PLANNING COMMISSION SUMMARY The Planning Commission held a public hearing on May 2, 2006, to review the proposed development. The Planning Commission voted 6 to 0 to approve the proposed project. The Planning Commission discussed the issue of rooftop screening. The Planning Commission agreed that due to the 20-foot elevation difference between Highway 41 and the grade of the site, rooftop screening enclosures were impractical and the developer could camouflage the units utilizing charcoal gray painted, low-profile rooftop equipment as permitted by the project design standards. The Planning Commission minutes are item la of the May 22,2006 City Council packet, pages 28 - 34. RECOMMENDATION Staff and the Planning Commission recommend adoption of the motion on pages 8 through 10 as specified in the staff report dated May 2, 2006. Building materials consist of rock face concrete block in cedar (primary material) and limestone (horizontal banding) colors. The property to the north contains Lifetime Fitness, which has a finished floor elevation approximately 13 feet lower than the proposed building. To the east is the Vengra Design building. Located to the south, across Water Tower Place, is the All About Lights building. To the west, approximately 20 feet above the proposed finished floor elevation, is Highway 41. Water and sewer service for the site is in Water Tower Place which also provides access to the site. At a future date, Highway 41 will be lowered and Water Tower Place will connect to Highway 41 with a right-inlright-out access restriction. The site has been previously rough graded as part of Arboretum Business Park 5th Addition. The developer has worked with staff to add a sidewalk from the north side of the building to the public street. Additionally, the developer has revised the building elevations to enhance the entrance features of the building. The proposed development complies with the development design standards and the zoning ordinance. Staff is recommending approval of the project subject to the conditions of the staff report. BACKGROUND On May 27, 2003, the Chanhassen City Council approved the following motions: The Chanhassen City Council approved the preliminary and final plat for Arboretum Business Park 5th Addition creating two lots; and Site Plan #2003-4, as shown on plans prepared by Steiner Construction Services dated April 4,2003, for a 20,000 square-foot, one-story office warehouse building on Lot 2, Block 1, Arboretum Business Park 5th Addition. December 10,2001, the City approved an amendment to the Planned Unit Development (pUD #92- 6) Development ContractJPUD Agreement for Arboretum Business Park incorporating printing as a light industrial use; permitting indoor recreationlhealth clubs and recording studios in the existing office-industrial buildings in the project; and prohibiting vocational schools, public buildings (except in Outlots A and B), screened outdoor storage, and food processing. On June 22, 1998, the city approved a site plan for a 55,911 square-foot building (All About Lights) on Lot 1, Block 2, Arboretum Business Park 3rd Addition and a 52,956 square-foot building (On The Level) on Lot 1, Block 1, Arboretum Business Park 2nd Addition (the On The Level building was not constructed). APPLICABLE REGULATIONS Arboretum Business Park Development Standards Site Plan Review, Chapter 20, Article II, Division 6 Design Standards for Commercial, Industrial and Office-Institutional Development, Chapter 20, Article XXIII, Division 7 GENERAL SITE PLAN/ARCHITECTURE ARCHITECTURAL COMPLIANCE Size Portion Placement The building entrances are highlighted by canopies over the doorways and display windows to the sides of each entrance. The developer has projected the entry areas out from the building to provide additional articulation and definition to the entryways. Material and Detail The building material consists of rock face concrete block in two colors: cedar and limestone. Horizontal banding is proposed through the use of the limestone block along the base, above the windows and above the sign band on the western building elevation. A limestone colored accent is provided at the top of the architectural columns. The northerly and southerly 35 feet of the west elevation are stepped out from the building approximately four feet. Halfway between each entrance, a column is projected out from the building to help break up the building pattern. Color Building colors consist of cedar (reddish-brown), limestone, sierra tan and colonial red. Height and Roof Design Building height is 22 feet to the top of the parapet. As part of the building permit process, the applicant must provide a schematic verifying that the rooftop equipment is screened pursuant to city ordinance. No wooden fences are permitted on the roof for screening. Facade Transparency The first floor elevation viewed by the public contains more than 50 percent transparent windows and or doors. Site Furnishing The developer is providing a bicycle rack in the southeast comer of the building. Additionally, staff had the developer extend the sidewalk around the building from the northern door in the northwest comer of the building to the bike parking area in the southeast comer of the building. This sidewalk will then tie in to the sidewalk out to the street. Loading Areas, Refuse Area, etc. The truck parking/loading areas, service yards, refuse and waste removal are located on the eastern side of the building. The landscaping in the southeast comer of the building shall be changed to conifers to provide year round screening of the truck docks. An enclosure is provided for trash containers at the northeast comer of the building. Landscaping Minimum requirements for landscaping for the Arboretum Business Center, Lot 1, Block 1 development include 4,410 square feet of landscaped area around the parking lot, 17 trees for the parking lot, and bufferyard plantings along property lines. The applicant's proposed as compared to the requirements for all landscape requirements is shown in the following table. Staff recommends that the Black Hills spruce identified near the building be moved east to serve as screening for the truck area. Additionally, due to the limited width of the planting area, staff recommends that the spruce be replaced with a narrower