Whether they permit the tardiness is up to the
board.
