WS 1999 09 27CHANHASSEN CITY COUNCIL WORK SESSION SEPTEMBER 27, 1999 Mayor Mancino called the work session to order at 5:35 p.m. COUNCILMEMBERS PRESENT: Mayor Mancino, Councilwoman Jansen, Councilman Senn and Councilman Engel COUNCILMEMBERS ABSENT: Councilman Labatt STAFF PRESENT: Karen Engelhardt, Kate Aanenson, Todd Hoffman, Elliot Knetsch, Bob Zydowsky, Anita Benson, Bruce DeJong, and Sharmin A1-Jaff Consent Agenda: g. Approval of Bills: No questions were asked on this item. c. Resolution Establishing No Parking along Audubon Road Adjacent to Pillsbury. Mayor Mancino commented to the newspaper that they should alert the public as to this no parking resolution. Resolution Establishing a School Speed Zone Along Coulter Boulevard Adiacent to Bluff Creek Elementary School. Councilman Senn stated that he would be pulling this item off of the Consent Agenda for discussion. Resolution Approving Use of the Southwest Regional Light Rail Transit Route as a Snowmobile Trail. Councilwoman Jansen asked about the City's insurance coverage and liability for maintaining these snowmobile trails. Todd Hoffman explained that there was no additional cost to the city for insuring this trail, and that the City is ultimately liable for the trail maintenance, even though the Snowmobile Club maintains it. Councilwoman Jansen also stated that she thought the 11:00 p.m. curfew was too late and wanted it changed to 10:00 p.m. Councilman Senn asked if the Snowmobile Club was aware that the snowmobilers would not be able to use this trail for too many years in the future and Todd Hoffman stated that they were aware of this because of the city's continuing growth. f. Declination of Offer to Purchase Tax Forfeited Property. City Council Work Session - September 27, 1999 Councilman Senn asked if the procedure was to offer this property to the adjacent neighbors first for purchase, which Mayor Mancino said was correct. Councilwoman Jansen asked if this property would be something that the HRA would be interested in purchasing. Kate Aanenson stated that on all properties such as this the City looks at these properties internally to see if they would be suitable for public use. The City had looked at this piece and decided it was not. h. Approval of Minutes: No questions were asked on this item. i. Approve Resolution Regarding School District 112 Levy/Operating Budget. No questions were asked on this item. Update from Bob Zydowsky, Chief Law Enforcement Officer and Mark Littfin, Fire Marshal. Mayor Mancino asked how many people had been picked up on Pleasant View Road. Bob Zydowsky stated that the County Sheriff' s department was compiling a report to present to the Council. Bob Zydowsky asked when the no parking signs would need to be enforced on Audubon Road. Karen Engelhardt stated that the no parking would not go into effect until after the item had been published, which would be in approximately two weeks. Consider Approval of Business Subsidy Guidelines; John Dean & Kennedy & Graven. No questions were asked on this item. Ruby Tuesday Restaurant, Lot 1, Block 1, Villages on the Pond 2nd Addition, Alliant Engineering, Inc: a. Consideration of an On-Sale Intoxicating Liquor License. Councilman Senn asked if an additional condition could be placed on this item that it is contingent on a favorable background check being completed on the operating manager. b. Consider Site Plan Approval for a 5,223 sq. fl. Restaurant. Mayor Mancino asked about enforcement of the weeds growing on the Villages on the Pond property. Bob Zydowsky stated that the ordinance states that it is enforced until September 25th. Mayor Mancino asked if the number of lights on a building were regulated by ordinance. Kate Aanenson stated that would be hard to enforce the number and is enforced by the applicant submitting a photometrics plan. Councilman Senn asked if this project had the required amount of parking spaces for a restaurant. Sharmin A1-Jaff stated that this project would have a cross access agreement for parking with the adjacent property. The Council was concerned that the City Council Work Session - September 27, 1999 parking lots needed to be completed at the same time so there would be adequate parking. Staff stated that the building permit had been submitted for the adjacent property and was just waiting for approval of this site plan to start construction. Councilman Senn asked about requiring fake windows on this building. Kate Aanenson stated that the Planning Commission had asked that the back of the building be designed to look like a front of the building and the applicant had submitted a design adding other architectural features in response to that request. The Council stated they would like more fake windows placed on the building. 5. Chanhassen Cinema. Staff stated that this item had been withdrawn by the applicant. Councilman Senn asked if staff could look at options under the TIF agreement to cover maintenance and upkeep of the building. And the Council also asked staff to check into the temporary sign for the cinema and give a report to the Council. Conceptual PUD Request for a Mixed Housing Development (414) Consisting of Manor Homes~ Court Homes~ Village Homes and Townhomes on 82.8 Acres and 3.7 Acres of Commercial Uses; Located on the Northeast Corner of Highways 5 and 41~ Arboretum Village~ Pulte Homes. Anita Benson updated the Council on an e-mail she had received from MnDOT on the Highway 5 upgrade project being possibly delayed due to staffing problems at MnDOT. The Council asked her to write a letter from the Council stressing the importance to the City of Chanhassen that the Highway 5 upgrade project be completed in 2000-2001. Councilman Senn asked for clarification of what PUD conceptual review entails. Kate Aanenson explained the process to the Council. Mayor Mancino emphasized that there was no need to rush to a decision on this item because of the size of the project and the importance of it's location. 9. Individual Sewage Treatment System~ Mandan Circle. Kate Aanenson stated that this item was informational for the Council. Mayor Mancino asked if the City is liable for experimental septic systems and what type of system was being requested. Kate Aanenson stated it was a type of mound system. Elliot Knetsch stated that there wasn't a lot of risk involved by the City by approving this.
