May 12, 2006 Todd Gerhardt, City Manager FROM: DATE: SUBJ: Request for On-Sale Beer & Wine License, Bruce Foster Restaurants Las Vegas, Inc. dba Frankie's Pizza, Pasta & Ribs, 7850 Market Boulevard This office has received a request for an on-sale beer and wine license from Bruce Foster Restaurants Las Vegas, Inc. for the Frankie's Pizza, Pasta & Ribs restaurant at 7850 Market Boulevard. Mr. Foster is purchasing this restaurant from Patrick Shea, Deloias, Inc. The restaurant seats 75 people with a full service menu and is located in the Market Square strip center. Mr. Foster does not intend to make any changes to the restaurant's current operations at this time. Law Enforcement is conducting a background investigation, including criminal history, driving records, outstanding warrants, financial, and references on Bruce H. & Carol J. Foster. Thus far, no negative comments have been found; however, we are awaiting a final report from the Henderson Nevada Police Department showing any prior involvements with their restaurant at that location. Staff anticipates receiving their final report prior to Monday night's meeting and will notify the Council if any negative comments are found. A public hearing notice was published in the Chanhassen Villager and sent to all property owners within 500 feet of the site (see attached list). As of the date of this writing, staff has not received any comments from the public. RECOMMENDA TION Staff recommends that the City Council approve the request for an on-sale beer and wine license for Bruce Foster Restaurants Las Vegas, Inc., dba Frankie's Pizza, Pasta & Ribs at 7850 Market Boulevard, contingent upon receipt of the license fee, liquor liability insurance, and a response from the Henderson, Nevada Police Department. Approval of this license requires a simple majority vote of those City Council members present.