evergreen species such as arborvitae. Lot Frontage and Parking location The site fronts on Water Tower Place and Highway 41. Parking is distributed around three sides of the building. Loading docks are located on the east side of the building across a truck court from the loading docks on the building to the east. The site has a shared driveway with the property to the east at the common lot line and a second access out to the cul-de-sac bulb. In the future, Water Tower Place is projected to be connected to Highway 41 with a right-inlright-out turning restriction on the connection. GRADINGIDRAINAGE The applicant is proposing to fine grade about 80% of the site for the new office-showroom- warehouse building and parking lots. The plans propose to grade the site for the new building Arboretum Business Center Planning Case 06-16 May 2, 2006 Page 7 of 11 pad of 1003 in elevation. At this elevation, stormwater from the building and parking lots will drain toward the proposed catch basins to be conveyed via storm sewer to the existing Water Tower Place storm sewer. Prior to building permit issuance, storm sewer design data for a 10- year, 24-hour storm event will need to be submitted for staff review. The plans show silt fence is proposed along the north side grading area. The applicant should be aware that any off-site grading will require an easement from the appropriate property owner. A maximum side slope of 3: 1 is allowed along the north side of the property line. EROSION AND SEDIMENT CONTROL The silt fence to be installed along the northern part of the project is proposed on the adjacent property. The applicant must obtain permission from the property owner to the north prior to silt fence installation. If permission is not ob~ained, the plans should be revised to accommodate all sediment control measures on-site. Street cleaning of soil tracked onto public streets shall include daily street scraping and street sweeping as needed. OTHER AGENCIES The owner/operator of the proposed development must apply for and receive an NPDES Phase IT Construction permit prior to beginning construction activities. Any development disturbing more than one acre and creating more than one acre of impervious surface must also have permanent storm water treatment. The Arboretum Business Park PUD addressed permanent storm water treatment as a part of the overall review process. The applicant should apply for and obtain a permit from the Riley-Purgatory-Bluff Creek Watershed District and comply with their conditions of approval. UTILITIES Municipal sewer and water service is available to the site from the south side of the lot on Water Tower Place and the east side along the property line. The applicant is proposing to connect to the existing water and sanitary sewer lines and extend them to serve the lot. The south watermain and sewer lines will be considered private utility lines since they will serve only one lot. The applicant must verify with the City Building Department if the site connecting to the existing 8-inch watermain on the east side is adequately sized to handle the two lots' consumption. A 20-foot wide public utility easement must be dedicated over the existing watermain and where the sewer crosses from one lot to another. This easement must be recorded before a building permit issued. Arboretum Business Center Planning Case 06-16 May 2, 2006 Page 8 of 11 The site has previously been assessed for utility and street improvements and the City Finance Department does not show any remaining balance. Sanitary sewer and water hookup charges will also be applicable. The fees will be calculated at the rate in effect at the time of building permit issuance. The party applying for the permit is responsible for the payment of these fees. The 2006 trunk hookup charge is $1,575 for sanitary sewer, $4,078 for watermain and $1,625 for SAC. The hookup charges are based on the number of SAC units assigned by the Met Council. The City sewer and water hookup charges may be specially assessed against the parcel at the time of building permit issuance. All of the utility improvements are required to be constructed in accordance with the City's latest edition of Standard Specifications and Detail Plates. Permits from the appropriate regulatory agencies will have to be obtained, including but not limited to the Watershed District, MnDOT, NPDES and Department of Health. STREETS No public streets are proposed as part of this project. The applicant is proposing full access to the site from Water Tower Place. As the eastern access will service the two lots, cross-access easements will need to be obtained and recorded against the lots. LIGHTING/SIGNAGE The developer is proposing 27.5-foot high metal halide light fixtures for the parking lot on square steel poles and wall mount lighting units at a 20-foot height on the building. All fixtures must be shielded with a total cutoff angle equal to or less than 90 degrees. The developer is proposing a sign band above each building entrance. Each property shall be allowed one monument sign per street frontage. All freestanding signs shall be limited to monument signs. The sign shall not exceed eighty (80) square feet in sign display area nor be greater than eight (8) feet in height. The sign treatment is an element of the architecture and thus should reflect the quality of the development. The signs should be consistent in color, size, and material throughout the development. The applicant shall submit a sign package for staff review. A separate sign permit will be necessary for each sign. The Planning Commission conducted a public hearing on the proposed site plan was preceded by published and mailed notice. The Planning Commission heard testimony from all interested persons wishing to speak and now makes the following: FINDINGS OF FACT 1. The property is currently zoned Planned Unit Development, Light Industrial/Office Park (PUD). 2. The property is guided by the Land Use Plan for Office/Industrial. 3. The legal description of the property is: Lot 1, Block 1, Arboretum Business Park 5th Addition 4. Site Plan Review: a. The proposed development is consistent with the elements and objectives of the city's development guides, including the comprehensive plan, official road mapping, and other plans that may be adopted; b.
