BACKGROUND City code excludes the use of temporary structures for the sale of fireworks. State statute prohibits local governments from restric he use of temporary structures provided they comply with National Fire rotection Association Standard 1124 (200 edition). Minnesota S (d) A local unit of government may impose an annual license fee for the retail sale of items authorized under paragraph (c). The annuallicen ee of each retail seller that is in the business of selling only the items au zed under paragraph (c) may not exceed $350, and the annu se of each other retail seller may not exceed $100. A local unit of gove may not: (1) impose any fee or charge, other than the fee authorized by this paragraph, on the retail sale of items authorized under paragraph (c); . (2) prohibit or restrict the display of items for sale authorized under paragraph (c) that comply wi Association Standard 1124 (2003 edition); or (3) impose on a retail seller any financial guarantee requirements, including bonding or insurance provisions, containing restrictions or conditions not imposed on the same basis on all other business licensees. RECOMMENDA TION Staff recommends that the City Council adopt the attached ordinance amending Chapter 10 of the Chanhassen City Code. ATTACHMENT 1. AN ORDINANCE AMENDING CHAPTER 10 CHANHASSEN CITY CODE, LICENSES, PERMITS, BUSINESS REGULATIONS THE CITY COUNCIL OF THE CITY OF CHANHASSEN, MINNESOTA ORDAINS: Section. Section 10-80 (2) of the City Code, City of Chanhassen, Minnesota, is hereby amended to read as follows: The licensed premises must be a permanent building equipped with an automatic sprinkler system, or if a temporary structure, must comply with National Fire Protection Association Standard 1124 (2003 edition). Section. This ordinance shall be effective immediately upon its passage and publication.
