Staff has received a request from Joshua Pickard, owner of the property, for the vacation
of the eight feet of alley right of way north of the property.
BACKGROUND
The existing 16-foot WIde alley fight of way was dedicated with the St. Hubertus plat.
On April 13, 2006 Joshua Pickard submitted the vacation application along with the
required fees and surveys.
DISCUSSION
Alley nght of way was platted throughout the St. Hubertus plat, however the alleys were
never constructed, nor do they provide access to any lots within the subdivision. In May,
1995 City Council approved the alley right of way vacation for Lots 4 and 5, Block 2, St.
Hubertus, to the east of Mr. Pickard's property
The applicant intends to build a single family residence on Lot 3 with access to West 78th
Street, a minor collector. Staff researched the feasibility of the driveway access from
Erie A venue through the alley right of way. This alignment requires each property owner
adjacent to the dnveway to grant an encroachment agreement. Staff discussed this
scenario with one of the affected property owners, who indicated that he would not
support this dnveway alignment at this time.
The applicant must construct a "hammer head" driveway so that vehicles will not have to
back out of the property onto West 78th Street.
A ten foot WIde drainage and utility easement will be granted on the south side of the
existing sanitary sewer within the alley right of way. The Gopher State One call did not
identify any additional public or private utilities within this alley right of way.
RECOMMENDA TION
Staff recommends that the Chanhassen City Council approves a resolution vacating eight
(8) feet of alley right of way located along the north property line of Lot 3, Block 2, St.
Hubertus
