PROPOSAL SUMMARY
The applicant is requesting an extension until June 30, 1997 to record the final plat.
BACKGROUND
On September 9, 1996, the City Council approved the final plat for Subdivision #94-7, Creekside
2nd Addition, creating four lots, subject to the following conditions:
1. A woodland management plan will be required as part of the platting process. The home
builders and home purchasers shall be provided a copy of the plan.
2. A ten foot clear space must be maintained around fire hydrants, i.e. street lamps, trees,
shrubs, bushes, NSP, NW Bell, cable television, transformer boxes. This is to ensure that fire
hydrants can be quickly located and safely operated. Pursuant to Chanhassen City Ordinance
Sec. 9-1.
3. Full park and trail fees shall be paid per city ordinance.
4. The applicant shall revise the development plans to include a 100-foot setback buffer around
Bluff Creek and a 50 foot setback buffer along the tributary to Bluff Creek. The 100 and 50
foot building setbacks shall be shown on the building site plan as part of the building permit
application for the individual lots.
5. All areas disturbed as a result of construction activities shall be immediately restored with
seed and disc-mulched or wood-fiber blanket or sod within two weeks of completion of each
activity in accordance with the City's Best Management Practice Handbook. Type III erosion

control will be required adjacent to all wetlands except where storm ponds will intercept
runoff prior to discharging into the wetlands. In these areas Type I erosion control is
required.
6. The applicant shall enter into an addendum to the development contract for Creekside with
the City and provide the necessary financial security to guarantee compliance with the terms
of the development contract.
7. The applicant shall apply for an obtain permits from the appropriate regulatory agencies, i.e.
Carver County, Watershed District, MWCC, Health Department, PCA, DNR, Army Corps of
Engineers and MnDOT and comply with their conditions of approval.
8. For custom graded lots, a satisfactory soils report from a qualified soils engineer shall be
provided to the Building Official before the City issues a building permit.
9. No berming or landscaping will be allowed within right-of-way areas.
10. The lowest floor elevation of all buildings should be a minimum of 2 feet above the high
water level calculated according to the shoreland ordinance guidelines.
11. Individual grading, drainage and erosion control and tree removal plans will be required for
each wooded lot prior to issuance of a building permit. This condition applies to Lots 1, 2, 3,
and 4, Block 1.
12. SWMP connection fees will be based in accordance with the City's SWMP. Staffhas
evaluated these fees based on the applicant's contribution to the SWMP design requirements.
The fees have been calculated at $6,867.00 and are payable to the city at the time of final plat
recording. The fees for phase I are also payable prior to recording this final plat. The fees
are $29,590.00.
13. The applicant shall report to the City Engineer the location of any drain tiles found during
construction and shall relocate or abandon the drain tile as directed by the City Engineer.
14. A trail easement shall be dedicated over Lots 1, 2, and 3 that provides a minimum 20 foot
trail corridor including Outlot B, Creekside Addition.
15. Lot 2 does not meet the minimum lot frontage requirement and shall be increased to 90 feet in
width.
16. An Ag/urban wetland is located in Outlot D adjacent to lots 3 and 4. A 40 foot setback from
the wetland buffer is required for buildings on these lots. The wetland buffer shall average

10 feet in width with a range from 0 - 20 feet. Wetland buffer areas shall be surveyed and
staked in accordance with the City's wetland ordinance. The City will install wetland buffer
edge signs before accepting the utilities and will charge the applicant $20 per sign.
On May 8, 1995, Creekside Addition received final plat approval of Subdivision #94-7,
Creekside Addition, subdividing 39.5 acres ofland into 44 lots and 6 outlots subject to the plans
dated April 27, 1995.
On January 9, 1995, Creekside received preliminary plat approval for a 44 lots and 4 outlots, first
reading of rezoning from A2 to RSF, Wetland Alteration Permit to fill and mitigate wetlands on
site, and Conditional Use Permit to excavate and fill in the flood plain.
DISCUSSION
City Code, section 18-41 (e), states: "Upon approval of the final plat by the city council, the city
shall notify the applicant of the approval and within thirty (30) days thereafter, the applicant or
the city attorney shall file the final plat with the county recorder and furnish the city evidence of
such recording. Failure of the applicant to comply shall be cause for revoking the city's
approval. "
In reviewing the trail alignment within the project, staff discovered that the dedicated alignment
as part of Creekside Addition would unnecessarily impact trees. The applicant has been working
with the Parks Director to come up with a meandering alignment that will preserve additional
trees within the project. The applicant has agreed to grant additional easements to accommodate
the trail alignment.
RECOMMENDA TION
Staff recommends that the City Council adopt the following motion:
"The Chanhassen City Council grants an extension on the final plat recording requirement until
June 30, 1997 for Creekside 2nd Addition subject to the original conditions and the following
condition:
17. The applicant shall dedicate the additional trail easement needed to accommodate the
meandering trail alignment."
