WS 2000 08 28CHANHASSEN CITY COUNCIL WORK SESSION AUGUST 28, 2000 Mayor Mancino called the work session to order at 5:40 p.m. COUNCILMEMBERS PRESENT: Mayor Mancino, Councilman Senn, Councilwoman Jansen, Councilman Labatt, and Councilman Engel STAFF PRESENT: Todd Gerhardt, Sharmin A1-Jaff, Teresa Burgess, Bob Generous, Bruce DeJong, and Andrea Poehler, City Attorney. Teresa Burgess gave the City Council an update on the city water tower repair and the problem with loss of water that occurred because of water usage in the city. The loss of water caused problems for a woman in the Lake Minnewashta area. Consent A~enda: me Resolution Establishin~ Just Compensation and Authorizin~ Purchase of Lots 998-1000~ Carver Beach. Mayor Mancino asked if the City was buying these parcels with an option or if they would go through the city process prior to purchase. Bob Generous stated that the variance request would go through the city process. Mayor Mancino asked if the variance should be approved prior to the city's purchase. Bob Generous stated that the purchase would be contingent upon approval of the variance to making the lots into a buildable lot. Councilwoman Jansen had questioned staff regarding the value being placed on the property and Todd Gerhardt passed out a handout with numbers he had prepared. Mayor Mancino asked if the City Council was comfortable with the County Assessor's appraisal or if the city should get some independent appraisals done. Councilman Senn stated it would be cost prohibitive to get additional appraisals. Be Eckankar~ Final Readin~ of Rezonin~ to PUD~ Approval of Land Use Amendment~ and Amendment to Site Plan Approval (#00-5). Councilman Senn asked that staff clarify what Eckankar will and will not be paying for with this rezoning compared to if they kept the zoning as is. He also stated staff and Eckankar needed to clarify who would pay for traffic lights if the need arose due to traffic coming from this site, and asking for ongoing payments from Eckankar for changing the guiding on the property from residential, which is taxable, to office commercial for a church, which is not taxable. Mayor Mancino asked for staff input on Councilman Senn's suggestions. Todd Gerhardt stated he agreed that the City and Eckankar should engage in further discussions to resolve these questions. Mayor Mancino asked for a legal opinion on whether this item could be tabled for discussion with the applicant. Councilwoman Jansen asked if this would be a big surprise at the last hour for Eckankar and Bob Generous stated that the issue had not been brought up before. Todd Gerhardt stated he felt it was an important enough issue to table the item before final approval is given. Mayor Mancino stated that this item would be tabled. C. Set Special Meetin~ Dates to Canvass Election Results. A new handout with a change in dates was passed out to Council. Councilman Senn asked for clarification. City Council Work Session - August 28, 2000 D. Approval of Bills. No questions were asked on this item. E. Approval of Minutes: Councilwoman Jansen asked if a vote needed to be clarified from 4 to 1 to 3 to 1. It was stated it didn't affect the results of the passage of the item. F. Set Dates for Truth in Taxation Hearings. After Council discussion, 6:30 p.m. was set as the time for the hearings to be held. Ge Request to Re-Advertise "Request for Proposals" for a Cable Communications Franchise, Wide Open West. Mayor Mancino asked for clarification on this item from staff. Todd Gerhardt stated the city would go through the same procedure they did for Everest. The Council expressed concern about the number of Cable TV boxes being visible throughout the community. 3. Site Plan Review to Allow a 39,910 sq. fi. Expansion for Classrooms, Gymnasium, and Library/Offices, etc. to an Existin~ Buildin~ and a Variance to Allow a 30 Foot Front Yard Setback, 7707 Great Plains Boulevard, Chapel Hill Academy. Councilman Labatt asked about the height of the gymnasium and the height of the trees used to screen it. Sharmin A1-Jaff stated the applicant was proposing to plant 6 foot trees. Councilman Labatt asked if the city could require 12 foot trees and was told the city could require taller trees to be planted. Councilman Senn asked if the city has received many telephone calls from neighbors on this item. Sharmin A1-Jaff explained there had been concerns raised, but a number of them were private matters between Chapel Hill Academy and neighbors regarding right-of-way issues, views, and land ownership. Councilman Senn asked if overall the neighbors were comfortable with this expansion. Sharmin A1-Jaff stated they were, except for possibly George Shorba who would be losing air flow because of the height of the building. o Request to Subdivide a 2.17 Acre Parcel into 4 Single Family Lots on Property Zoned RSF, Residential Single Family and Located at 6330 Murray Hill Road, Arvidson's Addition, Mike Arvidson. Councilman Senn asked engineering about the access for the Middle School from this property. Teresa Burgess stated it would be used for neighborhood access mostly, but some buses would use it because it offered a safer entrance than off of Highway 41. Councilman Senn expressed concern about school and the amount of traffic this would generate through the neighborhood. Mayor Mancino asked if building a through street at location would force development, and who would be responsible for paying for the road to be built. Teresa Burgess stated the developer would pay for the road. Mayor Mancino stated that entrances to public facilities such as schools are usually off of collector roads, not local neighborhood roads. Teresa Burgess wanted to emphasize to the City Council that she would strongly object to approving a private road as proposed. Buildin~ on Property Zoned lOP and Located at 950 Lake Drive (Lot 1~ Empak Addition)~ Amcon Construction Company~ Emplast. No questions were asked on this item. Correspondence Section. Mayor Mancino thanked staff for the Senior Housing Market Update that was provided. Councilman Labatt asked if there had been any response from Paws, Claws and Hooves. Staff stated they had not received anything to date. Mayor Mancino asked if City Hall would be open for tours during the Minnesota Cities Week and what distractions it would cause for staff.
