WS 2000 04 24 CHANHASSEN CITY COUNCIL WORK SESSION APRIL 24, 2000 Mayor Mancino called the work session to order at 5:40 p.m. COUNCIL MEMBERS PRESENT: Mayor Mancino, Councilman Senn, Councilwoman Jansen, Councilman Labatt, and Councilman Engel STAFF PRESENT: Scott Botcher, Roger Knutson, Kate Aanenson, Dave Hempel, Todd Gerhardt, Cindy Kirchoff, and Teresa Burgess Consent Agenda: A. Approve Proclamation Declaring May 6 as Arbor Day. No questions were asked on this item. B. Approve Disposition of 1984 GMC Rescue Truck. No questions were asked on this item. C. Award of Bid for 2000 Sealcoat Proiect No. 00-03. Mayor Mancino asked for clarification from Dave Hempel on the price difference between bidders. D. Authorize Preparation of Feasibility Report for Crestview Circle, Proiect 00-05. Mayor Mancino expressed surprise that the bid price remained the same for more work proposed. Dave Hempel explained that the contractor had agreed to that price and was looking to start a working relationship with the City. E. Approve Amended Development Contract/PUD Agreement for Villages on the Ponds 6th Addition, Proiect 99-19. No questions were asked on this item. F. Approval of Bills. Scott Botcher clarified questions that Councilman Senn had asked earlier in the day. G. Approval of Minutes. City Council Work Session - April 24, 2000 Councilman Senn had a question regarding a discussion in the Park and Recreation Commission Minutes. Scott Botcher stated that they were meeting on April 25th and he would ask for clarification. Approve Resolution Adding Minneapolis Fire to the Southwest Mutual Aid Association. Mayor Mancino expressed surprise that the area for mutual aid spread out to such a wide area. Councilman Labatt explained how the process worked during a large scale emergency. 2. Board of Review and Equalization. Mayor Mancino asked that Todd Gerhardt explain to the City Council the process that would taken at the meeting. Presentation by Sgt. Dave Potts, Carver County Sheriff's Office and John Wolff, Fire Chief. Mayor Mancino asked if the City should continue to allow hunting. Councilman Jansen asked that the issue be looked at and that the City examine the areas where hunting is still allowed. Request for Payment of Adiusted 1999 Police Contract, Carver County Sheriff's Office. Mayor Mancino asked if Sheriff Bud Olson would be present at the meeting to answer questions. Scott Botcher stated that he had other commitments and if the City Council had questions he would forward them to the Sheriff for answers. The item could either be pulled off the agenda to be approved at a future meeting once questions are answered or approved with conditions. Request for a Wetland Alteration Permit for a Septic Hauler Site Located on Park Place, Metropolitan Council Waste Haulers and the City of Chanhassen. Cindy Kirchoff explained changes that had been made to the conditions in the staff report. Kate Aanenson explained the Planning Commission's concerns with this item and stated that the City could break the lease agreement if there were complaints with the site. Request for a Wetland Alteration Permit, Upgrade of TH 5/West 78th Street, MnDot, Proiect 97-06. Dave Hempel updated the City Council on this item stating that this was a request for an amendment to the existing agreement and gave an update on the progress of the Highway 5 improvement project. City Council Work Session - April 24, 2000 Request for an Interim User Permit to Haul 50,000 cubic yards of Excavated Materials on Property Located at the Northeast Corner of TH 5 and Galpin Boulevard, Larry VanDeVeire. Mayor Mancino expressed concern over this much fill being brought onto the site that close to a wetland and changing the contours of the land. Dave Hempel stated that this project was infilling the site and preparing it for future development. Kate Aanenson stated that this permit was similar to the Charlie James site. Dave Hempel stated that the applicant would be constructing a berm or dyke with erosion control to protect the wetland. Councilman Labatt expressed concern over the number of trucks making turns from Highway 5 onto Galpin and the turning radius of those trucks. Dave Hempel explained that the City could work with the County to build auxiliary turn lanes if it became a problem. Mayor Mancino asked if the City Council was comfortable with the hours permitted. Roger Knutson stated that the City could restrict the hours if it became a problem. Councilman Senn asked that a condition be added to handle revision of the permit administratively if any problems occurred. Request for an 18.5 foot Rear Yard Setback Variance to Permit a Garage Expansion, 6712 Hopi Road, Michael Woitalla. Mayor Mancino asked for clarification on the percent of votes needed to pass this request. Request for an Amendment to Conditional Use Permit, 40 Lake Drive East, Abra Auto Body & Glass. Mayor Mancino asked for clarification of the complaints that had been received at this site. Kate Aanenson stated it was outside storage and trash removal complaints. Roger Knutson stated that the City Council had little discretion with this item except to attach conditions to the Conditional Use Permit. Councilman Labatt asked if the applicant was asking for this amendment because they had been cited for non-compliance. Kate Aanenson stated that they could not comply with the existing conditions of the CUP. Correspondence Discussion. Scott Botcher stated that he had received a letter from the Meier family and asked that the City Attorney look into the matter. Under Administrative Presentations Scott Botcher stated he wanted to provide an update to the City Council on the school siting process and discuss a request by the Fire Department. He also stated that Ruby Tuesday's had cancelled their purchase agreement to build in the city and that another party was looking to acquire the site soon. Councilman Senn stated that he had been receiving a number of calls from residents about the poor quality of the water in the city and asked that the item be looked into.
